Poland - getting a tenant out (post-lease)

I have a tenant who was several months in arrears on his rent. His rental contract expired several months ago, and I sent him a registered letter requesting he vacate the property. He hasn't.

I am getting conflicting advice as to whether I can call the police to get him out (in theory he is occupying my property without a valid lease) or whether I have to go through the full eviction process, which the lawyer I consulted said can last up to three years.

Has anyone had any experience with a problem such as this?

dude that process is too long and tiring.If the electric is on your name get it shut,If that will not work then get some Ukranian/Russian/Armenians guys buy them vodka,throw them cpl of zlots and they will take care of the rest:)Thats what I did in 2007 in one residential I have.After that rent it to a American.I still have that tenant 13 years and raise rent 100 pln every year,is my best tenant who is never late even in these crucial times.

If no contract is in place then knock on the door, when he opens it grab him by the collar and throw him out, lock the door behind you and call the police, possession is 9/10ths of the law, put his stuff out of the window, make sure you have proof of ownership on you.

I would not do the dirty work myself,let the ruskis handle it there way.

That could cause more complications , its better from a legal point of view to claim your own property back , ie he stepped out on the pavement saying he was leaving and I went into my house and closed the door behind me.

Doesn't say much for his choice of tenants, I would stick to Americans,Germans Austrians etc, always a mistake to rent to economic migrants, IT professionals and business managers on short term contracts are the gold standard when it comes to tenants.
