UK, Ireland / Help with passport issue for my daughter [2]

My daughter is polish, born in poland and living in england with her mother (my wife) and her father lives in Poland. Our daughters ID card has run out and so we are looking to get her a passport. From what we understand we have to get her a polish passport and to do so we have to have the permission of the birth father or a court order stating it is ok. Does anyone know of any other options because her father is being difficult.
