POLISH ALIMONY ART S209 need advice and help

Hello,

I recently learned that I may have legal problems under Article 209 §1a of the Polish Penal Code because of unpaid alimony.

I remarried in 2019 and now have three children.

Since 2019 I have not been paying alimony because I was living abroad and then moved to another EU country.

My financial situation has been very difficult, and I support my current family on a modest income with partial social assistance.

I now wish to resolve this matter legally and fulfill my obligations according to my financial capacity.

My questions are:

1. How can I apply for a court-appointed defense attorney (obrońca z urzędu) in this case?

2. Can I request a translator (I do not speak Polish well) for the proceedings?

3. What is the best way to settle or discontinue the case under Article 209 §1a if I start paying regularly now?

4. Can I apply to reduce the alimony amount because of my current family responsibilities and low income?

5. Since I live in another EU country, is it possible to handle this matter remotely/online without traveling to Poland?

6. Can communication with my appointed lawyer be in English?

7. If I am living in another EU country, can I be arrested or extradited for an alimony case under Article 209?

Living abroad is not an excuse to get out of alimony, legally and morally

Though really you need to see a lawyer and spend some money - a problem for you if you are not even willing to spend money on your own kids food and clothes.

SIR I AM SENDING HERE ACCOUNT BUT IT REFUND AND YESTERDAY I again sent here account alimony but today 3rd of September returned in my account?
I have all proof some can suggest me what to do

Regarding point #7, it's very unlikely you'd be arrested for avoiding alimony payments because it's not a criminal offense.

P9lamd is one of the few countries in Europe where people, usually men, are regularly jailed for non-payment of child maintenance.
