Get a lawyer on the case and get on with your lives.

TommyG Read it again and absorb. You read it too fast. It is the legal system that is at fault and Poland's lack of care for children. The Law is what makes a country. If the Law is bad the it follows does it not.

I don't actually think in general terms like that but in child cases Poland is without doubt the worst country in Europe.

The reason I post this stuff up here is so people can see the danger they are in should their international relationship fail. We have spent over 2 years in the courts now. I wouldn't wish it on anyone.

Abducting children is certainly against the law. I get the feeling thats not the whole story.

In Poland you cannot abduct your own child. Both parents have equal responsibility and there is no provision in Polish Law to prevent it. If you call the Police they refer you to the courts and the courts want to spend six months deciding who is the responsible parent. This usually falls to the parent with the children. The abductor.

If you think like that you may be in for a shock when something doesn't go your way. In my experience most are just doing a job, take to much on, know a lot about a lot of things but not enough about something specific. It's far safer to attain the knowledge yourself and direct them.

We have the best. Our UK solicitor is a barrister specializing in Polish, English and International Law, fluent in Polish. Our Polish solicitor is great. I have an excellent understanding of the Hague and Brussels II and a fair idea of Polish Law.

The problem anyone has in this situation is that Poland does not play by the rules and actually breaks the Law.

There are over a hundred cases of parental abductions involving Poland and the UK a year. How many occur in total is anyones guess because its not possible to abduct your own child under Polish Law.

No he is the father he is allowed to do that under Polish Law. The Polish court made it clear that this was not for discussion.

Of course. Damned expensive it is as well. We have English lawyers advising our Polish lawyers but they don't like doing as they are told. The problem is there are very few lawyers in Poland that understand International Law. Many advertise the fact that they do, but when you ask them a simple question like, "Can i get divorced in England?" most will smile and say of course not. The courts have no knowledge or understanding of International Law. It's a Joke.

No. The Hague convention and Brussels I I stipulate the Law. They provide for circumstances were there are cross border disputes. They define very clear articles. I was polite about what I said. The fact is Poland signed up for these laws. It was not as simple as a signature. They went before the Supreme Court which at the time said Polish Law was incompatible and that Polish Law should be changed. They did nothing. So now Poland looks ridiculous.

Maybe you didn't understand what I was saying. The court showed a lack of vision because it was blind to the fact of the result of its actions. (which are incorrect anyway)

If Poland would go about sorting out her problems, your legal circles in Europe would scream murder like in Hungary case!Am I wrong?

More info on the Hungary case please. I am not aware of this. England for sure would be very happy if Poland straightened itself out. A lot of Polish citizens in England would be extremely happy. The British goverment would be happy as it would save a fortune on legal fees.

Most importantly children would feel safe. How would you like to be a 6 year old child worrying that someone might take you off the street at any moment and that there is nobody or no organization that can help you in Poland?

I have very strong opinions on this because currently my partner, her children and I are badly affected by crappy Polish Law. I think they should be spending money on changing laws that they have promised to, to make the country more compatible with its European friends.

Building roads only reduces the time to travel. It doesn't make it a better place. Society is rooted in law. If law is bad then ....

My partners saga of Polish woe continues.

Yesterday an appeal was heard in the higher court about her children staying with their father for Christmas. It all sounds like a petty conflict until you understand he abducted the children in January 2011. Drugged and secured headphones and builders dust masks to them while hiding from the Police for three days. Nice fella which according to Polish psychologists, everyone should feel sorry for.

Of course the children don't want to go and are in fact terrified. We don't want them to go as the father has made it quite clear he will retain them in Poland again. There is no law in Poland to prevent this of course. (CLEVER!). We have no objection to the father visiting the children in England and have in fact invited him to do so almost monthly for the last 18 months. He refuses. The last time he saw his children in the UK was October 2010. Over 2 years ago.

We have an ongoing case in the UK for residence but there is an issue over jurisdiction which has to be heard at the High Court. When we have this order, the children will be safe and no longer weapons that can be used by the father. All contact will be dealt with by the courts in the UK who will not be as accommodating as we are. It will be an expensive process for the father.

So whats the Polish court done. First they have decided erroneously that they have jurisdiction. Obviously they cannot understand Brussels II. Secondly they have ordered that the children are given to the father at Christmas. Absolutely no thought about the children what so ever which is another judicial error. They cannot make this order at all, as currently there is a Ward of Court order in place in the UK that gives them the full protection of the courts of England and Wales and under Brussels II they must respect this order. So now we have a nice conflict. We have a Polish order that cannot be obeyed because to obey it would be a criminal act in the UK.

The net result is a home goal for the Polish courts. What has happened is the result of Political and Religious prejudice wrapped in a lack of understanding of European Law. So well done Poland, through your lack of consideration for your children, you have now most probably excluded two Polish children from stepping on Polish soil until they are 18 and mum maybe will never be able to go back.

This is why Poland is considered "The poor man of Europe" in legal circles. A lack of vision.

Don't for a moment think our case is unique. This sort of thing is happening every day in Poland. It's way past time for change.

It's a pity it hasn't caught on. I think its rather good and deals with moral issues very well.

It surprises me so many people like "Keeping up appearances" in Poland. It portrays a society that has all but disappeared now. I'd say in the seventies, there was one or two Hyacinths on every road. It's the domain of footballers wives now.

It surprises me that Dr Who appears totally unknown in Poland. Its well made (now) with intelligent story lines and my partners kids love it. Saturday evening isn't the same without it. The kids end up in a Mexican standoff when trying to discuss it with their cousins on Skype.

From past experience you could be looking at six months. Things take time in Poland. Not for any reason you might understand. It's just the Polish way.

To be honest I would believe almost anything that I wouldn't have believed about what happens in Poland, two years ago. It's not how I imagined Poland from the descriptions the girls who worked for me gave. I did wonder why they grumbled about going home for a fortnight. Not because I'm a hater, but from first hand experience. I now understand its a democracy firmly rooted in communism and religious ideology. It's a mess.

How typically Polish of you again Magdalena. :) It is so typical because nobody believes anything bad about Poland until it happens to them. Poland is a paradise, and when it all goes wrong its the sh*t hole from hell.

Its about time religion was banned from schools. Teaching mumbo jumbo should have been resigned to the past decades ago. Frightening children into believing is really not nice. Playing on childrens weaknesses is not nice. Look what happened to Polonious. The rules to which we should live our lives a firmly entrenched in law. Teach them law instead. Its less fanatical.

A typical English house transplanted into a Polish winter would not survive more than a few hours - the water in the pipes would freeze solid, end of story.

Hmm! Interesting. Funny how the pipes freeze in Polish houses in harsh winters when the heatings not on. So what happens when you bury a pipe in the wall. A problem. Thats what. There is a reaction between copper pipe and cement/concrete that causes corrosion and the eventual failure of the pipe. Of course the pipe can be sleeved with a plastic/polythene pipe but from what I have seen is not done in Poland. The ones I've seen have been plastered/cemented into the wall. Perhaps it is different on new builds but I've not seen one of these yet.

I think you would find most English houses would survive admirably because they are built to standards which are checked at all stages of build.

In Poland you see some true craftsmen working on restoring buildings but equally you see a lot of tragic home builds.

Don't forget that you can start a divorce in the country you reside.

So if you marry a Pole and it all falls apart start your divorce in your home country and this STUPID law is to the bin.

Read Brussels II Bis it walks all over STUPID Polish law and Poland signed it.

Wrong. It doesn't matter where you live its where you start your divorce. Once a court is seised you work under the law of that country.

The truth of the matter is that in most cases this is not applied. This one of the reasons some Poles choose the "at fault" divorce. In most "at fault" cases, both partners are found to be at fault after wasting up to 3 years of court time. I remember reading somewhere that this is likely to change as it is currently overloading the court system as divorce has become very popular in Poland.

I think you might find that Rambo Rutowski screwed this case up for the Police by his selfish self publication of evidence. I watched this unfurl from the UK. That mans a liability. Send him to Norway, I believe they are waiting to lock him up.

Just asking questions for conversation.

I meant to quote another bit. The girls lining the roads in and out of Poland rarely look Polish. I think with a bit more research you will find a number of these are "trafficked" but as prostitution is legal, nobody cares. The "nightclub" is a funny term for English people.

International relationships, I think are true test of metal for both partners. Cultural differences initially are funny but soon escalate into battlegrounds. It takes time to overcome these differences and find some middle ground and if you can survive that long, then it should be a good relationship. It's all about give and take and if you can't manage that, your unlikely to succeed in any relationship.

Trust is a major factor. If you don't trust the driver, don't ride the bus. I know plenty of people would find it difficult to trust someone speaking in a language they don't understand in front of them. The same people would have a problem if their partner was 10 minutes longer at the shops than usual. Not worth bothering with in my opinion. They failed to grow up.

My point is valid and exactly why Poland is considered "The Poor Man of Europe" in terms of child protection, child welfare and your ridiculous legal system that fails to protect and even when it blatantly knows its wrong, it still feels it has to say its right.

Gregorz_, I am not interested in mud slinging but if you want some, I'll play. I don't think Poland or Poles are inherently bad. I live with one and her two kids. When you have seen the devastation the Polish courts can cast over a family, as I have done first hand, and through a multitude of unconnected cases, which should not be happening because Poland agreed to change its laws and did not, then you would know where I'm coming from. The trouble is that the majority in Poland are completely unaware of how law can affect them until it actually does. Polands laws need an overhaul now. Its not just family law thats holding Poland back, banking is equally affected which currently prevents Poland from taking on the Euro. Not that it would be a good move right now.

Things are swinging in the right direction. The concept of parental abduction is slowly becoming understood and ITAKA is taking an active role. When the courts understand that children should be protected first and argued over in court afterwards, they will have made a massive step forward away from communist idealism. Currently it can take up to three years to decide which parent has the children and its not necessarily the one they have been living with for the past three years.

There are lots of things Poland needs to do.

They must change laws that they agreed to when signing the Hague and Brussels II
They need to set up a welfare system separate from the courts. The current Kurator system is a joke
An independent organisation should be set up and separated from the courts so the psychologists are not in the direct pay of the judges or "friends" of the judges. This really is a joke.

Judges, and welfare agents acting on behalf of the courts should be made responsible for their actions.

All Hague cases should be held in higher courts where judges have specific training and understand that in this situation, International Law overrides Polish Law (exactly as it would in England)(Yes we apply voraciously)

Poland should enforce its own Hague decisions not just ignore them as it currently does. Poznan family court has even been seen to assist child abductors when the same court has ordered a return.

There we go. A bit to go at.

Ok so whats the Wests agenda here? A smear campaign on Poland? Or is it we just don't like the idea of shipping girls to our countries to a life of servitude in the sex industry? Are you doubting this exists? Do you doubt Polish citizens have involvement?

What I was hinting at was Polands lack of acceptance/understanding of European Law. Sign it and ignore it.

Nice lady but they are more passive in their approach.

This seems to be the inherent approach to most things in Poland. No-one appears to want to put their head above the parapit in case they get shot down.

There is an organisation called ITAKA that is dealing with parental abductions amongst other things. This may fall under their umbrella. They are a little passive for my taste though, and typically Polish in not really understanding fully concepts from, shall we say, the west.

Of course its not their fault and what happened wasn't necessarily a bad thing. From what you have divulged it was essential to ensure you had a future.

Maybe there will be none. I'm just saying be careful. This sort of thing is life changing and potentially harmful. It's something that needs very careful consideration and shouldn't be done through selfish desire. Remember you are playing with someone else's emotions and psyche that probably doesn't even know you. I'm just putting an alternative view forward. I don't know the full details and you shouldn't make them public.

I'll give you an example from my past. I grew up believing I was born at Birminhgham childrens hospital. That was fine by me. I didn't need to know anymore although I did on rare occasions think about this. I was 31 when my first child was born. The day I registered his birth was a life changer and upset several peoples lives. I was asked where I was born and on replying I was told it was impossible as there was never a maternity unit at Birmingham childrens. My nose was pretty much put out of joint and a big argument ensued at the registrars. An even bigger argument occurred when I confronted my adoptive parents which resulted in us not talking for 3 years which now I sincerely regret. They lied to me but they had a very good reason to do so. It was for my protection as a young child. It took me 3 years to really understand and even now typing this I'm trying to think of an alternative method they could have used. I can't.

So thats something that in most peoples mind is something pretty small, but this had a significant effect on me and my adoptive parents.

I don't normally advocate the use of psychologists but in a situation like yours I would recommend a couple of sessions to open your mind to the possibilities. How many people through history have believed they were doing good unto others and caused the opposite?

As an adoptee myself, I'd be pretty upset if someone found me because I have no interest in being found. I'd be pretty angry actually. Why not let them find you if they really want to. It might be happier all round.

This is a touchy subject for a lot of people and has potential to cause a lot of damage. Did you know there is a high suicide rate amongst adoptees that discover their birth parent/parents? Trust me, you should seek professional advice before embarking on this mission. It could lead to catastrophe.

My adoptive mother gave me my original birth certificate when I was 42 although I was aware from an early age I was adopted. I was well settled but this messed with my head in a big way. I tracked my birth mother down and sat in my car outside her house in the early hours of the morning, thinking should I do this. I thought it through and decided it was a can of worms I didn't want to open. What would it do to her? What effect would it have on me? My conclusion was I didn't need this and there was a good chance she didn't either. What I never knew, I never lost.

Unlikely as they were getting rid of nurses and employing more managers. Those that entered the "nursing profession" mostly were doing jobs the UK nurses felt were beneath them. Use your imagination. Electricians for sure would not be employable without certification as Polish standards are considerably different to the UK's. Can't comment on plumbers although having stayed in a Polish house where the toilets flushed with hot water , possibly standards differ with this profession also :-)

IMO immigration was used to drive wages down in the UK which it has succeeded in doing which can be gauged by youth unemployment. Where agency jobs were filled by our younger generations, they are now filled by Poles in their mid thirties. I know thats generalising but I believe it is about right.

Now I was doing this aged 12, many years ago. Kind of confirms my point as you don't see teenagers doing it nowadays.

(in Poland you can't even send off for the kid's passport - both parents must be physically present, and the child, to fix it)

Natasia/Harry that is a little miss-leading. OK it is the law but all she has to do is go to court and she has the passport. The family courts are flexible when it suits them. I have seen several examples of this but obviously I cannot divulge.

Thats not quite how some Polish Family Courts think when johnny foreigner is involved. She can very easily remove all his rights dependent on how vindictive the judge is to foreigners. Even there own abroad in some cases.

Here is Donald Tusk answering a question about Child Abduction. What hope has Poland got of sorting anything out with someone like this in charge?

Law / Where to register a .PL domain name? [33]

Another factor to consider is that when you register a domain name, it will take some time to rise through the search engines. It is effectively sandboxed by them unless you are willing to spend $ on promoting it. Financially it may make more sense to buy the domain that is already registered if it has been registered for a few years. A domain that has already been registered for some time will always will rise faster.

I would suggest you make an offer for the domain; roughly half what they are asking. It sometimes works even though they are in the driving seat. Even more so if it reflects the product the company is selling.
