Probate laws in Poland - banking data access and money transfer

I've got a rather bizarre question. If a relative gives you his banking details whiles in his sick bed and then dies days later. Would it be legal to transfer the money in his account to ones personal account? In other countries there is a specified amount you can move or withdraw without a probate but it's rather difficult to get this information in Poland. Our fears are that the tax authorities will rip it off before it gets to the family.

No, absolutely not. The proper process has to be followed and authorised by the court, you can't just transfer money to yourself.


The tax authorities won't rip it off. The person handling the estate has to distribute the assets according to the law, and recipients are responsible for paying tax on the inheritance.

If he is compus mentus enough to give the details then can he maybe make a transfer while he is still alive ? Would still potentially be gift tax payable but would be quicker, create some facts on the ground, better cash flow and definitely save lawyers fees.

But using his passwords etc is very ill advised

We could have done it days before he passed on but sometimes it's hard to give up on a loved one when he or she says he is not going to make it. We have been hopeful that he will pull through. He started recovery and then all of a sudden he has to go.

Personal info of an account holder in Ing Bank - Poland

Is it possible for any employee of the Ing bank in Poland to reveal the personal information of an account holder?I suspect my information with address,contact info,identity and account transactions were leaked.

Quite easily, and in fact, such data is routinely sold in Poland by companies.

UOKiK should be your first step if you suspect something like that has happened.
