I need to get my girlfriend back home from Poland - need legal advice

She stayed here 6 years to make money for her family. The problem is that she only had a 1 year visa. Now I am trying desperatly tpo get her back!! does anyone have a good lawyer?

have her to go canada or mexico and just walk across the boarder :)

god knows that it's so easy to cross, look how many mexicans we got here lol

When u over stay your visa in usa, is it possible to come back? Help!

Sorry to hear about your dilemma but I knew a girl that overstayed her visa and
went back to Poland, now she is not allowed to come back for 10 years.

I would suggest a good immigration attorney or go to Poland and marry her that
still might not work????

I heard that too Sledz. It takes about 10 years for the data to be purged, and a person can try again without a record of previous entrance. Mikeracing, I think you need to book a flight to Poland and take your best suit with you. :) You still will come back to USA alone, but you can initiate paperwork for your wife.

I vist to a polish-american lawyer would help too... if you really care.

Good luck fella, love should know no borders.
If you were in the UK i would suggest she converts to radical islam ,then incites hatred of all non belivers , then she'd be set up for life here.......(ok ok I know Poles can come and go here anyway,just a touch of sardonic "wit".)

It's been six years, so here's some advice. Marry her here. Go tomorrow. On Tuesday, start filing your paperwork. If you can afford it, get an attorney. If not, you CAN file it yourself. You will need your taxes for the past several years, a couple of months of pay stubs, proof of your citizenship, your birth certificate, and she will need her I-94 card, as well as her passport, and other documents. File an emergency travel request I don't recall the form, but if her mother, for example is sick, you can use that as a reason. File a one step process packet, it will be faster. As a point of reference, my wife and were married on January 12 of this year. Because her ex was/is an *******, and refused to turn over her I-94 card, our paperwork wasn't filed until mid-February. We interviewed on May 18. Unless your relationship is a fraud, there's no reason they will deny your application. She had her permanant residence card two weeks later. You should be able to travel in less than 90 days. It may seem like an eternity, but after six years, for 90 extra days, everything will be legal. Best of luck.

ps. seriously, if she exceeded terms of her visa once, then you can forget about her getting another one. BTW, say 'thank you' to the US govt which so generously revoked visa obligation for Poles recently.

...or maybe not.

Ya , you have an uphill battle my friend I feel bad for you like I said before,
the same thing happened to a girl I know. She cant come back for 10 years!

Your GF must have known this before she left?

Like RP said you might have a shot through marriage??

y a i am hoping someone has some expierence in this situation...and yes she did know but her dad was sick so she had to se him, understandably....our goverment sucks! why are they so srtict on polish people! they never bombed anyone!!!!

Rules are rules. The Poles don't abide by them. They overstay their visas and there are too many of them coz they lie. If Poles got them visas, which are only for visits, more than half would stay in the US illegally and no lawyer will even touch their case.

The girl won't see America for 10 years. Then if she lucky, she might get a visa to visit.

thats not the point, there are other countries ( illegals) who ruin it for the whole
crowd.. and its understandable if they want to stay.. but it also takes two govts
not just one..

when you have illegals running around Killing people in school yards ( innocent people)
its time to buckle down.. unfortunately thats the way it has to be.

nothing against Polish or any other nation

That why border patrol the US-Mexican border and deport them little black-heads back where they belong. They get smuggled into this country in semis, boats, underground and deported back if they catch em. But they are a sneaky bunch. Poles are much better. They should learn how to sneak into the US...heh heh heh

Poles are much better.

I agree.. but those other sneaky bunch ruin it for the ones who are here working
and want to stay and I dont see that as a Problem.. they dont suck off the
govt.. I never seen any do it here.. and matter of fact they are very well educated
and willing to work... Polish folks that is..
