as far as his wife she has to use his passport as prove for her reason to work in the uk

As an EU citizen, she has the full right to live and work in the UK regardless of her marital status.

Wroclaw,

You are only partially correct. You CAN do time for lying under polish law ONLY after you have been sworn / warned by the court about the consequences of lying. In theory that is....

First of all, judges as a practice never (or very rarely) follow this procedure, so even if somebody is caught lying.... no consequences - this is the law. Secondly, if they do warn the witness, they rarely do anything about it (lots of paperwork related to forwarding the case to the prosecutor office). I would love to hear /read in the media of ANY case when somebody did the time on such charges.

As far as letting children of Polish nationals travel to Poland. It doesn't matter if the child abductor is a mother o father. Both of them will be protected in most cases. Yes, recently Poland made some progress in Hague Convention cases, but the Polish Ministry of Justice is helpless should the Polish judges decided to issue an illegal decision. Remember, for last 10 years THERE IS NO appeal to the Polish Supreme Court in child custody (Hague cases including) under the law. Also, there is a great number of Polish Politicians who question the legality of the Hague Convention treaty itself every time there is a case when a mother / father is order to return a child abroad.

There is a theory and there is practice. I theory Poland was a Democratic country in 1952, 1960, 1970... but was it? Was East Germany a democratic country even though it was called DDR ?

On simple rule (no matter how "draconian" it may seem): you married a person from another country, and suddenly they want to travel with your very young children to Poland, Russia, Germany, Sweden or even Switzerland.... beware... block your child's passport, don't let them travel. This is what the US State Department itself suggests. I and many left-behind parents happen to agree.
