Do I need to have my residence permit finalised before my husband can apply for his as family member

Hi,

I'm British, recently moved to Poland with American husband. He has been married previously and has apostillised divorce certificate. We married in Denmark.

We're moving here based on EU freedom of movement, which eventually allows moving back to the UK on the Surinder Sing route. In the meantime, we have an apartment (both names on lease), joint bank account and I have a job.

We want to apply for our residence cards this week - but do I have to have my residence permit before he can apply for his as my family member? I've seen they have up to six months to process my application. A long time to wait before submitting his application.

Hi Eban

If your applying this week I would simply ask at the Urząd Wojewódzki when you apply.

Although I would imagine so, that you would have to wait.
