That is true but now that the barricade is set up and antagonists lined up on either side the judges know which side their bread is buttered on. If PiS had 14 and PO 1, that wouldbe a different story. Now PiS has 6 and PO 9.

That is still the PiS govt's policy.
Personally I think that's a mistake. Some other way of monitoring constitutionality should be devised, perhaps transferring that job to the High Court. Candidates should be screened for being free of political ties and commitments. Perhaps no-one who ever belonged to a poltical party could apply.

In many ways a govt spox or company spox are the same, They do not dispense the truth but only what which serves their master's interests.

Someone as intelligent and politically savvy as cannot possibnly beleive all the high-sounding rhetoric (meant for Joe Slob and his Missus) alleging that courts and tribunals are indepdnent and judges are impartial because that is written down in some document. Judges are first of all human and subject to all the concerns and temptations off all people everywhere. The Tribunal judges know PO appointees still dominate and rule accordingly.

The Supreme Court which suffice to deal with the constitutionality of laws in the USA.
Mutliplying bodies (offices, desks, computers, staff, cars, etc.) is wasteful esp. for a poor country like Poland. There should be a 200-seat Sejm and 50-seat senate and govt cars should be Opel Astras except for the President and PM

who migth be assigned Vectras. Also all elections should combine national. local and any referenda being conducted. Huge savings! That would ensure a better turnout. People do not like to be herded to the polls. And terms of office should be standardised -- either 4 or 5 year terms for all. Waste not, want not! Grzech marnować! Kto nie marnuje, temu nie brakuje!

What a skewed comparison! You really are clutching at straws. (I prefer the Polish,,sih version: a drowning man clutching at a razor!). According to oyu a casher at Biedronka can be comapred to a polticla party on the take. A political party influences legislation, the workings of government and the life of the nation and as such should not be on the payroll of foreign sponsors. That has nothing to do with individuals who have little if any influence on the common weal.

Another aspect of this whole row which has hardly been mentioend is PO's desperate bid to continue its TK monopoly. Although pluralism is the cornerstone of democratic governance, PO had 14 appointees on the 15-man TK and their hasty appointment of 5 new ones was intended to perpetuate that imbalance. When the only party in post-PRL Poland ever to democratically win an election outright tried to improve the compositon, PO launched yet another all-out battle in the ridiculous, wasteful and destabilising time-, energy- and cost-consuming Polish-Polish war.

That seems to be a pattern. When PO lost in 2005 they also went into shock and rebounded with furious, no-holds-barred attacks on the democratically elected government. It appears the PO views democracy as comrpising only one of two options: either they win or throw a destructive, destabilising tantrum!

Are people in a country whose ruling party (for the past 8 years) was an agent of influence or lobbyist serving foreign interests and where many people are mercenaries in the employ of foreign corporations that channel their profits abroad -- OPPRESSED OR NOT? Thanks to slick and glib PO-style propaganda they may not think they are. Especially if they get plenty of bread and circus!

I know yiou're not that naive and are only pretending. Urban also proclaimed there were no poltical prisoners in martial-law Poland -- only criminals who had broken the (PRL) law. Politicians, whether PRL or PO, have a nice euphemism for everything they do, and you know it!

Is not that martial-law abomination (TK) not a freak or bastard structure only serving to anarchise Poland's political scene? The more so that it is headed by an ex-commie. And then it has begun ruling in its own case. When it struck diown a vetting law it clearly showed who it was created to protect -- commies and collaborators.

TK ruling

The TK compromised itself and showed their true colours when they struck down a vetting law passed by the Sejm back in 2005-2007. There is much to indicate that the TK is merely a branch of the foreign lobbyists party, PO.

TK itself is not really what it should be

SURPRISE! SURPRISE!
The PO-dominated TK voted exactly the way the PO in their war on PiS wanted. Above all, Jaruzelski's unelected panel rejected the de-communisation of the TK leadership.

A 47-page report issued by Attorney General Andrzej Seremet declared that a decision by the PiS-dominated lower house of parliament to elect five new judges to the Tribunal was not in line with the country's constitution. Other issues which were unconstitutional, according to the Attorney General, were a 30-day time limit for the newly-elected judges to be sworn in by President Andrzej Duda, as well as an amendment shortening the term of the current head and deputy head of the Tribunal. In a recent sitting to rule on the selection of five new judges to the Tribunal by the former Civic Platform (PO) government, the court found that the election of two of the judges had been unconstitutional. The PiS government said that by electing five new judges to the Tribunal it was righting wrongs done by the previous PO cabinet. PiS

PiS hard barely won the election when the Michnikites and frustrated PO losers pounced on them wtih unrestrained fury. They hadn't had time to do anything yet but we heard accusations such as "faszyzacja", creeping dictatorship, etc. Szydło spoke without wrapping herself in an EU flag, Macierewicz became defence minister, State Forests went into the "wrong" hands, an ex-PZPR member was appointed to something (ironic coming from PO, the most ex-commie-riddled of any party now in the Sejm!), etc., etc., ad nauseam. One of your PO lobbyist mate (Delph probably) suggested that the whole TK things was a trap deliberately set by PO which PiS stupidly fell into.

The bottom line is that PO are a client party of Western big-money interests, although rank and file Platofmers probably believe all the freedom and democracy rhetoric PO politicians spout. PiS are an honest, straightforward and, above all, 100% Polish party not on the leash of foreign interests. All that should be considered when discussing the current political scene.

Merged:TK farce continues apace

The TK farce conitnues. That lofty "independent" and "impartial" communist-created body, headed by ex-PZPR member Rzepliński and stacked with PO appontees, are citing paragraphs, points and subpoints in favour of their PO mentor-sponsors. What is the most farcical of all is that the TK are deliberating and ruling in a case to which they are a party. It's like a murder trial where the accused murderer takes his place on the judge's bench and rules on whether or not he's guilty!

In the current untypical case, where the TK itself is directly involved in the row, the Supreme Court or some ad hoc judicial panel appointed by the High Court should preside over the case.

if PO were doing it?

The blind PO toadies would support the ones providing the kickbacks no matter what. The PO can do no wrong, and that attitude is not surprising when one is lobbyist on the take.

PiS government

Foreign Ministry rejects CNN report as one-sided. That's diplomats for you! It was actually a scathing attack on Poland's democratically elected government repeating the slander and lies cooked up by frustrated Platformers and off-the-wall Michnik-style haters.

"We listened to the arguments presented in the last program of 'GPS' on CNN and the article by J. Diehl in the Washington Post with astonishment and surprise," noted foreign ministry spokesperson Artur Dmochowski in an official statement.

"They represent a false and one-sided message on the situation in Poland that is not supported by facts," he argued.
The CNN report claimed that the recently-elected Law and Justice party had "embarked on a dizzyingly rapid power grab that has drawn comparisons with a coup d'etat."

The report also dwelt on Law and Justice's "anti-immigrant rhetoric", which CNN argues has "emboldened" nationalists. A clip showed an effigy of an Orthodox Jew being burnt by nationalists in Wrocław, south west Poland.

The Washington Post article created a similar picture, describing recent developments in Poland as "disturbing" and noting that the new Polish government "could deliver a wake-up call" to Americans.

Poland's foreign ministry has said it will "demand from both editors the opportunity to present the Polish position on these allegations." (nh/di)

There's a huge difference between a façade grouping like sponsored lobbyist PO serving foreign banksters and other outside interests, and a genuine, indigenous political party like PiS. Say what you will about how clumsy, unglib, un-image-obsessed and ham-handed PiS are, but at least they're not on the leash of any outside force.

A nice and catchy saying but totally untrue. Millions of Americans would love to remove Obama but are powerless to do so using democratic means. Peaceful protests outside the White House? A petition drive? A referendum? Impeachment?

And he is also being badmouthed by Michnik and Lis, Schetyna and Miller...the PO hate industry is turning over in top gear and spreading the venom worldwide to the EU, FAZ, Economist, CNN, etc. Trying to improve their image in the eyes of their foreign sponmsoring masters PO seem to be saying: "OK, so we lost the election but do take note of how we are constantly needling, attacking, undermining and sabotaging the democratcially elected president as well as harrassing and destabilising the government at every turn of the way!"

Are you convinced PO and Kukiz will even survive the next election? Petru most likely will to become PiS' chief antagonist. Razem may be the SLD's replacement. PSL will probably not make it but Korwin may do.

Likewise haven't hear of the ZL or SLD, although I got a glimspe of their blonde bombshell (name escapes me at the mo) on one of the talking-head shows but I didn't follow it.

Actually Petru has done quite well for himself in a relatively short space of time. So did Palikot a few years back but lost it.

TK ruled

All that be as it may, one should never forget that the TK was the creation of a dictatiorial communist regime. It was set up as propaganda window dressing to create the pretence of impartiality. Its chief to this day (Andrzej Rzepliński) is a former PZPR member. At present the TK is stacked with PO appointees. All those things should be taken into account when discussing that controversial body.

Merged: What's really happening in Poland behind all the high-sounding rhetoric

All the blather about protecting the constitution againt the threat of a totalitarian dictatorship is yet another clever smoke-screen designed to conceal the machinations of a power-holding group that has managed to preserve their privileges since the ostensible collapse of communist rule in 1989. Behind the scenes, this well connected powerful mafia-like group, managed to get hold of all the key resources of the country and to transform the justice system and media into an effective tool protecting their own hold on power.

This power-holding group consist of two divisions: Operators and Propagandists. The first devises an action plan, while the second implements it and manipulates the public opinion. The first group controls everybody, the second controls primarily the media. The key opposition leaders who are intimately familiar with this holding mafia (like Ziobro, Kaczyński and Macierewicz), have been portrayed by the propaganda group as the greatest enemies of the public. While the Civic Platform was about to prosecute them, it decided not to, out of fear that too much confidential information about their modus operendi would be exposed. Similar plans were pursued with respect to the CBA (Anti-Corruption Bureau) chief Mariusz Kaminski, but President Andrzej Duda through his swift pardon frustrated their plans.

protecting the constitution

Grzegorz Snitchyna, er, um I mean Schetyna has met MEPs to warn them of the alleged horrible threat to Poland's democracy posed by the country's democratically elected government. The ambitious poitician with visions of becoming the next PM has a lot to lose if PiS win the next election so everything must be done to terrorise the international pbulic wtih concocted political horror stories.

Another well-known snitch is Tomasz Lis who stands to lose his cushy public TV post which pays him a greatly inflated monthly salary at the Polish taxpayer's expense, as if his Newsweek editorship didn't provide more than enough cash for any person. Recently he complained to Germany's ARD TV that journalists are persecuted in today's Poland. The sad thing is that many Westerners have little knowledge of Polish affairs and readily believe such nonsense.

Absolutely not. Women should have access to various options: full-time career woman, part-time career woman (some might prefer a part-time job to devote more time to the kids), full-time homemaker, work-at-home (via itnernet) plus homemaker, nun, etc. And all options be equally honourable and worthy of resepct. It's the feminists who try to ideologise things by looking down on stay-at-home mums ("kura domowa") and playing up careerism.
