Can a Woman file for child suport in u.s.a,if the child was born in poland and has no contact with the child.where does she have jurisdiction in u.s court,shouldnt this be filed in polish court for child support?should the support be in dollars or polish zloty?
how she can file for child support if she does not have custody of the child? first she needs to have a custody of a child and that needs to be file in the country where is the child is.
If the child doesn't live in the USA, she can't file there. But if the kid lives in Poland, she can file there and will be able to absolutely take the father to the cleaners. Then she applies to the USA court to have the judgment of the Polish court enforced.

That's your job. The child might be in US. Wherever it is, the courts know. Petition to see the child. And if you don't want to see the child, money is the least you can contribute.
Courts dont know anything.Guess all people in Poland are money hungary! you guys are forgetting there is a child growing up without a father,due to the mothers narcisstic behavior.Now all she wants is money and no rights for the father?Why cant the child come to u.s.a to visit her father?seems the mother calls all the shots in life and court?thats not right!

well explain how the polish court has no judgement for support in poland.Only in u.s.a where the child wasnt born.there are procedural guidelines in filing for child support.Neither the court in u.s.a or the mother followed them.Have a problem more with the court system than with mother.

Thats what happened here.1st jugde ruled in my favor,then change her mind on appeal based on UIFSA law.UIFSA law is state to state in u.s.a not international.maybe the Judge had no clue about the laws pertaining to this case.goin to court next month for another hearing,.
Are you sure the child is in Poland. Sounds like they moved out of state. Unless they retained a lawyer prior to moving to Poland (Divorce lawyers are the worst) What state are you in as state to state laws vary to some degree.

Yes - some earn 1200 PLN/month and some earn 12000 PLN/month. What's your point? You think 400 USD/month is too much? If she works full time, doesn't have family to look after the kid and the kid could not get into nursery, she will pay the 1200 PLN/mont for the nanny.
Also curious was paternity established? If it wasn't you may wish to do so as it will make visitation judgements easier. Also this is one of the agencies in Poland that may be able to help. It is a bit old but may still be of use.

I think we only hear a part of the story here. Looks like father is American, so mother applied for child support at the "source". If the father is identified all she had to do was give his name to the court/ child support and they do the rest - or am I mistaken?
The point is the guy wants visitation. Why should he have to shell out a dime if not guaranteed his paternal rights. He obviously wants to raise the child if he wants visitation. If the mother decided to run and has no support system that is on her. He shouldn't be made to suffer because the childs mother made a poor decision. (assuming she has no support system)

Yes - you are right here, but the issue is that he now has to take care of this part. I'm not sure if he actually wants to raise the child, but he should have some visitation rights regardless. If the women used him as a "sperm bank" then she shouldn't now ask for money, if she is asking for money she should allow him to see the kid.
There is no doubt a father should always take care of his own. Even if she used him as a sperm bank he should still take care of his obligations.
I will have to warn OP. I am not sure what the laws are in your state but the amount awarded does not seem outlandish. If you persue in Polish court, from what other postings on this site seem to indicate is that Polish courts tend to screw foreigners. I am not sure if she has the right to sue in Poland also, or at least seek an adjustment on future earnings in Poland but if she does if you marry she will be able to adjust the amount if your spouce also contributes to your household. In other words if you are looking for a battle you may lose at least financially. I would consult a Polish attorny to check your options.
It would be easier to say that if one knew the whole story, rather than just one side of it that has been spewed out on the internet.

I think she was. $400.00 per month is a drop in the bucket here but in Poland that can go a whole lot further.
When was the divorce finalized? Did she have the courts permission to leave the country? What was your visitation?
Dude I feel for you. Once the courts give them full custody, you are at thier mercy. As I posted earlier, be careful. I would definately consult a Polish attorny to find out your options.
