TRESPASSING ON MY LAND IN POLAND....what can i do legally...?

Its not a major problem , but its annoying the hell out of me...

I did not move to a farm in the middle of the country to have people dropping in at will , not that they are coming to be sociable , more a case of stopping by to help themselves to fruit from my garden....

The problem comes from the old bat on the next farm , she mentioned to me once that her young grandson would sometimes help himself to an apple from my trees as he passed my place , this was from a tree that could be picked from without venturing onto my land... Not a problem i said , i have lots more than i can eat... This turned out to be not the right thing to say....

A few days later i discovered her entire family stripping bare all my trees and bushes of apples pears , berries and plums..i was not very happy about it....

Most of the trees and bushes can only be reached by walking some distance onto my land to get to them.. A few days ago i once more spotted the old bat and several members of her family well inside my borders taking apples...

I am not bothered about anyone grabbing a few from trees that overhang my borders , but i am not at all happy about somebody coming onto my land to stock up for the winter without even asking me if its ok....

What can i do legally to deter them...? i have a few not so legal ideas in mind but what is the law in Poland on such matters....

Get a dog and a Zle Pies sign. Let it run around loose on the property, or at least guard the entrance.

Get an interdict/injunction. Take photos and catch them in the act. Proof is what you need and legal remedies don't tend to be too practical unless you are on a solid footing. Remember that a court here is likely to believe a native over an expat.

I mean what does it matter if you are off to Moscow, to a good woman.

This is what worries me....if they think coming onto my land is ok , and they know i am out of the country i am liable to lose a lot more than just apples...

Well , i am not planning on selling the place yet.... and i don,t want to return at some point to sell it and find there is no roof , doors windows or floorboards...

Are you not going to have some one live there, to tick the place over, especially during the winter?
Maybe that has nothing to do with what you want.

You should promise to marry her daughter and leave her standing at the alter.

Put some bear traps on your property. If there is some blood trail when you are back home, you know that everything went Ok ;) Usually this explains better than friendly talk.

you need to hire a friendly soul from the village to check the place out every so often, or rent it out to somebody when you are in Russia.

A friend will be using the place for a base for his paintballing ( ballpainting ) business , but i suspect he won,t be around the place much in winter....

When i confronted the old bat she just smiled and nodded....

I should not call her the old bat really....she is the same age as me....

but she looks like Stalin....!

Why not just sell?
Or try to find someone to live there, a house with noone in it will fall in to disrepair quite quickly, especially given the condition I believe it to be in.

Why not just sell?

My problem is that if i sell the farm i have no place to put all my stuff...its going to take a few trips to Russia to move just the bare essentials...

And yes its not in great condition at the moment...

Put out a big sign "TEREN PRYWATNY, WSTĘP WZBRONIONY".

Some fence will be helpful, too. But realistically, if you are not there, your property will be stripped bare. I had a house in the countryside where nobody was living there. All the fruits on the trees and anything of metal was gone.

I wasn't havin a go at you but I think if you are to hold on to the place, you should find someone to live in it, while you are not there.

As for people taking the fruit just tell'em to get lost! (stronger language might be necessary but since this is a family website)

I mean realistically what do you expect the law to do? They can't drive around your plot looking for phantom fruit pickers, they could warn a few people off but having someone living there is your best deterrent or bear traps or standing Stalin's daughter up at the aisle.

Well that's my opinion anyway.

Send them a bill, an invoice with a list of everything they've taken and the amount of money that they owe you. Tell them if they don't pay you, it will go to court. (It will be just to scare them into stopping, of course).

If you had seen the daughter you would know that nobody is going to believe i want to marry her....

She looks more like a pig than a pig does , and she has a baby that looks like some kind of rodent from Chernobyl..

I don,t know if she is married , but there is a guy living there that does look ugly enough to be the father of the mutant child...!

Why don't you just tell her that as soon as you are gone, she can take as much fruit as she wants in return for looking after your place. A friendly neighbor is better than a distant enemy.

The fruit has no value you to you in Russia and she will take it anyway.

The fruit i am not that bothered about , although it is very annoying to have to go and buy an apple when you have five apple trees in your garden...

The thing is , i am not entirely certain that members of her family were not involved in the theft of tools and equipment from my farm , so i would rather not inform her of my absence from the place...

Its a pretty small village near my farm , so i dare say it won,t be long before word gets around that the place is empty , but hopefully by then i will have got the things i value out of the place.....

Sadly , the Polish friends i trust completely do not have the time or the means to keep an eye on my place....

It would be great to have somebody living here , but its very basic here , and the only people likely to want to live here are those that are poor and desperate , and likely to sell everything they can to make money...

I will figure out an answer somehow....????

Put the farm up for rent on here. Or maybe offer it up as a crash pad for some of the bikers that you know. That way you could have people going there at very random intervals.

That's true. Very true. BUT, bikers are usually self limited from stealing too much stuff...

I was thinking about people on HUBB doing cross countries.
