Zameldowanie and the landlord presence vs rental contract only

Dear All,

another inquiry about the residency registration certificate: we have been living my wife and me in small flat owned by my wife's parents, but as the flat is pretty old, the family decided to renovate it, and probably sell it later on.

We have to move, and as consequence change my residency registration. The problem i am facing is that we will rent new flat owned by non-family member: is the rental contract enough as document to submit to the city hall in order to get zameldowanie? or does the owner have to be in person to sign? i think that the latter option will be difficult is not impossible, as the landlord will think we will stay forever and therefore will not rent us the flat.

Any idea what do to? will they accept only rental contract atcity hall in order to re-register my address in the new rented flat?

Owner in person with notarial deed confirming ownership in hand or no maldunek. I went to get one for myself and although they agreed that I did own the flat (they checked the records of who pays the property tax and who give previous malduneks), I couldn't get a maldunek because I didn't have the notarial deed confirming ownership of my flat.

Ouf...i am going tomorrow anyway to ursynow cityhall in warsaw to check, before i sign the rental contract. I read in many blogs that sometimes they dont ask ab the owner to b present, and even some said in some blogs that the zameldowanie is to be abolished. Is it true? if city hall will insist, then i have to check if landlord accept. But if no, then what hundereds and if not thousands of fioreigners like in my case who are still in the 'residency for set period of time' will do, if they don t have address and/or if they can t get???

zameldowanie should be abolish anyway, its is costly nonsense (for the state)

They just get somebody to sign saying that they live at that person's flat.

If I was you, I'd just keep my official address at the old flat until it is actually sold.

Apparently a written contract (with full details of who both parties are, including ID numbers and so on) is enough - but many 'landlords' won't want to give this because they don't want the tax office finding out.
