Obtain Poland's Citizenship for Adoptive Daughter

Hello,

I'm 18 years old and I'm currently living in Argentina, heading to live in Europe in the following months. My father and I have successfully received the Polish Citizenship by the Jus Sanguinis law, however, my 23 years old sister doesn't share my father's blood, which unfortunately means she is not eligible for receiving the citizenship.

We are trying to explore all the possible options that let her to work in a territory of the UE or in Poland, since our original intention was to move to Spain. The law that gives citizenship to an adoptive child is not applicable since it's from 2012 and the only remaining option that we know is to write a petition to the president of Poland.

Does someone know if there are other chances for her to live with us in UE territory and work? Do you think it could exist the possibility that the president accepts our situation?

Your sister would most likely manage to get temporary residency in Poland based on exceptional circumstances, possibly even permanent residency (if she can demonstrate links to Poland and Polish culture), but there's no way she's getting citizenship, especially if there's no intention to live in Poland.

Thank you for your reply, I was fearing that would be the case; the only thing that ties her to Poland is her adoptive father, she doesn't also talk the language, and this is the reason why we decided to go to Spain.

How could she obtain the right of residency? Would that permission give her the possibility to work in Poland? And how long should she live there in order to potentially receive a citizenship if it's possible?

So move to Spain, then file for your sister to join you there under the E.U.'s right to family life. Spain must permit this, regardless of her lack of citizenship elsewhere. I recommend that you find a lawyer in Spain to help you with this.
