News / Throwing away the constitution in Poland? [626]

pro-Opposition members

Hey toothless granny from "Sami swoi", when the PO-led govt had the Tribunal stacked with its subservient flunkies you and other "rule of law"-spouting Michnikites and Petrus were strangely silent about that miscarriage of justice.

PiS will only have 2

So at least you admit that the judges are not impartial arbiters of constitutional law but party hacks -- PO has these and PiS has those.

never respected the rule of law.

And the PO did when they illegally appointed two extra judges back in June? Get down from your feigned moral highground, because you well know every poltical party is self-serving and uses high-sounding slogans as their fig-leaf.

You remind one of the old, illiterate toothless grandmother in "Sami swoi": "The law court is the law court but justice must be on our side." At least she was sincere. You try to cloak Realpolitik in pompus rhetoric.

appointed illegally

I don't know why I should be explaining all this when it's all over the news. PO-PSL had a right to appoint only those whose terms were due to expire during the PO-PSL govt's term but they illegally extended it to two judges whose terms expired under teh successor PiS govt. By rights Duda should have sworn in the three legal ones and decliend the illegal twosome but refused to swear in any of them. So both sides committed the same mistake of overstepping their competence.

subverting the rule of law

Rule of law is a nov'ble concept in theory, but in practice it is yet another trendy catch-phrase or buzzword invoked by politicians when it serves their purposes.

As Marshal (speaker) of the Sejm, on 10th April 2010 Bronisław Komorowski became interim president following the death of Lech Kaczyński, although Article 131 of the Constitution states that the it was the Constitutional Tribunal that should have entrusted him with that post. Somehow that oversight did not bother PO, Gazeta Wyborcza or Richie Petru!

Only goes to show that politicians do what is expedient and serves their political interests and fall back on those rules, regulations, laws and constitutional passages that give them an alibi. Machiavelli rules!

PiS government

The PO birdbrains and their hayseed sidekicks back in June saw the writing on the wall - that PiS would win the election, so to ensure themselves of the abiltiy to stymie PiS legislation they appoitned 5 Tribunal judges -- 3 of them legally, 2 illegally. They thought nobody would notice the fast one they were trying to pull, but they were easily seen through and President Duda declined to swear in all 5. The present government passed a bill appointing five new judges, 4 of whom have been sworn in. The 5th will be sworn in within a few days when her predecessor's term in office expires. Each side is accusing the other of undermining the constitution but both sides share part of the blame.

But the constitutional crisis is but a pretext. It could have been about speed radar traps or test-tube babies. The bottom line is that the losers are totally committed to continuing the wasteful and debilitaitng Polish-Polish War they launched in 2005 rather than working for the good of the nation. The sooner PO disappear from the political stage -- the better!

Oblivion

Oh dear, sob-sob, boo-hoo, whom will the Brit Bullies and their PF toadies brown-nose once the P(rime) O(ffenders) disappear from the scene? As arrogant look-down-on-your-fellowman elitists, most likely they will transfer their admiration and loyalty to hard-nosed, everything-for-the-oligarchs Petru and to hell with Poland's common man!

name-dropper,

Just part of the job. I had to converse with and pick the brains of all kinds of people including commie and GW scum.

Merged: Justice has been done: Kamiński & Wąsik are free men!

A Warsaw court has overturned convictions against the former head and deputy head of Poland's Central Anti-Corruption Bureau (CBA), following pardons issued by President Andrzej Duda in November.

Both men currently occupy key positions in Poland, with Mariusz Kamiński serving as the country's secret services coordinator and Maciej Wąsik as secretary of state in President Duda's Chancellery.

Kamiński and Wąsik had been given three-year prison sentences in March 2015, seven months before conservative party Law and Justice returned to power in the October general election.

The original sentences concerned exceeding their powers in 2007 while running the CBA during Law and Justice's coalition government of 2005-2007.
According to the March 2015 verdict, Kamiński and Wąsik had illegally started an investigation into the ministry of agriculture - then run by coalition partner the Self-Defence party. The court also found that the CBA was guilty of forging documents and carrying out illegal phone tapping in connection with the probe.

The verdict had not become final when Law and Justice came to power in October 2015. President Andrzej Duda, himself formerly of Law and Justice, pardoned both men on 16 November.

He claimed that the verdicts had a "political character" laying the blame on the Civic Platform, which led a coalition government between 2007 and 2015.

he was never imprisoned

Michnik's " man of honour" Jaruzelski sent Lech Kaczyński to an internment camp during his martial-law crackdown on Solidarność, but let his twin brother go free. As Jarosław once told me, "I think they wanted to have someone to follow who might lead them to underground Solidarity cells, fugitive activists and clandestine printing operations."

PO had the decency of doing that in secret, hiding it from public

That's a new one. Being sneaky and not getting caught is a virtue in the PO bible, I reckon.

extracts members

No-one can be extracted against his will! As for Merkel, moving tricky Don to Brussels may be her only claim to fame. She really botched up the refugee thing. Had glib, slick and slippery Donny remained in Warsaw, he may well have succeeded in keeping the wool pulled over the eyes of the Polish public a while longer.

Now the orphaned but ever power-hungry Platformers are thrashing about in impotent, frustrated fury. They seem to forget that in a democracy one party cannot always win, but they appear determined to continue the Polish-Polish War they started in 2005 by deriding, slandering and discrediting their successors and undermining and sabotaging their efforts. Apparently they hope the incesssant attacks and provocaitons will somehow, some day enable them to derail or overturn the government and lead PO back to the feed trough.

And you are accused of mindless, chronic PiS-bashing. Rather than think in terms of the country you have joiend the embittered, frustrarted and resentful Platformer mudslinging and backstabbing team whose only goal is the discredit and badmouth the party they lost to. Somehow you were strangely silent when the PO thieves were at the feed trough.

At least the new state forest bloke has had experuience in that area. Even if he hadn't, a minister is surrounded by experts and advisers and does not need to hold a PhD in the field his ministry specialises in.

successful countries

The US is notorious for its winner-take-all approach to cabinet and administration forming. The cushy, prestigious posts including attractive ambassadorships go to trusted party loyalists and/or generous campaign contributors.

PO didn't claim to be paragon of virtues

How could they that band of thieves and scammers?!

Every sensible politician prefers working with associates he knows and can rely on than picking random appointees off the streets. Name any party (may only Kukiz becuase he lacks the poltical savvy) that prefers a motley ragtag crew to people of proven worth and commitment.

enable PiS to lower

Many developments can at times become the unintended collateral results of other things. But the PO regime did not rob OFE for that purpose but to plug up holes in their mismanaged and overextended budget.

Who will you blame

Whoever's to blame. Already the Platformers are providing a preview of the storm-out temper tantrums and mud-slinging they intend to pursue to keep the Polish-Polish civil war blazing apace. They are outnumbered luckily but their barrage of false accusations and slander will require time-consuming clarification and therefore slow down the United Right's planned reforms and return to normality. That is obviously the devious tactic of the PO losers so they can later complain the Right did not promptly fulfil their promises.

Duda, Kaczyński, Gliński, Macierewicz

Still better to look at than shifty-eyed Tusk, two-faced Sikorski, squinty Kopacz and crafty Schetyna... The only exception is Mucha.

Yes, there were abuses during MacCarthyism but let's not forget what was happening behind the iron curtain at that time and how the US was being infiltrated by spies and fellow travellers. Judaeo-Commie Hollywood has tried to make marytrs of the Rosenbergs, Chaplain and others and to villify McCarthy, and that narrative has been propagated by the leftstream media. But the drastic threats of that period (to mention only Soviet GRU agent Alger Hiss in the US State Dept) required drastic counter-measures. It was comparable to the current ISIS threat.

crushing win in 2018

More pipe-dreams? PO is finished, washed up, kaput. They are already being eclipsed by Petru and most likely will not clear the 5% threshold in the next election. All their temper tantrums only show them up to be the losers they always have been (but temporarily managed to conceal it) and always will be.

After the United Right clear the playing field, they will be able to clean up the mess left behind by the Platformers and start building the Poland of our dreams.

post-election political scene

PO is doing everythingn possible to stoke the Polish-Polish war which it launched back in 2005. Tusk and Rokita were so shell-shocked and traumatised by their dual defeat at the polls that they lost their minds and when they came to PO started doing everything in their pwoer to sabotage and undermine the work of the democratically elected government.

Now they're back to their old tricks, even worse, acting like a spoilt brat that didn't get his way. At least the Petru group can be admired for holding their own and hurling questions at the government, whislt the Platformers stormed out and held a briefing, now get this -- one the stairs. Any honourable oppositon would have stayed, voted against or abstained without throwing cry-baby temper tamtrums.

They thought they werte so clever last summer when they forced through a measure that would ensire a Constituional Tribunal fully controlled by PO. Although they didn't have a majority in the Sejm or Senate, they felt at least in this way they coudl obstruct or overturn the government's measures. PiS luckily caught onto their little ruse and has prevented the planned take-over by a losing party.

Do you realise how the West's foaming-at-the-mouth leftstream media are working overtime to badmouth and discredit the democratically elected Polish government? What are YOU DOING to correct the negative stereotypes and distortions?

Oh, almost forgot, you're part of the same badmouthing team!

You, who have never uttered a peep about PO's numerous "irregularities", never questioned, contested, disputed or even doubted a single of their moves and misdeeds, have got the audacity to lecture the Polish government on what procedures and time-frames they should follow.

It was all over the TV news channels right after teh election. They were constantly showing słupki according to education, occupation, place of residence, age, etc. and saying for the first ime PiS has eclisped PO in most categories. Also that only 2 of the 16 voivodshisp suported PO. Go back to 26-27 Nov. and you'll find plenty.
