Life / Political correctness in Poland [210]

If a simolar act of blasphemy had occurred in a mosque... well, you can take it from there.

If the elders in the mosque had been brazenly, openly supporting Putin - then it would have been exactly the same reaction.

it has never been mentioned in any mainstream media sources.

I think we can pinpoint exactly why - the RCC stole so much money from the country that they now represent a very powerful interest group who would run straight to the best lawyers should anything come up.

Stuff does come up now and again, but as far as I know - no journalist has ever investigated the true extent of abuse in Poland. It's not helped by the way that the Church has been caught on several occasions to be covering up abuse, even in Poland.

USA, Canada / Who is better informed, the expat or the Polonia crowd? [144]

they also use the PROPAGANDA language from the old PRL times, which you supposedly hate so much.

It's very interesting - thank you for your comparison!

The similarity in language between PiS and the PZPR is really quite incredible. Perhaps Polonius would like to comment as to why he uses language similar to the PZPR?

But in Poland decent folk are saying these days: Wracaj Jarek do koryta, lepszy karzeł niż bandyta!

What decent folk? The same ones that I personally witnessed attack a young boy for speaking his mind?

Law / Rights of the Foreign consumer in Poland [5]

Can a foreigner bring legal proceedings against a Polish company in a second European nation for goods or services purchased in Poland.

Generally speaking, no. If the foreigner is in Poland and purchased the product in Poland, then the Polish legal system must be used. The concept of legal jurisdiction would apply here - what European court is going to get involved in something like this, especially when they have no idea about Polish law?

Of course, once the Polish law route has been exhausted, then you can proceed to the European level court system.

Under EU directives there are laws to protect the consumer. In some EU companies consumer rights laws are far more mature than in Poland.

Instead of blabbing on constantly about the EU, why don't you try and solve the case using the existing Polish legal structures?

Or alternatively, don't do business in Poland.

Does anyone have any examples of successful cases being brought against Polish companies outside of Poland.

You'd be best to consult a lawyer for advice on this. Generally speaking though, these would concern large amounts of money.

USA, Canada / Who is better informed, the expat or the Polonia crowd? [144]

Because Polonia will never have to live under a PiS government, which means they can vote according to the way that they think other people should live and not according to the way that they themselves wish to live.

I wonder how the 70% vote for the far-left wing economically PiS reconciles with their voting for Romney?

USA, Canada / Who is better informed, the expat or the Polonia crowd? [144]

Still claiming that the dumb US Polonia know what's best for Poland, despite the US and Canada being the only two places in the entire world where PiS won?

Anyway, it's far more likely that Kaczynski will be led away in handcuffs - his actions as Prime Minister are very, very questionable.

Law / Polish Contracts [6]

If a Polish company (large/State) is unwilling to provide contracts and instructions in English it must be considered “Aggressive commercial practice” under EU directive, as the foreign consumer is unable to make an informed decision.

I think you're living in cloud cuckoo land with that interpretation, personally. The cost to the State and business to provide information in all 27 (soon to be 28) EU languages would be astronomical and unaffordable. It's not unrealistic to expect companies to do business in their native tongue. i can imagine the reaction if you expected a contract in Polish from a UK company!

Are Polish large companies obliged to provide contracts in English under any EU law.

No. But you, as the consumer, can walk away if they don't provide it.

I have recently been advised by a well known Polish company, they are not responsible to provide me with correspondence/ Contracts in English, I have no ability in Polish whatsoever, they wish to sell me something and have informed me to bring a translator with me at my own expense. Any similar experiences from anyone and how did you handle it?

That's fair enough. They don't value your business enough to provide a translator, so you're free to walk away.

Quite honestly, why would you bother with a company that doesn't want your business? In my experience, companies are generally happy to source an English speaker if they want to sell you something.

News / Amber Gold and other Poland's suspicious institutions [139]

pity that the likes of Kaczynski got such a bad rap for wanting to go after people like this.....I bet many of those that lost their money now wish he was able to do more.

I'm not convinced Kaczynski would have even touched him - he was notorious for only going after those who had open political connections to perceived enemies. There's no evidence that our boy here was politically linked, apart from quite probably bribing the Gdansk prosecutors.

but i also suspect those Prokurators who had freed the fraudster 3 times and a bunch of officials,...

Hasn't it been made clear that the prosecutors in Gdansk are in big, big trouble over this?

People need a reliable Justice system to turn to like in canada ,Uk etc

It's a failing of the civil law system in general that prosecutors have so much power. In Canada, the UK, etc - prosecutors don't have nearly so much power.

Real Estate / Poland's apartment prices continue to fall [1844]

The polish version of the report actually talks about falling real wages which is correct in many sectors.

That's quite believable -everyone seems to be holding their breath this year.

Though I was correct in picking wroclaw as the worst performing town then on these numbers It's only 12 percent down.

It's not a real surprise - isn't Wroclaw heavily based around services and not manufacturing?

Law / Paperwork needed in Marriage in Poland!! [13]

Are you sure she wants to get married? After all it's not that difficult for her kid to get a polish passport. And why would that matter anyway?

You can just get a Polish ID card for the child - no need for the passport.

Real Estate / Poland's apartment prices continue to fall [1844]

What people say about the polish mentality is only applicable up to a point, normally when the bank starts pressing them to repay their credit.

An interesting question for you - when I was looking for a flat, one of the (as per usual) rubbish estate agents told me that we couldn't negotiate the price on one place because - I quote - "she's in trouble with the bank". Would the banks not want to get as much a a return as possible on the property, rather than having to repossess it?

And yes, I agree - I think that mentality is more often seen when there are multiple owners, or the owner has recently inherited it. I made a distinct point of not even looking at properties with multiple owners (unless it was a couple) - far too much hassle and unrealistic expectations as to price.

For those who think prices can not fall to 2004 levels should note that gant share price (theoretically the sum of all future profits) is at 2005 levels.

But isn't that a direct cause of too much debt rather than anything to do with the selling price of property?

News / Poland - shopper's paradise? [4]

Have any of you seen signs of this?

The German and Ukrainian borderlands - yes. Massively so - when you look at what's built up in places like Słubice, £ęknica, even Medyka - you can see that people are coming in to shop. Certainly, the quality of the meat on offer in Poland surpasses the Czech Republic, Ukraine, Belarus and Lithuania - and the price beats Germany by miles.

the Internet (just Google what you're after)

Why don't you provide us with that single reliable source from the internet? You seemed so certain of those two claims that well, surely you can provide that one source?

Sorry, but 'what a bloke in the pub told me' is not a reliable source.

I did meet several blokes in the pub who knew you ;) For some reason, any mention of Warsaw seems to be followed up with "do you know Harry?" :D

If this is that important to you, I'm sure you have the computer-savvy to find out. Koniec. I've got better things to do.

Is that an admission that you actually can't provide that single reliable source? Certainly sounds like it.

I created it and now I believe that the thread can be closed.

It's not for you to decide - I know you're only a kid, but this isn't school - tantrums aren't going to get you anything.

I believe you are right. The admin should grant the OPs the right to execute the closing down their own threads to avoid abusing it by others who promote their personal obsessions in those threads and whose further contribution doesn't really interest anyone except themselves. Slowly but steadily it adds to the deterioration of the contents of the PF.

Wouldn't that just mean the usual suspects shut threads down as soon as they're questioned/

Perhaps because it's of interest to Gazeta Wyborcza readers, many of whom are sick to death of Church interference in public life?

but subliminally it is obvious that the GW clique is a godless bunch

What's more obvious is that I have to ask you for the 10th time to provide a single credible source to the following two claims :

If you don't provide a source as to what you say, it's pretty obvious that you're just talking rubbish about Gazeta Wyborcza.

News / Kaczyński presents alternative to PO thievery [26]

Where's the investment coming from? The State doesn't have the means to provide 1.2 million jobs in small towns and depressed rural areas. The money can only come from Polska A - who are sick to death of subsidising these areas through KRUS and other things as it stands.

a housing fund into which would be channelled one-half of the taxes from housing construction

Why? Housing isn't terribly expensive compared to salaries. And with taxes on construction, what do you think is going to happen? That's right - less construction.

50% tax write-off for each additional child.

Where's the money coming from? Such policies will only anger the tax-paying electorate, especially the childless. They're not going to support any measures which punish them for being childless - and these people are the ones who have the power to decide elections.

Child allowances would begin at conception, and there should be discounts on textbooks.

Again - all totally unfunded. Discounts for textbooks can only be achieved in two ways - the imposition of set text books (thus harming the publishing industry) or by robbing other areas of the desperately underfunded Education budget.

A family coupon for poorest families would provide up to 300 zł towards nursery and preschool costs

But it's totally illogical - the poorest families aren't working, so why do they need nurseries?

the elderly coulod chosoe between OFE and ZUS

Not going to happen. There's not enough money in ZUS to give people the choice of opting out.

the 60 and 65 retirement age would be rerstored but people could work until 67 if they wanted to.

A total disaster - the population is aging and ZUS doesn't have enough in the pot to pay out pensions at that age. So - people might get to retire earlier, but they'd face the choice of a low pension or higher (which already stand at 39%) contributions.

The National Health Fund would be liqudiated

What would it be replaced with?

and the 8+4 format in education would be restored

A populist move which bears no relation to reality - 6+3+3 is shown to have raised standards. And again - where's the money coming from? The education ministry is poor enough as it is.

a full curriculum in history, Polish and religion would be restored and school doctors would be reinstated.

School doctors? Where's the money coming from? Schools need facilities and equipment, not random rubbish doctors who couldn't make it in proper medicine.

The culture ministry should .return to a policy of promoting our national heritage in the best sense of the word rather than financing controversial projects.

So more POLSKA POLSKA rubbish that no-one wants to see.

Banks and chain-retailers should be taxed.

They're taxed already. Higher taxes means higher prices for consumers, which means higher taxes to pay for increased benefits to them.

There should be stiffer openalties for violent crime and corruption including confiscation of property..

Perhaps about the only reasonable thing in the whole thing.

This is a foretaste of what is in store once the corrupt Tusk clique lands on the trash heap of history.

Except it won't happen. Poles are taxed enough - and simply won't vote in a hideously socialist Government that will be forced to dramatically increase taxation to pay for all of this.

testing though ow he proposes to fund all that?

Indeed, how will all of this be funded? Proposals are one thing, but it needs to be funded.

I've just read his proposals, and some of them are a complete disaster for business.

For instance, Kaczynski proposes that every single business in Poland will be subject to VAT. That's almost certainly going to drive small businesspeople underground - they won't be able to compete if they have to suddenly slap on 23% on top of their existing prices.

And his proposals to abolish the Matura are - well - insane.

Funnily enough, it seems that Polonius quoted directly from Gazeta Wyborcza, but left out some bits.

Law / Required Documents for Buying a Used Car in Poland [17]

Apparently there is still no nationwide register of cars - this is why they have the compulsory carrying of documents law, because there's absolutely no way for them to check otherwise.

Beats me why they need people to carry their driving licenses though - they've got in-car access to that database.

News / Who controls Gazeta Wyborcza?? [216]

editorial section is a totally different matter and some things written by Michnik or Żakowski really raise eyebrows of any non-Palikotist reader. And they definately do have obsession with their rivals.

But isn't the point to raise eyebrows? It's an editoral - you're never going to get fluffy sensible pure-centrist political opinions there, are you?

I'd be worried if Gazeta Polska started publishing editorials which praised the current Government for - let's say the successful implementation of the "one-window" business registration or the phasing out of the NIP for private people. Wouldn't you?

For example, Żakowski once said that abolition of inheritance tax would be a straight way back to feudalism.

And no doubt everyone shared it on facebook and talked about it.

(by the way : what are inheritance tax rates in Poland?)

News / Poland Parliamentary elections 2015 [1060]

But how can it succeed? PiS would need the support of Ruch Palikota - who would never, ever back a constructive vote of no confidence unless it resulted in a new government that was more favourable to their social agenda. PiS would never agree to that, so - you have political stalemate. RP already told PO that they would demand IVF and reform of ZUS and KRUS as a price of political support - do you think PiS would ever, ever, ever agree to either of these?

Polonius - let's look at the current Sejm.

PO - 207
PiS - 157
RP - 40
PSL - 28
SLD - 27
German Minority - 1

231 votes are required for an absolute majority.

There is absolutely no way that the current electoral mathematics can work for PiS - PO only need the support of one out of the three smaller parties to gain that absolute majority and to win any such vote.

Can you show me a credible scenario in which they would lose such a vote?

Law / Clocking cars and importation to Poland [47]

What do tints have to do with anything to do with this? Although your friend was desperately unlucky in this case - it's the first time I've heard of anyone getting asked for it when stopped in a foreign plated car.

I'd shut the hell up, ok? Try dealing with someone whose car was "insured" but really wasn't when he rearended you. And see how the police reacts. Yea, they don't care. So I guess I shouldn't either and pay for all the damage out of my pocket. Right? Because that's the "Polish way"?

I really don't get what your point is - we're talking about a UK car that is fully insured. And if the UK car wasn't insured under some arcane technicality, there exists a scheme to pay the third party in this case.

As has already been pointed out to you - UK insurers offer the option of keeping the car abroad for as long as you want.

Yea, there's this country called France you see, and it doesn't belong to the UK, and it's at the other side of the Chunnel and ferry ports...

And you think that French protection laws would allow the exporting of such data to the UK? What you're talking about simply doesn't happen, not least because there's a multitude of ways to leave the UK and a 200 mile unguarded border between the UK and Ireland.

There's a huge difference between the "rules of the road" and having things like liability insurance. Don't confuse them.

As I said, Poles don't bother with rules that aren't enforced. As you're well aware, the requirement for insurance is enforced in Poland.

Oh btw, the whole point of insurance is not to satisfy some stupid law. It's when you do cause an accident the insurance company is obliged to cover the damage you caused. There are people who buy OC on cars with German kurzeitkennzeichens and think they can get away with it, and the insurance companies don't mind because they make money. When push comes to shove guess who's forking the bill?

I still can't figure out what you're getting at.

I'm also wondering if your negative experiences in Poland are due to obeying far too many laws that the natives don't obey.

News / Poland Parliamentary elections 2015 [1060]

One recent poll showed an only one point difference between the Platformer crooks and the noble Law and Justrice camp.

And other recent polls show a 12 point difference. You also neglected to mention that the one point gap still meant that PiS only had 29% of the vote - which won't win a Polish election.

There is always hope the Polish people will wisen up. They should take their cue from our American Polonia, 70% of whom voted for PiS.

Ah, Polonius. Such a brave Polish-American, telling us here how we should vote! I mean, you guys know best, don't you?

Poles in Poland seem blinded by the glip and slippery rhetoric of tricky Don. Notice how he never looks anyone in the eye and shifts his glance away as he spouts his sugar-coated lies.

Or they realise that some American really has no idea about what's going no here.
