Sabbatical holidays policy in Poland and employment contract

Hey people,
Does Polish Labour Law allow for Sabbatical holidays - resting from work for a long period with no pay but keeping employment contract intact?

I doubt it as every time I mention it since at home we are allowed to take up to 12 months, Poles are amazed. You might though "negotiate" some time off with your boss....

yes, it's called "urlop bezplatny" and it is in fact specified in Polish labor code and should be permitted in most private companies operating in Poland. But if the company says no, an employee won't be able to do much about this.

Yes, Pol, but how long can it be? When I mention that at home it is up to a year, Poles are most amazed.

I think Andrzej Duda is still technically on such a thing and has been on it for years and years from UJ.

Edit : just checked, and there's no time limit.

From what I can see, it's very common in certain areas such as education to take such time off, and it's also widely used in corporations if someone wants to go and study at a top university abroad.

maybe so, Delph, in education but among "average" workers, I doubt it is done. I have dealt with dozens of big corporations of various nationalities here in Poland and no employee (= top executives) was familiar with it. I conclude that even if provided for by Polish labor law (since Poland has signed with the International Labor Organization, in Geneva), sabbatical leaves are not common in Poland contrary to what they are in Western Europe for instance.

Yes, Pol, but how long can it be?

It can be very short, even 2-3 weeks, for medical treatment or long, even up to 12 or 18 months -- so, there is no limit. but if the employer finds another worker with the same skills and experience, they may terminate the employment contract as well. So the risk is always there....

@Pol: if for medical reason, it is not a sabbatical leave but a medical leave..... Anyway, I agree with you that taking long leaves for whatever reasons can be very risky....

@ in Polska: Yes, it can be risky for an employee unless you have very good relations with your boss and are certain that they will not let you go during "urlop bezplatny".:))

Frankly speaking, a foreign company "firma" which is based in Poland (with their Polish-educated lawyers) will always find a reason to fire an employee, lay -offs, redundancies etc.

medical vs. sabbatical leave -- there are BIG DIFFERENCES between specific legal systems in each nation-state in Europe, they call it european " union", but this doesn not refer in any way to the unified legal systems.
