Hey wise people,

This is my situation, my girlfriend and i have a son together, expecting second child next year, we are planning to take a mortgage loan together for a house, and we will be 50/50% ownership of this house, i am putting the down payment of 20% which is about 90,000zl.

My question is, in case we break up, what am i looking at ? she said we can sign agreement with notarius regarding how we will share the house if we break up and she will have to give me part of my down payment. we have been talking about it for weeks, still not sure if it is right decision to make.

Any suggestion will be appreciated.

Thanks for your comment, i am not looking forward to any breakup, am Polish and i've been living in Poland for 20 years, everything is good with us now and i hope it stays the same forever, she is awesome but who knows...i've been divorced once...that is enough :)

It is always good to secure ones interest especially in term of mortgage together with girlfriend, i guess lawyer is the best one to talk to, what do you recommend, lawyer or notariusz ?

We are not actually married, just boyfriend and girlfriend and am not planning to be married, she knows this...only that we are planning to be living together and thinking getting mortgage together. only thinking a way to protect myself.

Well, am thinking we should take mortgage together (even though i can take it myself) so that she will be liable to pay because i think if i took it on myself and we are living there together and she is paying contributing like 1000zl monthly, it might be jointly owned based on her contribution, so why not include her in the loan....even though her inclusion does not help to get better deal or

and am thinking of doing separation of asset as many people as suggested i.e as for the house, we co-owned it 50/50 and i am putting down the 20% of the mortgage, so am suggesting we should go to notariusz to sign some agreement incase we break up, we will sell the house, and she will give me back my 20% and if we do not agree on selling the house...then the court should sell it and if she can not pay me back my 20%, it will come out from her shares of selling the house.

I have told her that and she agreed just wondering what else to add.

I am divorce from my ex and i can tell you it is not pretty, even when we do not have any property together, Better protect yourself than to be sorry in the future.

a friend of mine got divorce, paying alimony, paying his own rent (small apartment) and paying his mortgage while the ex is still living in the house cus she said she doesn't have anywhere to go and have 13 and 11 yrs old kids.

I think the best thing is to protect oneself, i do not want to break up with this lady, she is awesome but who knows after 10 or 20yrs.

Btw you're not the only one taking a risk here;.

That is 100% true, i truly hope we will live the rest of our lives together and in peace, hopefully, she will agree the 60/40%, thank you for your input, i know more now than i knew two days ago :)

I am wondering if applying for kredyt hipoteczny, will the bank know if i am paying Alimony for the kids? and around how much you must be earning to get at least 500,000 PLN?

I have been to several banks, i was in PKO and told the lady about my salary and paying 1500 child support, she put everything on their simulator, and said they cant offer me the 500,000 that i wanted, they can offer me 350,000.

Then i went to Mbank, they said they can offer me 571,000 meaning 400,000 for the loan and 171,000 is loan fees, I went to Alior bank today even though many people said dont use Alior, they said they can offer me 310,000 but with partner, we can get 550,000.

if anyone can suggest other bank for me, that will be great, i will be visiting them all, just to collate their fees and conditions together to decide on which one to take.

I am Polish citizen, and relatively good job, after paying child support, i still have about 5000 after tax, i will check out ING offer and hopefully they will be better than the rest.

Came to give the update from Kredit advisor.
He check most of the banks for us and with our financial capabilities, we are able to secure a 500,000 loan from banks, Alior bank have highest Rata przejściowa 2,443,27 zl and also Calkowity Koszt Kredytu 292,982,19zl, we have option in Santander and Mbank to choose from.

Overall, it is better to use credit advisor because, as he said, will be applying to 5 banks from us and if we are ever rejected from any, he will tell us why.

Now the question remain, should we build ourselves or buy developer standard house which of course will not be finished and still will need at least additional 120,000 zl.....we still researching anyway, any suggestion will be highly appreciated.

Thanks guys for all this advice, yes you are right @jon357 we shouldn't take mortgage that is at the limit of our finances, that would be like suicide, i believe we will check another broker to see what they offer.

Building yourself economically

We were optioning for Szkieletowy, that probably will be faster to build and less costly compare to normal brick houses.
We spoke with few construction companies, most of them said it takes them about 3 to 4 months from start to finish...

Fingers crossed, we still haven't decided yet but will definitely check other brokers to see what they can offer, this is a life time investment and commitment, i hope to do it with at least 1 or 2 mistakes....0 will be preferable :)

Hi, am sorry, you are experiencing this unfortunate event, however, as per general rules regarding renting and accomodation, you can not terminate a contract/agreement, most of the time you need to give 2 month quit notice, vis/versa, the manager or landlord can not send you packing also without notification for at least 2 months.

If you do not like the place, i dont think there is much to do regarding that, hope you did not sign agreement for one year and most of those manager/landlords put some clauses in the agreement saying if you terminate the contract you will not get your deposit, you have to always have agreement written in English language if you want to take next room/apartment....YOU MUST UNDERSTAND WHAT YOU ARE SIGNING.

You too do make a will and register it in Poland.That piece of papoer mean shi/t in court otherwise.

yes this part i must do because i have other 3 kids, of course they are entitled to something incase something happen to their pops. I've discussed this with my partner and we both agree it is better to do. so we are good in terms of understanding each other.

Hi, sorry i did not update my post since, well, we just signed the contract, now mortgage is crazy with everything going on with the war and and creditworthiness, we finally secure one with ING with the help of credit advisor, we had three option (Bank) almost similar offer with 20% down payment.

I have notariuz from the seller of the house, they both work in the same office, there is nothing relating to notariuz from signing agreement with the bank.

Law / Divorce in Poland - birth certificate issue? [5]

As you have married in Poland, i believe the divorce should be done in Poland, i know many family that got married in Poland and moved to Germany for example, the court in Germany advice to get the divorce in the country where the marriage took place, even though you have registered the marriage certificate there in UK (in order for it to be valid) as per staying in UK, the divorce has to be done in Polish Court, all you need is a Polish lawyer in the same city where the marriage took place (of course that does speaks English).

Divorce practically lasted for around 6-9 months, your lawyer can also call the court or write to them to check where is the process at time.

Sorry, you have to go through this mess but i think soon to be ex is right.

Hi,

Will like to ask, how does it work regarding dividing a property in Poland, me and my partner decided to get a house together, i put down the 20% (100,000) of the house and also about 120,000 PLN for renovating the house to livable standard. and my salary is about twice as much as hers

However, i think it is fair to say, i am to owned 70% of the house and 30% goes to her?

No. Whose name is on the title deed "ksiega wieczyste" ?

Perhaps we can put two names on it, and we are saying if something goes wrong we will sell the house and divide the proceeds as per % of who owned what.

We are thinking to put that into the deed, we do not know if any of what we are thinking is actually right in terms of law.
