Is it compulsory to have visa or karta pobytu to get marry in poland?

I am a student here in poland and I am about to complete my study here..coming semester will be my last semester.I had applied for Karta pobytu,four months ago and got really amused to get negative decision at this stage when i am about to finish my bachelor study. I am going to appeal and would please them to let me finish my study and not to play with my career.

I want to try to get visa somehow..I have polish fiance here and from 6 months we are trying to get marry but still we couldant. it all took long time to get paper from court and now when we have all paper for marriage then urzad stan cywilny ask me visa. i do not have visa but i do have red stamp which defines my saty is legal till now in poland.At this stage neither i have visa nor i have got karta pobytu.

is it possible to get visa from urzad wojewodzki by showing them all paper of marriage that we want to get married?

or

is it possible to get visa from berlin embassy by showing all the papers that me and my fiance want to marry here?

how can i get visa to marry here...my fiance want to get marry here with me with her all family

please suggest me in this difficult moment:(

You can not get married in Poland unless you are here legally (i.e. you have a Karta Pobytu or valid via).

I am legal here.I have got red stamp (pieczątka) on my passport which defines that i am legal here.

The only thing is that I dont have karta pobytu or visa....

That won't count - it's only a administrative decision which says that they're waiting for a final decision on your case. In fact - I'm not certain that the stamp ceases to be valid upon a negative decision being received, subject to the usual appeal process.

You need the Karta Pobytu or long term category D visa.

Incidentally, on what grounds were you refused the Karta Pobytu? It can only be refused if you don't meet the criteria.

they asked me to show 18000 zloty in my account and then i had shown them but they ask me again and again the same money...I mean 18000 zloty ......so i show them that i had 10000 second time and third time after someday i showed them that i had 6000.This was only reason that they gae me negatie decision.

You said you have got negative decision for karta pobytu but you have a red stamp. Can you be more precise? Since they gave you negative decision you have 10-15days to appeal against it. So if you appeal against it they would probably give you administrative visa which is for 3 months, If I am not wrong you also had visa valid when you got your decision.

I know few people who were not even legal and got married in Poland and that was shock for me. Valid visa or karta pobytu is asked by marriage office and is normal. Since you dont have visa so it means you cant travel to schengen countries or to Berlin. If nothing works for you then the last option for you is to speak to the foreigners office and explain your situation and probably ask you fiancee to accompany you and speak to someone head of the office, Again it will be totally against the discretion of the office if they can do something for you or no.

I appreciate your answer and would like to tell you in detail.

Actually they gave me this red stamp when my karta pobytu was finished and they told me to wait for the decision .....and with that red stamp( pieczatki) on my passport I have got zameldowania for theree month.

I have asked lawyers and have red article ...and that there is no such rule that a foregnier must have visa or karta pobytu to get marry in poland but of course one must have legal status in order to get marry in poland.but its just their demand (urzaud stan cywilnego) ...and also heard it differs from place to place.for example in warsaw they dont need visa or karta pobytu to get marry..but just they just need a valid passport.

Now i am supposed to appeal with in a week time...but i think they will not give any visa but they will say...that red stamp on my passport defines my legal stay so for what do i need visa?

I have got all papers to get marry ...I have aslo got paper from court that me and my fiance can marry in poland.

even after having all papers of marriage still I dont know what can i do ?

I am just curious that if my fiance go to berlin and show them all papers of marriage that we want to marry in poland ....and tell them to give visa for sometime to get marry then they will give or not?

Which city are you located and where is your fiancee from? Where you guys planning to get married?
