Law / Temporary residence card to obtain a mortgage in Poland? [17]

You may find that some of the best mortgage deals are only available to those with Polish residency. However, it is now easy for foreigners to get mortgages. I have used OpenFinance as brokers and found them very helpful. They are in the main cities. No doubt there are other good brokers.

For what it's worth, I was in Poznan when Euro 2012 was announced. I had offered the full asking price of 3 million Zl on one property, and 3.2 m Zl on one with an asking price of 3.5. The next day, the 3 million one had gone to 6.4 million and the 3.5 m one to 5 million. Basically, no-one wants to sell all of a sudden.

So if you can buy in Poznan at sensible prices do so, but be aware that it is all very frothy there at the moment.

You're 100% right that there is very little thought given to how to rent out in Poland. Not only are there difficult security of tenure issues, but also finding agents to manage properties is quite difficult.

You might consider having a look at Davidoff Kleeberg & Maresch. They are in Warsaw, have just started in Krakow, and I believe will open in Wroclaw soon. Their web site is worth looking at. You can Google it.

It seems to me that if you only have a reservation contract you are in a very weak position. You really need to have signed the preliminary contract and, if you want to enforce the contract rather than having the deposit paid back twice over, make sure the format of the contract is Zadatek.

I know nothing about BudMar. However, I do know that some developers have clauses allowing them to raise prices in line with increases in the cost of building. So long as this is in the contract, and given that the value of apartments is probably rising even faster, such a clause may not necessarily be unfair. As always, read the contract. Use your own lawyer and don't just rely on the Notary.

Be aware also that there is recent legislation governing what clauses developers can use in contracts. You will need to see a Polish lawyer on that. I am only a UK lawyer. It may be that the BudMar contract predates the new law.
