Law / Working in Poland while being self employed in the UK and paying tax and in there [24]

Hello,

Myself (British) and my wife (Polish) currently live in the UK with our 2 children (Both British Nationals). We are both self employed owning our own Business registered here in the UK. We have had this business for 2 years and obviously pay UK income tax.

We are moving to Poland this year in the summer to live. After much research and conversations we have read and heard conflicting information.

We understand (and hope) that we can Live in Poland and keep our business registered in the UK and pay UK income tax. Purely because of the greater "tax free" allowance you get in the UK. We wouldn't want to pay tax in Poland as well as the UK obviously.

90% of our business/product is sent to the UK, the remaining 10% is sent elsewhere worldwide.

We have heard conflicting information that if we live in Poland for more than 6 months then we would have to pay Polish tax instead of UK tax.

Could anyone clarify this?

Hello,

I'm refreshing something hat has been touched upon a few times but my situation is a little unique.

Myself (UK), My wife (Polish) and our 2 children currently live in the UK. We have our own UK registered children's clothing business here in the UK. It is a Partnership business and we are therefore both self employed.

We would like to move to Poland and continue our business. Our business is ran from our home. We would sell our UK house and buy a house in Poland for which we would need a mortgage for. We have already viewed many houses in Poland and have at last found the perfect house. We are I. The process of talking to Mortgage lenders and the tax office in Poland.........It is all very confusing and we keep hearing conflicting information.

As I understand - In order to get a mortgage in Poland we need to keep our business as UK registered. This is because if we made the business a Polish business they would need 2 years of Polish accounts to lend the mortgage money. I.e we would have to rent somewhere for 2 years before we could get a mortgage for our own house. We do not want to do this. Also, we need to somehow show that we earn in PLN. So we keep the business UK registered and have to show we earn in PLN, how are we supposed to do this correctly? All of our items on our website are priced in British Pounds. We use PayPal to receive money so would a simple solution be to convert our PayPal statements to show PLN??

Also, I understand that we would of course have to pay some form of tax in Poland. As we would be self employed in the UK, how would this work when living in Poland and what would we have to pay? I heard 1000PLN per month per person (myself and my wife) is that payment the equivalent to our NI in the UK?

There are so many questions that have been raised. This is just a start. Any info would be great. I'd like to speak to a British national that has done something similar too if anyone knows of anybody.

Thanks for the reply. So in your opinion, would the easiest/cheapest way be to set our UK company up as a limited company?

If we do this, do we still need to pay the social insurance of 1100PLN per person?

And by turning our company into a UK LTD company, we just have to pay Polish Income tax instead of any UK tax? I don't want to by liable to pay taxes in both countries.

Thanks, Would the cheapest way be to register as self employed in Poland then?

I have just received some advice from a person that works in a tax office in Poland.

As I now understand, our best route would be to transfer our UK partnership into a UK limited company. Then open up a Polish branch of the limited company. As the UK and PL are in the EU there would be double taxation relief meaning that we would only be taxed in the UK (corporation tax of 20%) and cannot be taxed again in PL. By doing it this way we would also avoid having to pay the Polish social security of 1100zl per month. The only downside of this is that currently as a partnership, myself and my wife get a large "tax free" allowance (approx £10,000 each) whereas if we go limited then the company will get just one £10,000 allowance rather than us as individuals.

I have read that if you open a new business in Poland (self employed business) then you only have to pay "preferential contributions" which is 445zl per month instead of 817zl per month.

Can anyone confirm this?

If this is true, does there become a point where it would change to the normal rate after a few years?

Any info would be good.

UPDATE - So on further investigation with our friend in the tax office over in Lublin, it appears the best way forward for us would be to close our company here in the UK and register it as a "self employed" business in Poland. We would fall under the 32% tax rate and also have to pay 445zl per month each for 2 years then it would jump to the higher rate.

This would be the cheapest way for us. We're taking a hit in paying more tax than here in the UK but the saving we gain from a Polish lifestyle more than makes up for that loss.

Our friend at the tax office has given us details to her friend that works for PKO bank and apparently they would be happy to give us a mortgage on the basis above. We just need to call her this week to organise. It looks like things are moving forward at last.

I (uk citizen) am moving to Poland towards the summer with my wife (polish) and our 2 children.

We run our own online company here in the UK and we have employed a polish tax advisor to suggest the best route for us. Poland is very different for paying taxes than the UK. Polish taxes are considerably higher however if you have a clever tax advisor it can be avoided legally! :-)

I can't wait to get over there now. I'm heading over in May for meetings with our advisor and bank. Exciting.

Hello,

I'm looking for a Polish bank that offer a mortgage in a foreign currency (GBP)

I have spoken to GetIn bank and they do not offer it.

From searching on here I can find old threads where this has been discussed, I just wondered if anyone had any recent knowledge. I am aware of the change that happened earlier this year that made things more difficult.

If anyone knows of a Polish Bank that still offer this please let me know.

Hello,

I'm seeking some advice. I am the owner of a UK company and I have employed a Polish Tax advisor. Ultimately I am looking to relocate from the UK to Poland. My Polish tax advisor has advised that our company can be left in the UK whilst we live in Poland without any problem. This is great as she told me we would only need to pay UK tax.

However, this now poses a problem for us when it comes to getting a mortgage. Our financials more than satisfy the Polish mortgage criteria other than the fact we earn in GBP. The banks have told me if we earn in PLN than we can get a mortgage without a problem.

Here's the question - Can I somehow show the UK company earns in PLN to satisfy the banks request?

I should have said that our company is a UK based self employed partnership however I can change this to a ltd company if needed.

Every bank in Poland I have spoken to have said I need to be earning in PLN rather than GBP. If I can show them that without having to pay Polish tax then everything is fine.

I can avoid paying Polish tax because I won't have a Polish income. My tax consultant has told me this. I also won't have to pay ZUS as I will get healthcare covered by the EU. As long as I don't have a Polish income everything is fine. I just need to satisfy the banks for the mortgage.

Very interesting comments Peterweg. We have employed a Polish Tax advisor and they have categorically told us in writing that we can leave our business in the UK and still reside in the Poland without paying polish tax or ZUS. Our consultant/advisor has quoted us all the statutes that would allow us to do this. She also told is this can be set in concrete by the ministry of finance for a small fee and the local tax offices cannot override it. This is a professional we have employed.

The mortgage is the main problem for now. I'm in the middle of speaking with millennium bank now.

The tax rate you mention in Poland is called "line tax" where you pay 18-19% flat rate and lay your ZUS fee. You don't get your tax free allowance like the UK though. Our consultant has told us that keeping the business in the UK is the best option for us for cheaper tax reasons and as mentioned before has stated this as possible.

Please excuse me on this. My knowledge is limited on it all I have merely been repeating what my Polish Tax advisor has told me. I have paid her for this service. I will look at the paperwork she sent me and post it here again. From memory it does have something to do with a 2006 tax agreement.

Ok, so the document I received from our Polish Tax advisor in Poland is a 5 page document so fairly long. In this document she discusses all of our possibilities when we move to Poland including if we moved the company to Poland. I've cut the majority of it out but you should see her point, apologies for the broken English :- ....

Summing up in the context of the facts it should be made clear that if the taxpayer, who is a Polish resident (and that you intend to be) receive income both in Poland and in the UK, it should account for the income using the method of avoiding double taxation ( the taxpayer settled in the UK, according to the British tax law, and shall submit a return in Poland- the tax paid only once). However, if a taxpayer Polish tax resident, he received only foreign income (did not receive any other income in Poland) do not have to settle tax in Poland, because its income is exempt from tax in Poland. It should be noted that some of the Polish tax offices require in such a situation, receipt of PIT zero (there are different practices). In terms of payment of social security contributions in Poland (in the facts) I received information in the Social Insurance Institution (ZUS helpline tel. Phone 22 560 16 00), that if the person involved does not conduct business in Poland he or she is not obliged to pay any contributions. In case of any illness the use of medical care on the basis of the European Health Insurance Card. I want to also inform that in Poland there is an institution submitting to the Minister of Finance requests for individual interpretation of tax laws with respect to the facts (for printing ORD-IN). Issued by the Ministry of Finance interpretation of the rules is binding, the taxpayer, who to apply it is protected by such an interpretation. I Inform about this on the grounds that you can take advantage of this by presenting the facts accurately predicted, due to an official from one application is 40 zł., Plus a fee for the person preparing such a request. With this interpretation of the taxpayer it is confident that his actions will not be challenged by the tax authority in Poland. The time issue interpretations by the Minister of Finance is three months from submission of the application.

Let me know your thoughts. I have paid for this and she has clearly done her research.

Regarding the medical care I'm not too worried about this as I will probably opt for private healthcare anyway.

Getting the mortgage is my new obstacle. Im awaiting a reply from Millenium bank. They are the only bank I have found that has a proper "English" section on their website and it specifically talks about accepting varying income types. I'm hoping we will fall under this category as every other bank I've spoken to so far have a problem with the fact we will earn in GBP rather than PLN - hence my original question in this thread. :-)

Life / Poland after one year of living here [105]

Hi,

I am a UK national about to embark on a big move to Lublin with my wife and 2 children.

I am from Nottingham and I'm 32 years old. Personally I have been visiting Lublin 8-9 times a year for the last 6 years and I have to say I love the culture, the family togetherness, the weather. I must admit Polish people are very opinionated and are not scared to show it. My polish wife also hates this attitude but we have taken the "water off a ducks back" approach. The main thing we find is that Polosh people have a certain way to look after their children and if you don't do it their way then you are wrong. Whilst frustrating we just ignore it and carry on. An example would be children wearing hats, on a mild winter day they would make their children wear woolly hats just because it's "winter" and would totally look down on you if your children wasn't doing it and make snide comments like "oh someone must be warm". My wife normally bites back at them, I just find it funny.

Anyway that's my main downside to the polish attitude, everything else makes up for it.

I think OP should stay another year. Personally, I'd be a hell of a lot more miserable living away from my children.

I (UK citizen) will be building a house on land in Piland in the near future. I will be buying a "project" from a developer and have them finish the house leaving just the internal finishes. It's such a good way of doing things in my opinion.

Life / Money Advice for expat in Poland: better using English bank card for transactions or Polish bank account? [2]

Hi everyone, just looking for some advice.

I am very soon moving to Poland from the UK with my Polish wife and 2 children. Im British. We have our own online business which we will continue to run in Poland.

Currently all of our bank accounts are based in the UK. All our business income therefore goes to our UK bank account. We will be closing our UK business and opening it again in Poland once we arrive.

We will be opening a Polish bank account once we arrive but I'm unsure how to deal with our money. Should we begin life in Poland by just using our English bank card for transactions in shops etc. Or should we leave all of our savings in a UK bank account and transfer an "amount" every month to our Polish Bank to cover us for the upcoming month then use our Polish bank account. Or should we close all of our UK bank accounts and transfer every last penny to a polish bank account......

I'm unsure how to deal with this part. Any advice would be appreciated.

Hi,

I'm just researching the best way to transfer large sums of GBP from a UK bank account to a Polish Bank account.

I am moving to Lublin from the UK next month and because of the current poor exchange rate I'm looking into options.

One option that I have found is to open up a Bank account with Danske Bank here in the UK and put all of my money into that. Then open up a Danske Bank account in Poland. This bank offers free transfers between its accounts in different countries. Are there any other banks that both have a presence in UK and Poland?

Any other ideas would be appreciated.
