Law / Family law in Poland - want the Polish children back to the Irish courts [53]

@Number47
It is a pity that you had not explained your position FULLY in the very first post. We would then not be guessing what you can and cannot do.

As things stand (and I'm playing the devil's advocate here) the mother can say that you have constantly for the last 10 years abused her and the children, have not provided for her and the children and she had no alternative but to finally escape from this situation.

You will have to prove to the Courts that she was wrong in doing what she did.
It seems strange that you did not know what she was planning - you should have acted sooner.
I cannot understand how she was able to take the children abroad without any written evidence from you that you agree to the trip.
You are on a sticky wicket due to your past - but should still fight...but it will be a long fight.

Law / Family law in Poland - want the Polish children back to the Irish courts [53]

I still believe that the mother could say that she took the children as normal (she does this every year with no problems) to Poland for Christmas. You then do not have a leg to stand on. The children MUST be on her passport (or have own passports) to get through the borders.

It is extremely unlikely that the mother took all her and the childrens' possessions with her to Poland when she went. The court may believe that (if there are any possessions left) she intends to come back. You cannot PROVE that she is not intending to do that.

You are on a sticky wicket. I do not understand why you are not married - you would then be in a better position. The main thing is to have EVIDENCE why she did not want to marry you, that you have provided for her and the children and that you have never abused her or the children financially, physically or mentally. You need to be getting evidence to show that you are coming to court with clean hands.

Work / Some questions about average wages and hiring a cleaning woman/maid in Poland [23]

I would advertise and see who applies for the position and how much they want. We can all write that you should pay this much or that much, but in reality it is the QUALITY of work/cooking that is most important. Remember if you pay peanuts - you get monkeys.

A good piece of advice: Get everything down on paper for you both to sign and date. This may prevent arguments later on that you promised to pay for this and haven't or she promised to do that and she hasn't.

Law / Family law in Poland - want the Polish children back to the Irish courts [53]

@Number 47
Please read Polish newspapers from a few days ago. A father married to the mother of a child (but separated from her) arranged a kidnapping of the child and is now in prison for at least 6 months while they decide his fate.

Before you commit a criminal act, make sure you know EXACTLY the consequences of any such actions.

You have to wait until January before you get a decision from the Irish Courts. If they say that you must have contact with the children and you can PROVE that the mother is preventing you from doing so, then take her to Court again.

As it stands now - the mother can say that she has taken the children to Poland for Christmas, like she has done before and you never complained.

Make a note of dates and actions taken on any date, so that when you go before a Court you have PROOF of what has been going on. Keep copies of all emails, phone conversations, texts etc. This is all EVIDENCE.

Does your name appear on the birth certificates?
Are you paying for the upkeep of the children (even without a court order)?
Firstly, collect ALL EVIDENCE you can to prove you are the father - you may then have some rights. Very difficult to enforce this in Poland.

The children themselves do not have to physically appear in any Court. The Court judgement is what counts.

Work / Information about jobs for Indian students in Poland [286]

>>>>There are no part time jobs for students (who don't speak Polish) and being a student in Poland will not let you enter the United Kingdom.

I don't understand how someone can even THINK that not speaking the local language, he will be able to get a job that will fund his studies.

Enlighten me, someone...please.

Further, knowing that there is high unemployment among Polish students (those that are still in Poland, the rest have left) someone, not speaking the language, not having any connections - can even dream of getting a good job afterwards.

I take the point about entering UK, - but all non-EU people entering the UK are subject to rules and regulations - not automatic entry, only for the reason that they have studied in Poland. This does not make them EU citizens.

By your reasoning, all women are women, so the differences between them are also not THAT important.

Study / Clark University in Warsaw Campus (Professional Communication) [12]

I was not aware of that. This changes everything.
In this way, being a student pays off, and once you calculate the cost of your 'education', you can remain in Poland for 2 years afterwards and earn more than enough to cover your initial fees.

Study / Clark University in Warsaw Campus (Professional Communication) [12]

I suspect that not many people have actually even heard of Clark Uni in Warsaw.
However, the decision for study at this place is left to you, EXCEPT, don't come back if it doesn't work out.
This is NOT the way to get into the country, remain and get a good job afterwards.

Study / Confused about WSGE Jozefow MBA - reputation and chance for a job in Poland or abroad [6]

NO. I of course assume that your Polish language skills are of a standard to undertake higher-level studies. As for a job, you have very little (practically no) in Poland, as an employer will have to go and obtain a work permit for you and why should he bother when there are thousands of Polish students (with MBA already) searching for the same jobs.

There are thousands of websites in Poland selling clothes (new and used). I do not see that what you proposed to offer is anything different to what they already offer.

Law / Temporary residence and work permit in Poland check [15]

I don't seem to understand the original post, but to my way of thinking (correct me if I'm wrong).
Work permit and residence permit are TWO separate things and require two separate instigations by your lawyer.

Study / Transfer ECTS credits to a Polish university...possible? [13]

The best way to find anything our - would be to send an email to the University, stating what you have studied, and how many points you have been awarded.

They are the ones who will either accept you, ask you to take on further courses, or reject you as being unsuitable.

Law / British living in Poland - tax treaty with the UK? [30]

I think that you can only pay your income tax in Britain, if you are a resident of Britain and you are entitled to receive your tax-free allowance.

However, once you become a permanent resident of Poland, it is likely that you will be taxed on your income in Poland in the same way as other Polish people.

If this is incorrect, perhaps someone who has gone through this process can advise.

Life / Is it common for Polish people to speak English in Poland? [122]

>>>>damn right!! I tell you what really annoys me, is when people use 'myself' and 'yourself' instead of 'me' and 'you'.

This annoys me as well. I then think that a person who has no grasp of English grammar cannot have a grasp of anything else.

News / PiS to force every hard working, low earning Polish family to pay for TV [96]

You may be incorrect in your assumption. TVP is a private company. It is TVP S.A. - in private hands.
No one has signed an agreement with this private company - there are many links on Interia.pl showing exactly the same. Also, the Post office (who is responsible for collecting the tax) is in no way related to TVP S.A.

News / PiS to force every hard working, low earning Polish family to pay for TV [96]

They have agreed the fees/charges for 2016. It is 22.70 pln a month.
My argument that it is not STATE television still stands, as all of the stations broadcasting are in private hands. So in effect you are paying towards the profits of private companies and not the state.

Law / Drinking in a parked car. What the Poland's law says? [24]

>>>>>Wrong. In the UK you cannot be drunk in a car even while asleep and with no keys, because you are in charge of the vehicle.

That is why if you are inflagrante on the back seat - it would be difficult to prove you were in charge of the vehicle...

>>>>>>If they are blind they can still watch TV and if their are deaf they can watch TV. :D

Sorry I couldn't resist to take a crack at this. :)

What you MEANT to write was,...if they are blind they can still LISTEN...no one who is blind can see.
Sorry, couldn't resist....:-)

Law / Drinking in a parked car. What the Poland's law says? [24]

The law states...'in charge of a vehicle'...so that if you are sat on the backseat with your girlfriend making whoopee, it would be very difficult for the police to charge you.....

News / PiS to force every hard working, low earning Polish family to pay for TV [96]

We have all forgotten about people, who for whatever reasons (e.g. being blind, being deaf, being disabled) cannot take advantage of watching TV or listening to the radio. What exactly happens to them? They have to pay electricity bills, but do not see or hear....so how can the argument that it is for TV/Radio apply to them?

If this is a tax - then call it so. A tax to pay for the inflated salaries of so-called 'stars'.
