Law / How can I get Polish citizenship after been married to a Polish spouse [75]

According to the Polish Law 1962, a foreigner is eligible for Polish citizenship if he meets the following criteria:

1. he/she has been granted the temporarty residency
2. he/she has been married to a Polish citizen for at least 3 years
3. he/she made a relevant statement as to his/hers will of obtaining the Polish citizenship. Such statement must be made within 6 months from the day you have been granted the temporary residency or, alternatively within 3 years 6 months from the day you married a Polish citizen.

Wojewoda or Starosta are the authorities that have jurisdiction in cases like yours. In case you are living with your wife in Warsaw or its administrative district, the relevant authority will be Mazowiecki Urzad Wojewodzki. In case you live in Krakow, the relevant authority will be Malopolski Urzad Wojewodzki.

I would recommend you to check out their websites for office hours and other relevant information. You should enter the citizenship application process.

The law also provides that in special cases, the President can grant you the citizenship even if you do not meet conditions set forth by the Law.

According to the Polish law on citizenship dated February 15, 1962, you will be eligible for the grant of Polish citizenship in case you meet the following conditions:

a. you have been granted the temporary residency on the territory of the Republic of Poland
b. you have been married for at least 3 years with a Polish citizen
c. you make a statement before the relevant Polish authority that you want to become a Polish citizen. The statement must be made within 6 months from the day you have been granted the temporary residency, or, alternatively within 3 years and 6 months from the day you married a Polish citizen.

The authority relevant for all matters related to the grant of Polish citizenship on the basis of marriage to a Polish citizen is Wojewoda (Urzad Wojewodzki). For example, if you and your future wife will be living in Warsaw, or anywhere within the Mazovian Voivoidship, then you will have to go to the Mazovian Voivoidship, Department of Foreigners in order to settle all the issues related to the temporary residency, and citizenship. They are located at Plac Bankowy 3/5 and the manager of the office is called Mrs. Miroslawa Wozniak. If you are going to be living in Poland outside Warsaw or its administrative district, the authroity relevant for your citizenship issue will be always the Voivoidship (or Starostwo) of that district where you are living.
