My point is that if during a sexual encounter
So it is exactly what I have gathered from you. It all sounds reasonable and sensible on the surface but it is stupid and crazy.
Sure in theory that should happen and probably happens a lot more often them not. However, if you want to criminalize some behavior you find not to your taste, you need to ask how would that work in practice.
Because what I see is a classical scenario - she said he said. How is she going to prove that in fact, she refused d to have sex with him?
You see, they are both in bed or on the table or whatever and they are making out, they are here with a certain intent to have a go at it, and then what?
Assuming she changed her mind at the last moment and he didn't notice or refused to take it seriously, what happened next is she goes to the police and says what happened - he denies it or plays stupid or is genuinely surprised. How is she going to prove that she was 'raped'? She can't!
The only way.
Well, there are two ways but the other one is wrong so I don't bring it up, if she was resisting and he beat her up to subdue her that is and she can prove it by her wounds.
The other way is if the law goes crazy in the direction you want it to go and her word will be the law, if she says she was raped it means she was and that is the truth.
You see, that's where I draw the line. I can well imagine that a couple has consensual sex and the day after or a week after she goes to the police and reports the rape to screw the dude over, in your world that would be possible and that would mean that many innocent men would be done for. Hence your position is silly, unethical, and immoral.
The best way for women to stay safe is to have sex with a long-term partner or husband, not some random encounter with people they hardly know. Simple!
