Hoping to receive multi billion funds from the EU, PiS rulers are going to cancel their pseudo reforms which spoiled the judiciary system in Poland and allowed rightists to prosecute independent judges when they didn`t follow PiS party line and dared to initiate legal proceedings against PiS members who broke the law.

In order to opress independent judges, PiS nominated its own "judges" - sort of enforcers. Now one of them, Piotr Schab, is going to have legal problems coz his recent career advancement under PiS is seriously questioned:

Three legal, "old" judges of the Criminal Chamber of the Supreme Court decided on Wednesday that the sentence issued in 2020 in the Warsaw Court of Appeal by, among others, the current president of this court, Piotr Schab - who has been the central judge's spokesman for discipline since 2018 - and by his subordinate in the office of the spokesman, Beata Łabuda, will be overruled, and the case will be re-examined in the Warsaw appeal.

Agnieszka Prętczyńska, attorney-at-law, applied for such a solution in the summer of 2022 . It was she who applied for an independence test for Schab. In the application addressed to the Supreme Court, she indicated that Schab should never judge anyone. - Mr. Schab is a pending, biased and politically dependent judge. This is what I wrote in the application for an impartiality test against him, and I uphold this opinion, attorney Prętczyńska told us in August 2022.

- He did not comply with the final judgment regarding the admission of Judge Igor Tuleya to adjudicate, which broke the law. He was promoted thanks to the politically appointed National Council of the Judiciary, and besides, he was elected a judge of the Warsaw Court of Appeal without the required opinion of the General Assembly of the appeal, she mentioned.

All of this, coupled with his hasty appointment to the panel hearing my clients' case, begs the question - is he an independent judge? Prętczyńska asked.

- The Supreme Court has clearly indicated that no test of independence is needed here. And this is because Mr. Schab's career path and his promotions raise serious doubts about his independence almost every month , the lawyer points out. - The Supreme Court therefore relied on the conclusions of the defense in this case that the panel that tried the case in the Warsaw SA in 2020 was incorrectly staffed, which is an absolute prerequisite for appeal, says Prętczyńska.

My God, I am so proud of all this majority of judges and other people of law who retained their decency and didn`t allow PiS to intimidate them into subjugation.

It is strictly amasing how PiS politicians lie not only to their voters and non-voters but to each other as well. They are obsessive liars - nobody has lied as much as them so far. Probably only communists did but that was over 30 years ago.

PIS is negotiating a new deal concerning the independence of the judiciary in order to receive the withheld funds from the EU. The President has already objected to not being consulted by his PiS buddies on the matter.

PiS Minister Buda writes on Twitter:

Today I know that the talks that are being held with the president after this statement placate him siginficantly. I do not suspect that there are any problems at the president's level with accepting the solutions that are being negotiated with the EU.

The final summarising commentary:

PIS was trying to suppress independent judges and take over the whole judiciary for themselves so that they could steal, get corrupted and cause accidents without any legal consequences. They nominated their own renegade judges and members of legal institutions, sometimes breaking the Constitution and Polish law.

It proved useless in the end.

The vast majority of Polish judiciary resisted gallantly, with the help of the EU which defended the rule of law in Poland. PIS lost the elections. The new gov is going to introduce necessary changes soon.

After a storm there is the sun. ALWAYS. All pessimists, remember about it.

Ziobro's man fatally knocked down a woman on a crosswalk. He hasn't heard any charges for 4 years

Artur Dziadosz, former deputy head of the Prison Service, fatally hit a woman on a crossing four years ago. To this day, he has not been charged, although a year ago the case was supposed to be "at its final stage". Now Dziadosz, appointed by Zbigniew Ziobro, heads a powerful state-owned company.

This text may sound familiar because we wrote about this case exactly a year ago. Let us recall: in 2019, Artur Dziadosz, then deputy head of the Prison Service, hit a 69-year-old woman on a zebra crossing, who died in hospital as a result of her injuries.

The accident case was conducted for a surprisingly long time. Even though investigators had surveillance footage, testimonies of 8 witnesses and 3 expert opinions, they were unable to bring charges against Dziadosz for three years, and the case was passed around between prosecutors' offices like a hot potato.

In December 2022, the spokeswoman of the prosecutor's office assured us that Dziadosz's case "is at its final stage". Now, a year later, it turns out that he is still gambling, and Dziadosz has still not been charged.

Meanwhile, Dziadosz retired shortly after the accident, and immediately afterwards - on the nomination of Zbigniew Ziobro - he became the head of a powerful state-owned company. Both at the time of the accident and in the following years, Dziadosz held high positions in institutions subordinated to the former Minister of Justice and the head of Sovereign Poland, which ruled Poland together with PiS in 2015-2023. Ziobro, as prosecutor general, also supervised the activities of the prosecutor's office.

In 2023, as if nothing had happened, Dziadosz showed off in the company of Sovereign Poland politicians during various events related to the prison system.

The accident occurred at the beginning of November 2019 on one of the main streets of Kozienice, with a population of 17,000. The city is located on the route for drivers traveling from Rzeszów to Warsaw. Artur Dziadosz was crossing this road when a 69-year-old woman appeared on the pedestrian crossing.

According to our information, the course of the accident was as follows. The woman stopped in front of the stripes, she was wearing dark clothes, but the backpack had reflective elements. First, she let passing cars pass, but finally decided to enter the crossing. Then it was hit by a Mazda driven by Artur Dziadosz.

The woman was conscious, although in shock. She was taken away by an ambulance. A few days later, as a result of internal injuries, she died in hospital.

Investigators very quickly collected key evidence: CCTV footage from a nearby gas station, a quick autopsy, then traces from the victim's clothing, interviewing eight witnesses and securing the driver's phone billings. They also had three expert opinions.

An interesting thing: according to the information of "Dziennik Gazeta Prawna", the analysis of Artur Dziadosz's phone billings indicated that "at the time of the incident, an Internet data transmission was running on the driver's phone." What does it mean? Dziadosz could then listen to music, use car navigation or browse social media. To be sure what he was doing, the prosecutor's office decided to examine the official's phone.

It failed - during the search, Dziadosz explained that he had lost his phone while on vacation at the lake.

Instead of coming to an end, the meticulously conducted investigation was suddenly postponed. First, from the District Prosecutor's Office in Kozienice to the District Prosecutor's Office in Radom, then to the District Prosecutor's Office in Lublin. It got stuck there for good.

As we found out a year ago, the experts' opinions were similar, but they shared the blame for the accident equally. The woman was about to suddenly enter a pedestrian crossing.

Despite the convergent opinions and complete evidence, prosecutor Andrzej Wójcik, who is conducting the investigation, said in a conversation with us a year ago that "the evidence so far did not provide grounds for bringing charges", and the prosecutor's office was to order another - already fourth - expert opinion.

- In my opinion, the prosecutor's office is trying to discontinue the case and whitewash the perpetrator of the accident - ​​the daughter of a woman who died as a result of an accident told us a year ago.

After our publication, the then deputy minister of justice, Marcin Wójcik, explained the case. On Radio ZET, he talked about Dziadosz's "personal drama" and the media's attack on him. He argued that the accident occurred "during the rainy season."

Here is a short story of financial frauds and scams in certain credit union called SKOK closely connected with PiS. The first charges appeared in 2016 but after PiS had come into power in 2015, PIS prosecutors delayed the case as long as possible. It

An indictment has just been brought to court against 32 people associated with SKOK Wesoła in Mysłowice: former heads of the management board of the union, members of the supervisory board, important employees and members of their families.

The Katowice prosecutor's office accused them, among others, of: for mismanagement, misappropriation of property, accepting financial benefits, certifying untruths in documents, forging documents - enumerated on the website of prosecutor Małgorzata Zawada-Dybek, spokeswoman for PO in Katowice. The notary who certified the financial scams is also expected to appear in court. The damage resulting from the allegations was calculated at PLN 282 million.

Spółdzielcza Kasa Oszczednościowo-Kredytowa Wesoła was established in 1993 with its headquarters in Mysłowice and connections with the Mysłowice-Wesoła mine. It had branches in 12 voivodeships and 64,000. members - customers who paid PLN 650 million. Wesoła, like all credit unions, belonged to the National Fund, headed by Grzegorz Biernacki, later a PiS senator and an important person in Kaczyński's party.

In 2007, after PiS lost the elections, many prominent party officials found shelter in SKOKs. When they returned to power , they spread a protective umbrella over SKOKs and repaid their benefactors as much as possible.

From the very beginning, Wesoła fell into the hands of its own people - primarily activists of the mining Solidarity movement and their families. Loans were granted to people without creditworthiness for bribes. The prosecutor's office found that members of the supervisory board signed contracts with their wives, children and aunts for fictitious services, which were completely unnecessary. Children (allegedly) handed out advertising leaflets, wives (allegedly) praised Wesoła during social gatherings... and everyone took money for it.

It is therefore hardly surprising that in 2013, SKOK Wesoła recorded a loss of over PLN 160 million and was on the verge of bankruptcy. The Polish Financial Supervision Authority stepped in, and two years later a receiver was appointed, who dismissed all members of the management board and some of the management staff on disciplinary grounds.

The case was brought to the prosecutor's office and dragged on for eight years. Since 2016 - I found out at PO in Katowice - excessive involvement in the investigation against Wesoła was frowned upon by its superiors. If it weren't for the change of government, it would probably drag on forever... Towards the statute of limitations.

The acting national prosecutor, Jacek Bilewicz, asked the regional prosecutor in Lublin, Jerzy Ziarkiewicz, to clarify the matter of storing files. Ziarkiewicz allegedly blocked cases involving PiS politicians for years and kept files of inconvenient cases in the garage. The case was described by "Gazeta Wyborcza". Everything came to light when a driver from the prosecutor's office complained that he had nowhere to park his car because the garage was full of files. Ziarkiewicz is a trusted person of the former Minister of Justice Zbigniew Ziobro .

Prosecutor General Adam Bodnar filed an appeal against the decision of the deputy disciplinary attorney to discontinue the proceedings conducted against the prosecutor of the District Prosecutor's Office in Świdnica, Maciej W., who walked naked around one of the housing estates in 2021. The man was reinstated to his official duties, but the prosecutor general wants the case to be reconsidered in disciplinary proceedings.

This excerpt means that PiS tried to sweep the matter under the carpet coz the streaking performer had been nominated by PiS earlier on but after the change of power, the new prosecutors are going to look into the matter again. Good!

More problems for Judge Nawacki. An investigation is to be launched in the prosecutor's office

The National Prosecutor overturned the decision to refuse to investigate the case of the former president of the court in Olsztyn, Maciej Nawacki - reports OKO.Press. This concerns Nawacki's actions towards judge Paweł Juszczyszyn.

In March 2024, judge Maciej Nawacki was dismissed from the position of president of the District Court in Olsztyn . Earlier, Nawacki was suspended, and Justice Minister Adam Bodnar announced that he would lose his position, among others. by abuse of power against judge Paweł Juszczyszyn, whose suspension lasted 839 days. Only in December 2023, after over a year of working in another department, Judge Juszczyszyn returned to adjudicating in his home civil department.

As determined by the OKO.Press portal, the list of Maciej Nawacki's problems has become longer again. On April 29, 2024, the new national prosecutor, Dariusz Korneluk, annulled the decision to refuse an investigation issued on December 29 last year in the internal affairs department of the National Prosecutor's Office - it was issued by prosecutor Kamil Kowalczyk. As the portal notes, this will be the first investigation into Nawacki's actions towards Juszczyszyn.

"Now, in a new investigation, the new prosecutor is to assess his behavior in terms of exceeding his powers or failing to fulfill official duties under Article 231 of the Penal Code and in terms of violating the judge's employment rights, as provided for in Article 218 of the Penal Code," adds OKO.Press.
