Love / Indian national is seeking help to get my Polish wife back! [30]

I was reading your post from start and about all what u have shared here I feel that yo should not push too much to get her back. If you will push and maybe get out of control things will get even worse. People tend to take some wrong steps in panic so my friend be careful.

I can imagine how is it to stay far from wife and kid specially when you know things are getting worst day by day but my friend just calm down. Don't straight away think about lawyers police etc. Try to get yourself settled with your work and stuff. Concentrate more to get yourself established as you know life in Poland is very difficult especially with work. I would recommend you instead send her emails about how you guys met and about all your good times you guys had. Send her email everyday about how u miss her and your day to day activity that u do and that she and ur son is always in ur thoughts. Try this I hope it helps.

You said you spend 125000zl in 2 months for me its a shock wondering where all this money went. I hope things become better for you.

I am not Polish but since my wife is Polish and I have been living here for about 5 years so I know something so as pr my experience I would suggest you few things. Your husbands passport has a permanent address, you need to contact the City office(Urzad Giminia in Polish) of the address in Passport as they will have all his details. I know it will be difficult for him to travel because his passport is expiring today. I would recommend you to get in touch with the Polish embassy and I am sure for them it is much easier to find the PESEL by calling to the local office or writing them a letter. I hope this info will helps.

i do not have visa but i do have red stamp which defines my saty is legal till now in poland.At this stage neither i have visa nor i have got karta pobytu.

You said you have got negative decision for karta pobytu but you have a red stamp. Can you be more precise? Since they gave you negative decision you have 10-15days to appeal against it. So if you appeal against it they would probably give you administrative visa which is for 3 months, If I am not wrong you also had visa valid when you got your decision.

I know few people who were not even legal and got married in Poland and that was shock for me. Valid visa or karta pobytu is asked by marriage office and is normal. Since you dont have visa so it means you cant travel to schengen countries or to Berlin. If nothing works for you then the last option for you is to speak to the foreigners office and explain your situation and probably ask you fiancee to accompany you and speak to someone head of the office, Again it will be totally against the discretion of the office if they can do something for you or no.

IF someone has a visa still ideally has to apply for Karta Pobytu, I dont know what is long term visa according to you. Most of the people get not more then one year visa and they extend it by applying for karta pobytu. Karta pobytu for non EU nationals is usually not more then 2 years at a stretch provided is not eligible for Permanent residence card.

As per your quote I understand you and your spouse are non EU nationals. Your spouse has received visa for 120 days which is good enough to apply for Karta Pobytu. Usually they give residence visa type D which is minimum for 3 months and once he is in Poland he can apply for Karta pobytu (Residence card). Since he has a contract for 18 months he should be able to get Karta pobytu provided his company gives all the documents required by the office and he follows the correct procedure (one of the procedure: Apply for residence card minimum 45 days before the end of visa). I hope this helps.

Love / Marriage in Poland (civil ceremony,need advice on documents). Indian girl. [36]

There is lot of process involved in it. Let me brief you for the same.
1) First he needs to go to Indian embassy and request in writing that he needs a certificate that he is single and not married. In return Indian embassy will give in written stating that this certificate cant be issued from the embassy as In India we don't issue such certificate.

2) Once you get this from Indian embassy you need to get it translated in Polish and arrange for a lawyer and apply for they can exempt him from this document and he can get married in Urzad Stanu ciwilnego without this document. You guys will have an Interview before they can give you this document, I guess he doesnt speak polish so you need to arrange for a Polish-English Interpreter for the interview with Urzad. Hopefully they will issue this document and letter you guys can go with this to Urzad and apply for civil marriage, I guess rest you know how to go about :) Remeber you guys gonna pay for all these procedures and it can take from 1-3 months minimum.

You can marry either in Poland or in India. In Poland it can be bit difficult because there are lot of paper work involved. Polish marriage office need a document stating that he is single and not married in India but this document is not issued by the Indian marriage office, so he needs to get document from Sąd rejonowy that he can get married without this document (This is long time consuming procedure1-3 months). He would need visa to enter Poland so you need to get zaproszenie for him and the visa. I would recommend you guys to get married in India which will take 1 month from the date of application for marriage. The documents are very simple for example passport and any other id proof which means 2 pieces of ID proof, Photographs, 3 witness and that all. After marriage is done there is long way to go to make all documents and for him to get residence card. Once you choose where you want get married I will give you detail info about the procedures for the particular country.

The amnesty for aliens who are illegally staying in Poland comes into effect on 1 January 2012. Foreigners who want their stay to be legalized will have to submit applications to the competent voivode. Applications may be submitted during a period of six months. Amnesty will be granted for a period of 2 years.

quantity depends on the price.

Prices starts arround 15zl minimum in India from a normal retailer plus cost of transport and taxes. I dont know if it would be worth bringing here or just buy from ikea or some other shops.

Good suggestion but I guess restaurant business is not this easy it requires a good cook and man power. Indian take away and delivery at home is good idea though.

Maybe import some products from India, some natural stuff which is hard to find in Poland and Europe.

Law / Obtaining National VISA - Poland insurance requirements [9]

As per my knowledge people who are employed in a company are covered with medical insurance along with his family. When your husband is applies for visa type D it is possible that he gets 3 months visa because once he is in Poland he can apply for residence permit which will be for one year. I would recommend you to speak with the embassy and ask for how long they should take insurance for as husband would be working for company n will have medical insurance from the company.

It is true that insurance has to be taken for all the family members because the day when you all will arrive you wouldnt have insurance because paper work takes some time so it is always better to have insurance to be on safer side.

you will most likely be shocked by the blindness and bureaucracy that you will find while trying to set up business in PL, as foreigner.

I dont have problems setting up a company here as I already have one, My wife is Polish and I am married here since almost 3 years so I know a lot about bureaucracy here :)

I am sorry to hear about your situation. I dont know about your story but it is not a easy decision for a women to do this unless it is some extreme situation. Anyways since your card is going to expire in a months time so I hope you have already applied for Karta Pobytu 45 days in advance. Divorce is not a easy procedure it takes time to get divorced and it is more complicated because you both will have a kid. Has she already applied for divorce? If no then you need to speak to her and explain her that kid needs father and mother both and life is not this easy how she thinks because she needs to leave all problem aside and think about kids future, I hope she will understand if not then you can get visa to complete your divorce. If you are working or studying you can also get your visa extension. I am not sure I read it somewhere that if you have a kid and if you are working then you can always get visa to stay and live in the country to be in touch with your kid and support your kid financially. I hope you sort out your things and everything be fine. Best of Luck

Since you have changed the university and already have a valid visa it shouldnt be any problem. I would also advice you to ask the new university to send a official letter stating that they have accepted you as a student in their university because your previous university would already sent a letter informing that you are no more student in their university, it would be safe. Also please check that this university is recognized because at times admission for some private schools are not considered for extending your stay in Poland. I hope this information helps you. It is an easy interview for couples who are genuinely married. Things they ask is usually about how you guys met how did you communicate, language of communication. When did your husband propose for marriage, date of engagement. About holidays together, Each others family members and there names, Description of house if he was at your place and where you live now, How did you guys spend your last weekend, Likes and dislikes. For you guys can be much easier as you are married for 3 years. You dont have to carry any documents or photos as they have already asked for what they need earlier. About interpretor depends from place to place, In Warsaw my friend took his brother in law, In Poznan & Szczecin they need professional interpretor. You need to confirm what they need exactly. They take interviews separately one by one and they want check if maximum number of your answers match with each other. Wish you best of luck :)

Law / Settlement permit (married to a Polish guy) [2]

To apply for permanent residence card (Karta Stalego pobyt) one has to me married and be living 3 years continously without a break of more then 6 months out of the country in one consecutive year. So in your case have to wait for another 1.5 years. I hope this helps.
