Her position will be a lot stronger, but mainly because it is a Polish court, the judge will be female and you egyptian boys have a bad rep in Poland. Polish family courts are notorious for being biased against foreigners and males.

So it will be kind of as if you sued her in egyptian court where your cousin's a judge.

Unless you get a good and expensive lawyer she will legally f-u-c-k you 'til you bleed and then obtain a court order barring you from having much ( if any ) contact with the child.

You're only lucky in a sense that she won't be able to collect any alimony payments ( not that you can afford them ) off you, since Polish court orders are probably impossible to execute in egypt.

By all means please do, it may lose some in the translation, but Nowicki ( the older male protagonist ) gives a good performance.

Indeed some of them weren't fortunate and got side-swept as the new law on currency exchange took hold ( 1989 if I recall right ).
Others were ready and opened up many legal businesses that dealt with currency exchange and pretty much made millions ( check up the background on the Real Estate developer from GPW called "Gant" ).

Just like with the officers from the political police, some were ready for the new system and ended up running banks, others weren't and ended up as rent-a-cops.

There's a halfway decent Polish movie about slightly earlier days which deals with money changers. It is called "Sztos" I believe and stars Pazura and Nowicki ( the latter, in my humble opinion, would have made a career both in UK and US had he been educated either in Britain or the States ). It has its moments, although I don't know if You can get a decent translation.

Back in the 1980's I rarely dealt with these guys because ( that's not said in the film I mentioned ) they all worked as informants for the infamous Polish political police. I think getting this job was actually one of the perks that came along with being an informant. But when we really had to we had these 2 semi-trustworthy guys ( they worked as a duo ) in Warsaw we dealt with. One of them is obscenely rich right now, no longer needs to work. The other one is... well, dead, and some people that knew him from back in the day said his death was mafia-related.

when I posted my earlier post about female university students putting out for a dollar in the 1980s, I expected to get absolutely chastised by dozens of readers accusing me of spouting nonsense. I am not an Arab gentleman, neither was I studying in Poland in the 1980s so I have to rely on my friend telling me the truth, having said that he was not the sort to bu11sh1t.

I conducted business in Poland in the 1980's through a "firma polonijna" and I've gotten **** on this site for describing some of the stuff Polish women would do in the 1980's.

Let's just say that I'm not in the least surprised by what You wrote. We had a saying in our little expat group in Warsaw that there had to be something wrong with a foreigner who didn't get laid in Poland, Polish women were basically throwing themselves at foreign guys and the almighty Dollar indeed often had a lot to do with it.

1) For a guy who supposedly lived in U.S. for a long time Your English is simply abominable, yurek.

2) From a legal standpoint You seem to be ******, but rest assured that there are dozens of lawyers in Poland that will tell You otherwise and milk You for what You're worth.

3) Don't expect to pay Polish lawyers peanuts nowadays, You and them might have a different idea about what "good money" is. I noticed it very often with Poles who left Poland for U.S. and still think everyone will fall all over themselves for a few bucks in Poland anno domini 2011.

If its a good lawyer and the apartment is worth over 1 million zloty don't expect to pay less than 100.000 zloty for his services.

5) I'll be very blunt now --> You made Your choices yurek and one of these choices included shipping money ( ridiculous amounts by Polish standards, semi-ok amount by U.S. standards ) to Poland and not protecting your investment. The reason you got interested in the case is purely monetary, after you discovered one can no longer purchase a flat in Poland for chump change. Don't expect any sympathy from a Polish court here, they'll look at the facts of the case and probably quote what I quoted on p.1 after rejecting Your claim.

Hardly a legal scholar here ( I hire my own lawyers ), but how You expect a court of law to take into account black market prices of any commodity while looking into the matter is really beyond me.

Maybe not if he paid for the property, he still may have a legal interest.

Please re-read carefully what I wrote on p.1. Also, expect to hear a story from yurek about the precautions him and his precious wife took to prevent anyone from stealing their shiny U.S. dollars, which will most likely make proving the fact that he paid her anything rather difficult.

But by your reasoning, a couple could buy twenty rental flats and then when they divorce 25 years later one party assert that the other had no claim to the properties as no use had been made by that person of those properties.

It also depends on when she acquired the flat and when they divorced (from what I'm seeing, they didn't own the flat when he left but she acquired it at a later date).

My reasoning is perfectly ok, thank you.

If I need to spell it out: If he was removed from the deed by way of illegal or underhanded means and 30 years passed from the date of said removal art. 172 par. 2 of the Polish Civil Code protects the sole right of "ownership" of his wife. She can claim that in any court after he files whatever his Polish lawyer draws up for him.

It is a little something they refer to as "zasiedzenie" in Poland, it applies to real estate and based on the very same article a hobo who builds a shack on someone's plot and manages to live there unnoticed and uninterrupted for 30 years could try to claim ownership.

He could theoretically claim there were interruptions of her stay in the flat and that if anything might be able to save him if 30 years indeed passed from the date I mentioned. Also he could theoretically claim that she obtained his removal by way of crime which would, if I correctly understand, make all the fruits of such behaviour unclaimable in civil court ( my lawyer knows this stuff better, sorry ) but the Polish criminal statute of limitations covers her on this end.

I would also like to point out that I am rather well-versed in the "zasiedzenie" related issues, as some of my Jewish friends who tried to reclaim property were blocked exactly by the article and paragraph I just quoted. So unless someone is going to make a properly backed up legal argument please don't tell me I don't know jack in this particular matter.

Not really, if he "left Szczecin 36 years ago" and during that period his wife was in possession of the flat without any breaks she has already obtained ownership regardless whether she ****** him out of it by the book or not --> art. 172 par. 2, Polish Civil Code, as mentioned before.

She could have walked him out of that flat at gunpoint, if he didn't do anything about it for 30 years passed its all fine and dandy according to Polish law.

She payed it off with my $$$ I was sending her from US

Amazing what rising property prises in Poland bring out in people. Not talking only about Poles, either.

Anyways, statute of limitations in Poland is 10 years and ownership of real estate passes from the legal owner to the person that uses the property for 20 years, 30 years in case of bad faith ( article 172 par 2, Polish Civil Code ).

That's Polish Civil Law 1.01 and it pretty much means You're screwed.

In case you haven't noticed, des essientes ( and why should you ) after years and years of leniency UK is cracking down on non-EU immigration. I guess the cheeky ones amongst us will say that nowadays we got the Polish doing their work, but the bottom line is this:

UK is looking into limiting non-eu immigration and is actively plugging all the holes in our immigration law, so to speak.

Now, Poland, Bulgaria, Romania, etc. - often they don't even know such holes exist, so a trick that worked 30 years ago in the UK works just fine over in Eastern Europe.

And since obtaining residency in Eastern Europe equals obtaining EU residency nowadays, small wonder people from 3rd world countries are trying.

While I am a fan of secular Turkey ( other alternatives aren't to my liking ) I must say you're completely off your rocker.

If a candidate has completed 1 out of 33 if I recall correctly requirements in 20+ years, then they're simply a lousy candidate or they're unwilling to make any real concessions - it is as simple as that. Sugarcoat it all you want, that's the logical conclusion.

The funny part is that most of Eastern European candidate states that made it into the EU in 2004 weren't really that much better off than Turkey when they started.

For all those talking about 1st world and 3rd world (which are redundant cold-war definitions), Turkey was a first world nation, being a member of NATO since 1952, while Poland was a second world nation, being a founding member of the Warsaw pact.

Or one could turn this around and say Turkey has been whining to get into EU for ages and is constantly being shot down, because - surprise, surprise - it doesn't meet the criteria which often fit rather well into what defines a developed country. So far Turkey has closed 1 acquis chapter out of 33 and its been working on it since 1987 ( date of petition ).

Poland on the other hand is already in the EU.

Well in this case, bud, it is fairly simple.

You walk into a bar/club, you ask if they have an opening. They don't - you leave, they do - you stay and start bartending. Probably will help if you learn Polish by the time you start doing the asking.

Don't expect to make much money.

No, there isn't a foundation in Poland that will pay you that kind of money because you consider yourself brilliant and if there was one it would be swarming with Polish applicants since stipends for academic achievement in Poland rarely exceed 80 euro/month.

Midas may be harsh but on this matter he has written the truth. He pulled no punches but why should he on such a serious issue?

I take it a lot of people just don't consider this a serious issue, which in my humble opinion is rather staggering.

Back in the day UK indeed had a system protecting us from illegal immigrants, visa scammers and alike and while the system wasn't by any means perfect, we have learned a thing or two about the methods they use.

Now all this has gone down the loo, because Polish/Bulgarian/Czech immigration officers are easily falling for the tricks that our former immigration officers ( now redundant, I presume ) learned to deal with 30 years ago.

A lot of people from non-eu countries get legalised in Eastern Europe and then move over to pastures greener, it is a simple fact.

Everything I'm seeing is pointing towards the UK slowly but steadily trimming down the amount of immigrants from non-EU countries. Might have something to do with the recession. Also one can easily spot an increase in the amount of such immigrants who show up in the UK after obtaining their right to enter/stay in the EU in Eastern European countries.

In my humble opinion, Eastern Europe ( not going to dive into the effects of immigration from Poland to the UK ) isn't doing their fair share of looking into visa scammers and alike. As in many other areas, they're 30 years behind us. Only this time if they screw up, we magically have one more mouth asking for bennies in London or Birmingham, not in Wrocław or Warsaw.

As for the thread, studying can be costly and should be avoided unless you intend to work in that area.
