VAT on service imports from USA to Poland

Hello!

I have a Sp. z o.o. in Poland (Gdansk) and I'm going to pay a USA company for hosting services $100. Should I pay $22 as a VAT on top of that to the tax office?

I asked my accountant about that and he said that I shouldn't pay or withold any VAT but this sounds strange to me... Any accountants here or maybe there are some people who've already encountered with such a problem.

It's unclear which tax office you mean. However, you don't have to pay anything to the US treasury; you pay $100 and that includes everything (USA doesn't have a VAT.. yet). So from a business point of view buying online services, like hosting, makes sense if your own business is located in Poland or EU. Keep in mind, however, that a US host will probably assign you a US-based IP and if your business targets customers from Poland you'd be better off buying a host located in Poland, not in the US.

PS - these days the bigger hosting companies from the US offer IPs from Europe (especially from Holland or UK) -- in THAT case they will probably charge a VAT (because, technically, the service you buy is located on EU territory).

Wrong Nathan, each state in States have there own tax laws its called sales tax.Some states also require to add sales tax on services and the rate varies in each state.

Not true. There are a few states without sales tax.
