Excellent point but pointless from a legal perspective. My wife often tells me to STFU but that does not change the text and the spirit of the 1st Amendment.

We are discussing only if you can end up in prison for saying things. You can a lot more easily in Western Europe than in the US where the 1st actually protects "offensive" speech. "I love, my Queen" and "Have a nice day" don't need any protection.

Bottom line: The US version of "free speech" is the only one worth having and everything else is a pretend bs. Europe is notorious for it, just as the USSR used to be. The Soviets had the free speech clause in their constitution somewhere, too. With a couple of asterisks as chill pills but it was there.

"Moron" is not a medical or legal term. It's a one-word opinion and, therefore, subjective. Hence, not prosecutable where sanity is normal. It seems Poland is not one of those places.

If Duda said that Poland can win a military conflict with Russia, that would be so stupid that it could be safely called moronic. In fact, it should be classified as insane and be viewed as a medical issue. Still, no crime committed by the speaker.

This is what happens when a country does not have the First Amendment but does have the Truth Commission.
Duda, by choosing to be a public figure, should have no legal protection from political comments - even if those comments are "insulting". At best, if untrue and damaging, he should be able to sue for libel.

Or worse. In this case, the trial would be beyond ridiculous and center on the definition of "moron" and what "is" is. Sounds familiar? If I were the judge or a juror, the defendant would need to show only one instance where Duda said something really stupid and was (is) a "moron" at that exact moment. Nobody is something all the time.

In the US, they wouldn't be able to even file the charges with the court clerk.

I am also sure that Jews were hiring Poles as eagerly as Jews and didn't object to mixed marriages. They also didn't mind if one of them switched to Christianity to keep his Polish Catholic wife happy.

There is nothing wrong with racism in a country as monolithic as Poland. Poland could just as well post "Blacks - stay away" at every border crossing as is Poland's right.
