New flat from developer in Poland - question

Is it true that if someone buys new flat from developer in Poland he doesn't have to pay 2% tax?
I know that if someone has house/flat for at least 5 years and sells it he doesn't pay income tax. But what if I am British resident ( I live and work in UK but have polish passport) will I have to pay tax according to british law? ( capital gains tax)

It is little confusing.

I wish I knew that too -- but I think you are right that completely new apartaments/new constructions are tax-free.

If you are a British citizen, nobody except for you has to know that, no? At least when you buy a property in Poland (then as a British citizen you'd have to pay taxes, but I don't think you'd have to pay taxes twice -- at least I hope :).

It depends on location,size........My developer bought land but prices are not set up yet.

But it will be for about 6 000 pln for 1 square m. It is still srodmiescie in krakow but on the north edges.

So I suppose 40-45 square m will cost about 40-45 thousand pounds.

What I still don't know is if I had to to sell this flat Would I have to pay tax in England.
They don't have anything like this 5 years period. You pay always tax. I don't know if there is communication between Polish and british Inland revenue?
