Property dispute (hired apartment contract in Poland)

I have been hired one apartment from December 15, 2014.
In first visit to watch the apartment, the owner lies to me that Microwave, Washing Machine, Wash basin, Toilet, Ventilation all things are in good working.

Further all apartment need to be repaint and floor must be carpeted because wood floor was very old and bad condition. It is agreed that tenant will paint the walls and put the carpets on the floors. And the cost for this will be adjusted in any agreed way. It is further agreed that the owner also will take off all the old furniture from apartment.

After signing the contract, when I take over the keys, it reveals that that all above mentioned product are not in order and need to be replaced or repair.

After my several contacts to owner, at last she blamed me that I broke all the things, and I must repair or replace these products. She added that I must bear all the cost of paint and carpets for the apartment and she will not labile or adjust any cost for this.

Now she wants to cancel the contract as well as demanding the one month rent money, otherwise she threats me to go to Police.

Anybody can guide me what could be the solution?

Why did you take possesion/or moved in the flat?

Police cant do jack **** if you tell them its a civil case and she has to go to court for that.
I would start the process in court(which will last a long time)meantime pay her rent through bank deposits and live as long as you want then one day she will beg you to leave...then ask her for some money to do so:)

Go to the free legal advice service in your town. Search for porad biuro obywatelskich (advice bureau for citizens/people) in your location. Take some ID, ie residency registration or passport. An appointment is free, although you may have to queue for some hours but you can sometimes simply return for a particular appointment time.

As far as I know, anyone who is legally working or living in Poland qualifies for free legal help there. The person can be an alien (or even a martian).

thanks for every body help, as i understood police will do nothing?
it is not an issue to deal with police, but i have to do my job, thats why i avoide this situation.

actually i didnt moved there, i visited this apprtment for removing old furniture and little repairs, like lock of bath room and some srawers, and i found thiese problems.

before i was calling this lady to come and see but now she truned and accused me for all this problems.

This is a pretty important thing to clarify. Was all of this stated in the tenancy agreement?

Have you paid a deposit?

no in contract it was not mentioned that who will bear the cost,

this women played with me in two aspects,

1. she put cluase in contract that every thing is ok and tenant have no objection. ( but actually all the products were demaged, even doors lock need to replace, nothing was in order, the time of showing the apprtment she hide all things, offcourse i can not see all in one look)

2. in contract it was mentioned that paint, new furniture, will be remain the promperty of the tenant , if he put there, but about paint this is not written that who will bear the cost, i was verbally agreed that i will pay the cost at start but later it would be adjusted or refund back, carpets i have plan too and this women was also agree for new carpets, beacuse current carpets are almost absouleate, but she dont want to pay any cost. thats why i stoped.

in my point of view, she knew every facts, but she want to make contract me just to trap me, i belive if she was not true at the time of contract, there is no contract at all, this contract is void from the start and have no existence at all.

If you didnt pay any deposit then beat it man,let her take you to court assuming she does then ur arse is grass:),most likely she should/will not.

It would be quite hard (not to mention expensive) for her to take you to court and Pigsy's advice is good - walk away from the situation.

I agree with Jon here. Irrespective of whether the contract is void or not, I seriously doubt that she would take you to court. Too time consuming and expensive, particularly for a landlord who likes to play cheap games and avoid investing back into their property.

If you haven't paid a deposit yet, all the more reason to just walk away. I would terminate the agreement or state that you believe it to be void from the outset, give clear reasoning, highlight that she has acted in bad faith etc. Do it in writing, in Polish and sent recorded delivery.

I'm not a lawyer, but I am a pretty experienced landlord operating in Warsaw.
