rt2009,Jatux sp. z o.o. is existing in the polish court register. So, the best way could be to commence legal proceedings before a polish court. You have to act asap because such companies transfer their assets very quickly and than there are many problems with the enforcement of a court judgment.

oklahama - if you contact me on the e-mail address above, I'll be happy to give you some advice on the matter.

oklahama - the procedure of legal action before the polish court is complicated for foreigners. The court's fee depends on the high of claims (5 % of the claims not less than PLN 30 and not more than PLN 100.000; in some cases it amounts one fourth of 5 % - it depends on a procedure). You should also add the translation's fee of the documents and of course lawyer's fee. If you are interested send me PM on my mail box please.

can anyone let me know the procedure of cancellation of a
sales contract.how long is it valid?
gregor  - | 38
8 Jan 2010 /  #17
the sales contract should include the condictions of cancellation. If the contract doesn't include such provisions, the conditions of cancellation are regulated in the domestic law of one of the parties or in the international commercial law (the choice of the law depends on various conditions).

ITS SO AMAZING TO NOTE THAT JUST ONE COMPANY NAMELY "JATUX " (PRESUMABLY) ON PAPER IS CHEATING SO MANY PEOPLE AROUND THE WORLD. MORE SUPRISINGLY, ITS HAPPENING FROM POLAND WHICH IS CONSIDERED GENERALLY A GOOD COUNTRY.

JATUX IS PROBABLY SMARTER THAN POLICE IN POLAND. OR MAY BE WE ALL ARE THE GRATER FOOLS TO GET INTO TRAPPED WITH THIS ROBBER.

ITS WELL SAID AND I BELEIVE IN IT> EVERY DOG HAS ITS DAY.
BUT ALL THE DAYS ARE "NUMBERED" PL DO NOT FORGET.

WOULD BE ANXIOUS TO KNOW ANY FURTHER NEWS ON THUG.

Hi rt2009/gregor, After discussing with Jetux , they promised that they will pay back the money after sending cancellation document. But it is not happened. They are not replying for any of the emails and SMS. I am not sure how to take steps against them.

In my opinion you should take legal steps asap. Do you have a written agreement with the Jatux? First you have to analyse the stipulations of the written agreement. You should also consider what kind of law is applicable in this matter. Could you write where are you from? Secondly you should extend final payment demand and then take a legal action before polish court (if the Jatux will not pay). You have to take into account the limitation of claim. That's why I suggest you to take legal action asap.

Hi rt2009,
Just a suggestion, whether it possible to address this issue to "The Poland Import Export Chamber Of Commerce" and take necessary action through them. Best way is to take legal action against him in a polish court. But it is very difficullt to proceed with.

Can you please share your email ID?

Can you please share your email ID?

I've been talking about this with rt2009 via e-mail - if you can send me a mail at office@lindenia, I'll be happy to include you in with the discussion.

I'm almost certain that this is a clear cut case of fraud - unfortunately, recovery of the money may be much easier said than done.

HI gregor,
I am from India. Jetux promised to pay the money back if we send the cancellation documents. We did the same however he vanished after that. I am keep sending emails and SMS to him, He is not replying back. Can you please advice.

pons - my advice in this matter is to send myself (office@lindenia) copies of all correspondence - I'm trying to build up a case against Jatux, and I have a feeling that debt recovery may be more effective than going through the court system.

I have a suspicion that the Jatux company may not actually be aware of what's happened - as it seems "Andzrej Dąbkowski" may not actually exist.

Pons,

I suggest you should take the legal steps asap. Mr Dabkowski is owner of four companies listed in the polish commercial register. It could be easier to enforce the court decision.

Hm, why would an established and easily traceable company commit fraud on such a large scale? Unless they hope to rely solely on the language barrier blocking foreigners from research or legal action (but most fraudsters are not this stupid).

My feeling is that they may not have been behind it, but rather someone else is pretending to be them. I can't be certain, but it certainly seems possible.
