Law / Inheritance tax - from UK to Poland [8]

The six months begins from the date that you are notified that you are named in the will. Notify the tax office as soon as possible even if you do not have the funds in your account or do not know the full amount. It may take some months before the funds are transferred into your account. However, I will check on when exactly the 6 months begin, but do it now.

Please read up about the double taxation agreements between UK & Poland. It seems likely that if the inheritance includes any property, the Polish law on selling properties and taxation may apply.

I did however find this:
Również w Polsce po odzyskaniu niepodległości - na mocy przepisów ustawy o obywatelstwie Państwa Polskiego z 1920 r. można było utracić obywatelstwo, nie będąc o tym poinformowanym.

It seems that from 1920s onwards you could only have one citizenship. New Law came in 1951 whereby they recognised dual citizenship.

Sorry, my bad to the post above. Prior to 1951 it was 'Rzeczpospolita Ludowa' without the word 'Polska'

Very interesting. But where is the 'Polska Rzeczypospolita Ludowa' on the passport? Look up how Polish people obtained passports and to whom they were given. Even up to 1956 passports were only issued for official visits and had to be given back to the authorities on return.

However, from Wiki it does appear that 'dowod osobisty' which listed all the addresses of residence was incorrectly named 'passport' and was used before WWII.

Ask your solicitors. I believe that if you can prove that a recorded delivery has taken place, it is understood that the recipient has received notification. Go through a good solicitor. Say that the reason for the divorce is 'breakdown of marriage'.

Law / Can I use European Health Insurance Card in my application for an EU citizen Polish temporary resident permit? [4]

No, you cannot. The EHIC is a card which entitles you (as a citizen living permanently in the issuing country) to the same emergency treatment as a citizen living in Poland. It is not evidence of medical insurance cover in Poland. Entitlement to full insurance is only valid in the country which issued your card, but not in Poland.

In Poland with the card, you will be treated as a tourist who is entitled to medical emergency cover. Please read the full entitlements which area shown on-line of the card issuing country.

Poland wants to see that you are insured on a full-time basis in Poland whilst you are in Poland, for this you need evidence of private medical insurance which you will be able to get in Poland and for which you have to pay for.

You do not say where you are from, what subject you wish to study, who will be paying for your education and whether you speak Polish up to University standard. Without that it is very difficult to offer any advice.

Law / Money with ZUS - what happens to it when I leave Poland and come back home? [23]

If only. It was the old zloty in 1994, then in 1995 it changed into the new pln, but there was a time when both currencies were being used.

I've been trying with ZUS since last year, filled out forms, but there was always a new one to complete. Then original documents from my old firm, then a form showing my working career, although I only worked 2 years in Poland, the rest in the UK. The best one however, was that as I don't have a Pesel, at first they said that they couldn't enter me into the system. I handed my British passport over and the lady said 'but this is not a Polish passport' to which I replied 'but I am not Polish' and she looked at me in disbelief, 'but you speak Polish'....but 6 months down the line they relented and calculated something. I am now in the system by Passport number. I believe that one hand doesn't know what the other one is doing and anything unusual throws them into confusion. They were probably stretching my patience till I gave up. I haven't, but as yet not a grosz has gone into my bank.

The thing is, when you are working they take as much as they can get away with, but when you want some of it back, they argue about every grosz.

Let people have their simple pleasures...there are words in Polish that sound funny to an Englishman, and words in English that sound funny to a Pole.

In English we have a word 'cheaper'...something is cheaper than something else. That word does sound strange in Polish though.

I can give some advice based on my personal experience. I worked in Poland September 1994 to June 1996, that is 2 years. They have recently calculated my pension (as I am of pension age for Poland) and will pay me some money after confirming with NI in England that I no longer work.

Anyone paying into ZUS will be entitled to an old age pension when they reach pension age. The amount will depend on your contributions to ZUS. You cannot get any money back in the form of a lump sum from ZUS, the only way is through monthly pension until you die.

You already know that your agreement is not worth the paper it is written on. He probably cannot evict you formally, but he can get all your belongings and throw you out on the street. The only recourse would then be to go to the Police, but if he says that he gave you notice to leave and the date has passed then they cannot do anything. The Police cannot force your landlord to provide you with another place.....The fact that he had a witness means absolutely nothing, except that he wants you out. I would cut my loses and leave. You could go and ask at the police station what to do, but they are powerless to, if the landlord insists that he is doing everything right. Mind you, it might give him a fright if he gets questioned by the police.

You have a lot of hurdles. First, did he register the flat rending with the tax authorities. Answer probably no. You can always tell him that you will go and tell them that.

Do you have a rental agreement that is worth more than the paper it is written on. Answer probably no.
Can you break your agreement before the rental time runs out. Answer - probably no. Your reasons will not stand up anywhere.
I would not pay him any more money, would just take all your belongings and leave. The cost of taking this case to court would cost you more than it is worth. ,

I can only go on my experience of buying a flat.
Yes, it is normal to pay in cash to the notary when you pay the notary fee & sales tax. If you paid by bank transfer (przelew) you would need to do it a few days before so that on the day of signing the notary would have the cash in their bank account. If you did that and something went wrong, they would have your cash and you would have nothing. Similarly, you cannot become an owner before you pay for something and NO notary will let you pay for a house/flat a few days after the actual signing as they would not be sure that you would pay, but you would be the owner and they would have to go through the Courts to get any money out of you. The document you get from the notary states details of the house, the buyer and seller and their details and that the money has been paid or will be paid and when.

The money for the house is usually transferred through the bank via a 'przelew' to the buyers account, unless you want to hand the whole amount in cash in front of the notary. You can always ask the notary.

In my case, the seller came with me to the bank when I transferred the whole amount to his bank account and then we went straight to the notary. However, we had all agreed (in front of the notary) that this would take place and the notary waited for us whilst the money got transferred.

Unless you have a special talent for IT or teaching or something else - it will be very hard for you to find a job that pays enough to keep you in the standard that you have come to expect from life.

It all depends - you do not say where you live, but if in England - it is not the end of the world, you can jump on a plane and you're there within the day.

I can guarantee you that being in Poland for a holiday is completely different to living there. After 2 months you will be swearing like a trooper, everything will get on your nerves, the bureaucracy will kill you...but the food might be o.k. for you.

It would be extremely difficult, almost impossible for the president to grant you citizenship, unless you are a gifted footballer who can play for Poland and score goals in international games. Other than that your chances are less than zero.

If a person wants to drink, smoke and do drugs then surely the only person they have to answer to is themselves. No one has the right to tell anyone else how they should live and whether to smoke drink or do drugs. Once you accept that everyone has a choice then let them do what they want. It is not up to anyone to tell me or others what they should and should not do. You cannot make a person do what you want because it suits you.

It may be an idea to actually ring up the place which issued the original document and ask them. The town is given as Strzyzow. Look for any contact and then either email or phone them and ask.
