EU confirms it will take action against Poland over court reforms

Three of the five appointments were made legitimately by the previous government. The positions became vacant and needed to be filled within the tenure of PO so Duda had no grounds on which to refuse to endorse them. The issue concerns the other two which could be viewed as an attempt by PO to stuff the courts with their own henchmen which is most definitely unconstitutional (and that's what PIS is trying to do now). So Duda was right to refuse to appoint them in my view. As I've said many times Gumi, they're all as bad each other for the most part, though you always get decent individuals even amongst the mayhem, not that I think Duda is either decent or bad. He's just a bit of a non-entity, chosen by JK to do a job for him.

Just a little update. The premliminary judgement was issued earlier and the final judgement was handed down by the European Court of Justice today. Other EU nations are no longer expected to automatically honour extradition requests. Instead they should use a two step check process:

1) Decide if the foreign court can be considered independent of outside pressures (this was always taken for granted within the EU).

2) If they decide that the foreign court is NOT independent the extraditing court must assess whether that lack of independence is likely to directly affect the trial of the defendant in question. With regard to the Polish guy awaiting extradition from Ireland the ECJ said that Warsaw could be asked to provide a guarantee of a fair trial to the Irish courts. However I'd say that when he's extradited, the Polish courts and more importantly the Polish government who now control them, will know that this is a landmark case so they'll play it by the book. Having read the charges against him in detail (the Irish courts have it all on file) he's likely to go down for a nice long sentence. Btw, he was in possession of drugs with a street value of around 350,000 euros.

If i were in dudes shoes id much rather do time in an Irish prison than a polish one. Many prisons in the europe like in UK sweden Iceland Switzerland etc resemble college dorms more than prisons. One of my friends served like a 1.5 2 year sentence for fraud in uk and the whole time he just worked out and smoked weed. Wed even chat on viber as he showed how it was inside. Also the sentences tend to be a lot more lenient in most eu countries than the rest of the world. For trafficking he'll likely get 7 8 years if there's no aggravating factors and get out in 4 or 5.

Your friend was lucky then. The UK prison system has often been noted to be rather bad and underfunded.

Yeah there were a lot of fights but stabbings were rare. Lot of extortion lot of drugs trafficked and a hell of alot of radical Muslims trying to influence more secular ones. He said were a lot of east europeans though esp poles lithuanians and romanians so he didn't have any problems. The officers didn't seem to be in control they all just stood around like the middle talking to each other letting them all do their own thing.

If i had to do a sentence anywhere itd be Venezuela. Their country is crumbling but their jails are like a party - some people don't even want to leave hahaha

Its easy to Poland. If EU continue like this, if Trump go mad, Poland can always turn to Russia. Temporarily, at least. Why not use Russians? And give them something in return, sure.

Independent judiciary is curse. We have those independent moron federal judges who think they are presidents. Later, they are smacked down by the USSC but it takes time and money to get there.

Judges should be limited to trials and kept from running the country as far as Muslims should be kept away from Poland. Under no conditions, should they be allowed to stop the president from deciding what the Constitution and the law allows him. Like immigration. Threatening Poland over the judges' retirement age is an act of aggression. Unbelievable.

The Polish Supreme Court is refusing to comply with the new laws and has sent five questions to the European Court of Justice regarding the proposed changes and their legality. Fair play to them for standing up to Kaczyński.

Btw did anybody notice the 'changes' to the electoral code which were slipped under the radar a few days ago while the public's attention is concentrated elsewhere.

Because having judges chosen by parliament is surely worse than by their fellow judges. Makes perfect sense. No possible conflict of interest having judges chosen by other judges.

In Germany, politicians appoint judges and the EC is not making a fuss. Judicial arrangements are an internal matter for EU members and no EU treaty says how to appoint judges or what reforms to carry out. Not all EU countries even belong to the European Judicial Council Network which has no political clout and is mainly a decorative organization.

Half of the actual 16 judges are voted for in by the Bundestag, the other half get's voted in by the Bundesrat. The term is limited to 12 years and they can't get re-elected.

They also need to be elcted by a 2/3 majority.

The European Court of Justice has ordered Poland to suspend and reverse the law regarding the lowering of Supreme Court judges retirement age from 70 to 65 and to reinstate those who were dismissed.

This is an interim measure and a final judgement will be made at a later date.

As to the crux of the matter - regardless of a fact who is in charge in Poland EU (read German) action is unacceptable. It is a grab to bring down the last vestige of Poland's sovereignty. Such encroachment should be met with countermeasures. Few obvious steps came to mind.
