Getting registered in a house in Poland after getting married to a Polish citizen? [2]

There are two types of residence registration:
* Temporary stay (generally up to 3-months)
* Permanent stay.
Temporary stay registration
Up to 2 months:
Temporary residence should be registered if we know that the time of our stay will exceed 3 days and we should report to the office no later than 4 days from date of arrival in the specified location.
In the case of report for a period of two months we make the application orally at the town hall in the presence of the owner, or the person who holds any other right to the flat / house in which we live.
Depending on the office practice varies - sometimes for a period of 2-3 months, you can report orally, sometimes you must fill out a form, then apply the rules listed below.
Over 3 months:
In certain cases, a temporary check exceed three months. This includes people who:
- are employed outside the place of residence,
- are staying in a different place in connection with: educating, treatment, recreation or for family reasons,
- are taking active military service or are placed in prisons, correctional institutions, in detention centers or shelters for minors.
In these cases, it is assumed that someone is in a different location, although for more than three months, but the stay did not lost, however, the temporary nature.
In order to check-in, we have to fill out a form (available at the municipality office or on their website), which contained our data, ie:
* name (with family name), and first names,
* previous names and first names,
* parents' names and surnames,
* first names and last name of the spouse with the family name,
* marital status,
* gender,
* date and place of birth,
* citizenship,
* PESEL number,
* address: the former and the new place of permanent residence,
* type, series and number of identity document and information about education.
In addition, we provide also:
* the intended period of stay,
* confirmation of residence at a given address made by the person with the right to property
* for inspection by the official: confirmation of the above rights to the premises: eg. a copy of the Book of Perpetual, or property purchase agreement, court order (eg. a inheritance statement).
In order to check-in (regardless of the period), we need to identify ourselves by using:
* valid identity card,
* passport,
* abridged copy of birth in the case of minors who do not have an ID card.
Permanent stay registration
If your stay in a different location will exceed three months, and we do not meet the criteria for long-term temporary meld, or we plan to permanently settle in another place, we have to check in for permanent stay.
1. Check out.
To register for a permanent (or temporary residence) in another place we must check out from the previous location. To do so we must go to the municipal office in the place of registration and fill out a form. Personal data originally given at check-in shall be indicated. Check-out must be made no later than on the departure day. We obtain a certificate of checkout, which will be required to check in at the new location.
Check out by the change of residence is the same obligation as the check-in in the new place.
2. Check-in.
Check-in procedure at the place of residence is similar to that for temporary stay for more than two months.
We fill only another print: ie. Notification of permanent residence.
In order to change the place of permanent residence check out statement from the former habitual residence should be submitted.
The request can be submitted in person, or through a family member, guardian or actual legal or any other person authorized by us.
Change of permanent stay require Polish ID card to be replaced. The application for a new ID must be reported within 14 days from the date of check-in. Cost: 30PLN.
3. Children check-in.
Check-in of newborns is made in the Municipal Office, based on the information reported to the Civil Status at birth. Notification of birth is considered to be synonymous with the check of a child:
- In place of permanent residence of mother (in principle)
- In the place of permanent residence of the person with whom the child actually resides
- Or in a place designated by the Court of Guardianship.
On behalf of minors and incapacitated persons the residence place report is made by their legal representative (parents, guardians, curator), or the person who actually has custody.
Then a shared residential address of carer and the minor / incapacitated will be the address.
There is no need to report a temporary stay of less than three months in respect to children under 7 years-in.
NOTES:
Failure to comply with the registration obligation generally is not a big problem - the law enforcement agencies are not interested in sample verifications, however during the inspection of documents the authorities may be interested in the absence of such report.[/i]
