Arabic guy - my wife left with my son away, she wants divorce. My rights to my son? Permanent residence card.

Hello everybody,
i am an Arabic guy, i was married to a Polish woman since 2008 till now, i live in Krakow . we have a two years old son. my wife left me and took my son away to her city near Rzeszow two months ago. she wants to divorce.in this time i was trying to get the permanent residence card but they told me in the imigration office that i cant obtain it because we are not living as a married couples anymore.

my question is what is my rights as a forigen father to my son?
in which purpose i can apply for residence in poland ?

Certainly not on marriage basis.

That doesn't seem to pass the smell test. After at least six years here you should have already been given the ten-year card.

True talk Harry! I married in 2011 and now was just granted my stały pobyt. Maybe he got a different law bro.

Maybe you have bad nose.The guy could be married and living outside Poland where he cannot apply for the card and started living in poland in last couple of years.

Harry am sorry, i didnt mention that we moved to poland two years ago since my son was born

I know its a very old post, but I assume you should qualify for a residence permit as the parent of a Polish/EU citizen.
