EU confirms it will take action against Poland over court reforms

Three of the five appointments were made legitimately by the previous government. The positions became vacant and needed to be filled within the tenure of PO so Duda had no grounds on which to refuse to endorse them. The issue concerns the other two which could be viewed as an attempt by PO to stuff the courts with their own henchmen which is most definitely unconstitutional (and that's what PIS is trying to do now). So Duda was right to refuse to appoint them in my view. As I've said many times Gumi, they're all as bad each other for the most part, though you always get decent individuals even amongst the mayhem, not that I think Duda is either decent or bad. He's just a bit of a non-entity, chosen by JK to do a job for him.

the European Court will issue a preliminary judgement in the Irish extradition case in July.

Just a little update. The premliminary judgement was issued earlier and the final judgement was handed down by the European Court of Justice today. Other EU nations are no longer expected to automatically honour extradition requests. Instead they should use a two step check process:

1) Decide if the foreign court can be considered independent of outside pressures (this was always taken for granted within the EU).

2) If they decide that the foreign court is NOT independent the extraditing court must assess whether that lack of independence is likely to directly affect the trial of the defendant in question. With regard to the Polish guy awaiting extradition from Ireland the ECJ said that Warsaw could be asked to provide a guarantee of a fair trial to the Irish courts. However I'd say that when he's extradited, the Polish courts and more importantly the Polish government who now control them, will know that this is a landmark case so they'll play it by the book. Having read the charges against him in detail (the Irish courts have it all on file) he's likely to go down for a nice long sentence. Btw, he was in possession of drugs with a street value of around 350,000 euros.

If i were in dudes shoes id much rather do time in an Irish prison than a polish one. Many prisons in the europe like in UK sweden Iceland Switzerland etc resemble college dorms more than prisons. One of my friends served like a 1.5 2 year sentence for fraud in uk and the whole time he just worked out and smoked weed. Wed even chat on viber as he showed how it was inside. Also the sentences tend to be a lot more lenient in most eu countries than the rest of the world. For trafficking he'll likely get 7 8 years if there's no aggravating factors and get out in 4 or 5.

Atch can you provide a link with the charges he's facing?

Your friend was lucky then. The UK prison system has often been noted to be rather bad and underfunded.

@Atch
How exactly would Poland be expected to give such a guarantee.

Yeah there were a lot of fights but stabbings were rare. Lot of extortion lot of drugs trafficked and a hell of alot of radical Muslims trying to influence more secular ones. He said were a lot of east europeans though esp poles lithuanians and romanians so he didn't have any problems. The officers didn't seem to be in control they all just stood around like the middle talking to each other letting them all do their own thing.

If i had to do a sentence anywhere itd be Venezuela. Their country is crumbling but their jails are like a party - some people don't even want to leave hahaha

Its easy to Poland. If EU continue like this, if Trump go mad, Poland can always turn to Russia. Temporarily, at least. Why not use Russians? And give them something in return, sure.

That will happen only after pigs fly and hell freezes over... at best there'll be a bit more economic cooperation over the next few generations as the cold war becomes something that people read about in textbooks but did not live through or no longer habe families that did

Still, its an option. I telling you. This world is crazy enough. Look how EU evolve. Evilevolve, I mean.

Independent judiciary is curse. We have those independent moron federal judges who think they are presidents. Later, they are smacked down by the USSC but it takes time and money to get there.

Judges should be limited to trials and kept from running the country as far as Muslims should be kept away from Poland. Under no conditions, should they be allowed to stop the president from deciding what the Constitution and the law allows him. Like immigration. Threatening Poland over the judges' retirement age is an act of aggression. Unbelievable.

Latest turn of events:

bloomberg.com/news/articles/2018-08-02/polish-supreme-court-suspends-judge-retirements-until-eu-ruling

The Polish Supreme Court is refusing to comply with the new laws and has sent five questions to the European Court of Justice regarding the proposed changes and their legality. Fair play to them for standing up to Kaczyński.

Btw did anybody notice the 'changes' to the electoral code which were slipped under the radar a few days ago while the public's attention is concentrated elsewhere.

See atch told you pis has no intention of leaving the eu. If they did they wouldnt give a sh1t what the eu says. But for now theres money coming in and eu membership remains popular among poles. Id prefer Poland to leave after this next round of funding before they become a net payee, but it is what it is. I think that once poland has to pay into the eu the support for remaining a member will decline.

These commie 6 term judges, the ones clearly working against Polands interests and those stuffed by po need to be immediately purged.

As you know proper lustration was blocked in Poland , its about time this whole situation brought out into the open , all those connected to the communist regime should be named and given a grade which denotes the severity of their treachery against the Polish people , time to clear out the cesspit once and for all.

I'm well aware and now the eu is helping to impede lustration.

should be named and given a grade which denotes the severity of their treachery against the Polish people

That would be a good start for sure. Those with an f should be charged with treason.

Would they be allowed to let murderers and paedophile walk free from justice?

Where is the Justice for my mother and father and the hundreds of thousands either murdered, starved to death in Siberia and further exiled from their homeland by this rabid soviet cult.

Time for justice, clear this rabble from Poland now, I am fed up of being told that such and such working for local government was a active commie back in the day.

Evidence must be gathered and the guilty punished.

The EU and UK has protected peados especially those politically connected as in the case in Belgium. Same with the paki rape squads. It's only when their activities become too public and people start complaining that they do something about it.

Where is the Justice for my mother and father and the hundreds of thousands either murdered, starved to death in Siberia

I hear ya. We went through the same. Im not expecting any justice or compensation for those family members or their descendants. Neither from germany or Russia, although with germany there may still be a chance.

Perhaps when I move back to Poland I'll throw my hat into the political arena.

EU will nothing. EU is disgrace. Why non of you say that simple truth. Disgrace. Plus, monstrosity, abomination, heretical spawn of this world and maleficarum of underworld, fart of lucefugera, evil eye and worse.

EU WILL BE ILLUMINATED.

So, don`t worry Poles. EU will nothing. Empty threats.

The European Network of Councils for the Judiciary will take a vote on 17 September on whether to suspend Poland on the basis that the National Judicial Council of Poland (KRS) no longer fulfils the conditions for membership:

Because having judges chosen by parliament is surely worse than by their fellow judges. Makes perfect sense. No possible conflict of interest having judges chosen by other judges.
Ruprecht

chosen by parliament

In Germany, politicians appoint judges and the EC is not making a fuss. Judicial arrangements are an internal matter for EU members and no EU treaty says how to appoint judges or what reforms to carry out. Not all EU countries even belong to the European Judicial Council Network which has no political clout and is mainly a decorative organization.

Because it's not true!

Half of the actual 16 judges are voted for in by the Bundestag, the other half get's voted in by the Bundesrat. The term is limited to 12 years and they can't get re-elected.

Latest news.....

bbc.co.uk/news/world-europe-45917830

The European Court of Justice has ordered Poland to suspend and reverse the law regarding the lowering of Supreme Court judges retirement age from 70 to 65 and to reinstate those who were dismissed.

This is an interim measure and a final judgement will be made at a later date.
Interesting times ahead for sure........

Yes, Dirks' BBC film posting in OT perfectly illustrates why that is. You have a relatively high percentage of inhabitants with a long lasting inferiority complex from imagined victimhood. When you have a nanny state that has the time and freedom to spend (our) money telling them how wonderful it is to be Polish, and that daddy will get them that 500 zl he promised them, then people will vote for that.

The test comes down the line with the lack of progress in other areas due to these "generous" welfare payments.

Yes,

Yes, indeed. You have no clue about Poland. Sadly it must be true what you said about yourself regarding your IQ. Plus you're progressive that alone is enough to simply ignore your 'opinions', Let mention for a good measure your language skills after 30 years in the country and everything is clear.

Pis is setting polands reputation back many years.

Reputation amongst progressive establishment is worthless in the long run anyway.

The European Court of Justice

Not that anyone cares about it anymore. It is rather a question of integrity. Is PiS sturdy enough to tell them to go pound sand in a way that is a the same time constructive and clever?

As to the crux of the matter - regardless of a fact who is in charge in Poland EU (read German) action is unacceptable. It is a grab to bring down the last vestige of Poland's sovereignty. Such encroachment should be met with countermeasures. Few obvious steps came to mind.

language skills

Are nothing to do with IQ. And as for such as "intelligence", I am able to laugh about myself. Tell me - have you ever laughed at anything - other than AT other people?

As to the crux of the matter

You have no idea about Poland.

Sory iron. Its amongst all people. Polands reputation has been going down the toilet since they took over. Its going to take for ever to fix it. They are just too dumb to manage. Progressives? By that you mean not backward and stagnant like us here where i.live, we are just getting rid off our useless stagnants, first big blow was landed yesterday. Pis is useless, Poland is not atrong enough yet for their hair brained ideas.
