Your argument is a minority view

Yours on the other hand is a typical fallacy.

isn't shared by constitutional experts.

Let say that on this issue constitutional experts haven't reached consensus.

If you've got any evidence that the TK is actually bound to lesser law, let's see it.

They are bound by such a fundamental pillars of law as nemo iudex in causa sua.

The TK is bound only to the Constitution

By it is up for the Parliament to vote changes and amendments to regulate functions of the TK.

TK rulings

If you had more contact wtih normal Poles, not the renegade lefty-lib elitists you seem to hang out with, you would know how Jan Kowalski sizes up all the commotion and rumpus. This bit of doggerel tells it all:

Idą świnie PO ulicy,
Każda świnia głośno kwiczy.
"Czemu kwiczysz?" - ktoś zapyta.
"Odebrali nam koryta.
"A w korytach ośmiorniczki.
"Teraz mamy szczaw z doniczki!".

Pigs are marching down the street.
From each pig -- a squeal and squeak.
"Why do you squeal?" - if ask I may.
"They've taken all our troughs away.
"Those troughs were full of octopi.*
"With sorrel our diet's gone awry!"

*A reference to the baby octopi and other goruemt deligths enjoyed by by PO tape-scandal stars Sikorski and Rostowski at a champagne dinner at the taxpayer's expense.

"when KOD have been involved in mayhem and rioting?, Kod" Correct KOD demonstrations have been peaceful at all times.

But there are dark foreign political forces lurking, who may wish to take advantage or undermine peaceful and lawful protest, The draft laws if passed will give the government the ability to deal with any foreign fifth columnists

Plenty of Poles

Phew ! Your argument is ridiculous - plenty of Scots had been beheaded in the past it could happen again. Do you have a brother delph? If you do maybe you should invest some of your time in writing, you might even become as well known as the brothers Grimm.

Don't be daft Polonius. You don't expect public servants to eat bread and water do you? The days of beer and sandwiches are long gone, more's the pity:)

It is exceptionally glad to me that masks falling down and that Anglos losing control over Poland. Any kind of demonstrations for `democracy` are in fact demonstrations against legitimate Polish government. Because, the one who don`t obey to Anglos and don`t follow them blindly, that one isn`t democratic.

public servant

I do remember Tusk's campaign promise of an "oszczędne państwo" (economical state) that would slash red tape. He left in his wake a bigger army of pencil-pushers (maybe keyboard-punchers would be the updated version?!) than any previous post-1989 government.

You can start a business in 5 minutes these days.
You can do a lot of things through the ePUAP platform.
Tax returns are electronically generated if you don't have anything extra to add.
Your ZUS records are all online and updated daily.

The list goes on...

As does the increased volume of pencil-pushers or keyboard tappers. Dunno which version is true, but some say he has trebled the number of bureacrats. At any rate, there has been a sizable increase.

It's like everything these day is compurterised, but go to the bank, chemist's, outpatient clinic or other institution and there still is a lot of additional, non-digital paperwork. Or at the supermarket when the paper roll runs out and the cashier has to fumble with it as the queue grows increasingly impatient.

Everyrthing looks good on paper because as the Poles say: Papier jest cierpliwy.

Interesting idea. What would PiS do when the Supreme Court also refuses to side with them?

Fire judges from the supreme court and appoint loyal ones.

Judges cannot be removed once appointed to avoid exactly that problem emerging.

25 Mar 2016 /  #1993
So they have lifetime tenure in Poland? Well they can change that law.
Honest Pole

But PiS wants to void constitution or will simply ignore rulings of the Tribunal

Even if a judge is caught taking bribes, molesting young boys or embezzling court funds or goes insane or becomes paralysyed? If so, that's a pretty stupid law.

once appointed

America has true democracy because judges are elected by citizens at the polls.
As are sherrifs, bailiffs, town treasurers and many other officials. The more direct democracy and the fewer appointments, the better. Since nobody likes to be herded to the polls too often, usually electiosn are arranged to combine federal, state, country and local officials as well as referenda and millage votes (increasaed school taxes).

Thats corruption, not democracy. The legal system should be independent of politics, laws apply to politicians as well.

How can it be independent when party loyalists are elected by parties as judges?

Thats corruption

Voters voting for rthe officials of their choice is corrupiton? No, that's direct democracy. Switzerland also has direct demcoracy via the referendum route.

Looks like Obama is defending Polish democracy, more to come with Hilary in the wings, all is lost for America now, the bubble is sure to burst soon, no more Polish visa's for Americans maybe?, no more NATO boots in Poland?

Polish President Andrzej Duda is set to fly to Washington DC for a three-day visit, but the US isn't rolling out the red carpet. In fact, President Obama has pointedly refused to meet with his Polish counterpart, and so have US lawmakers. Polish media have already described the situation as the worst shock in Polish-American relations in 30 years.

Russia is no threat to Poland, especially if there are no Nato forces stationed in Poland, the cold war is dead believe it or not, It is only American propaganda that tells you to be afraid and dance to the American tune. Is Russia planning to stay in in oil rich Syria, don't think so.

Russia is no threat to Poland

Very short-sighted. If Russia is a threat to Ukraine then it can become a threat to the Baltics, Georgia and even Poland. Is economic blackmail (boycotting Polish agricultural produce) not a threat? Is colluding with the 4th Reich to bypass Poland and the Baltics with the pipeline not a threat? GI boots on the ground are the only guarantee that Russia will stay out. Some way should be found to plant GI boots on Ukrainian soil as well, inclduing Donbas and maybe eventually Crimea. Long live the USA, the arsenal of decocracy and guarantor of world-wide freedom!

GI boots on the ground, not worked in Vietnam, Afghanistan, Iraq to name a few, Poland would do well to keep only its own boots on the ground, Poland is a gateway to nowhere, just a buffer between two warring highly indebted countries looking to make a buck by building empires and spreading fear.

Donald Trump is going to charge Europe for those boots in the future, a nice little earner a bit like lend lease that bankrupted European nations after the second world war, America had it good during the fifties and sixties spending all that gold and cash from arms sales, others were enslaved behind the iron curtain left to fend for themselves, no GI Joe to the rescue of Poland in 1945.

Poland is best left to sort it's own democratic and political relationships without outside interference which has historically only brought grief to this peaceful nation.
Polonius3  980 | 12275

without outside interference

As a backer of the KOD/PO/Petru snitching brigade, you're certainly not one to distance yourself from outside interference. Now, in addition to your trademark Church-bashing, hetero-bashing and Pole-bashing you have added Yank-bashing to your list of favourite pastimes.

America was at war in Afghanistan and Iraq, boots on the ground are a peaceful deterrent. The neo-Soviet empire has never invaded a NATO country and the boots are an additional largely psychological safeguard.

neo-Soviet

Adam Michnik's son Antek (Antoni) has criticised GW for inadvertently supporting PiS' politcial campaign. GW has speculated that in exchange for the return of the Tupolev wreckage Kaczyński will agree to mount an anti-Western crusade thereby playing into Putin's hands. Such preposterous claims are working to PiS' advantage and turning people away from GW, Antek Michnik contends.

Quite possible. A lot of people have been remarking how PiS have swung heavily towards Russia, and certainly Kaczyński has far more in common with Putin than Obama.

Having said that, there's no way this government will last for long if they're openly hostile to America.

lot of people

You mean a lot of resentful and frustrated KODerasts who will say anything about PiS and Kaczyński as long as it's bad, negative, pejorative or demeaning.

Most Poles would not want the likes of a leftist-libertine Obama ruling Catholic Poland nor quasi-tsar Putin, but Orban and Cameron are another story. They are admired because they've got the guts to stand up to the Brusssels dictatorship, do what's best for their countries and choose an opt-out when the Eurocrats start getting too pushy.
