If my restaurant is less than 50m2 do I need a social room (zaplecze socjalne)?

Is there any way to get around building a social room (Zaplecze Socjalne) if my restaurant is very tiny (50m2)? Seems bizarre to be forced to have this. The max workers at any time would be 4.

From my research, you are required to provide a social room regardless of the size of your restaurant in Poland (UNLESS the employees are not expected to work more than 2 hours for every 24 hours in the building). The social room doesn't have to be at the same building as long as it's not over 75 meters from the workplace. So if you absolutely cannot provide a social room at your restaurant, the devil's advocate advice would be:

1) Hire temporary workers who are not expected to work for more than 2hrs a day;
2) Check if there is a building/place (ideally a public restroom located within 75 meters from the restaurant) and cover the expenses of your employees to use a bathroom there ; )

Thanks. I was thinking of asking a nearby business if we could share a room. The public toilet idea is interesting.
