I have to agree with this conclusion. The Family and Gaurdianship Code from 1965 is appalling to western thinking. Polands adoption of European friendly laws appear to be overidden by this document. How many procecutions are there for beating children are there in Poland annualy? It appears from the FGC it is appropiate to beat your children with anything that comes to hand as it is good for them. It also appears this document takes precedence over modern law.

Currently my Polish partner and I are experiencing the delights of the judicial system. My partners children were wrongfully retained by her husband on a contact visit. Not only were they retained but they were drugged and her son was nearly suffocated. It was only by luck he never became one of the many child killed by parent statistics Poland is generating at the moment. We presented documents to the court from a psychologist who interviewed the boy along with countless other information only to have back from the court "I have looked at the documents, but I'm not doing anything!". By chance we recovered the boy 5 days after the abduction but the daughter remains with a psycho who spends his day telling her "we must kill mummy", "Mummy doesn't love you. She didn't give me some of your birthday cake", "look how can your mummy love you. What has she done to me" We know because we have the flat bugged.

There is NO Law to PROTECT children in Poland. There is only Law to FORCE people to stay together. My partner and her son have escaped their beatings, hopefully the HC will work for her 4 yr old daughter. Sadly I have my doubts as 9 days ago we started a 7 day process to allow my partner access to her daughter at weekends and my partner is now being told, she has made trouble for herself in court, and of course we have no answer. The court even told her yesterday "off the record" that if she wants her daughter back, move back to Poland.

In my opinion her children will always be Polish in whatever country they live, and by living and experiencing another country, maybe one day they will go back and make Poland a better place. Try telling a Pole that!!

Ok it doesn't like returning to the US but UK has very little trouble with returns.

Unfortunately I am experiencing the Hague and Poland at the moment. It's not so bad but earlier posts on the court system are quite realistic. EAW's have been used in a Hague case in Poland. This was a case where a Polish woman returned to Poland from Holland and was ordered to return under Hague proceedings. She attempted to hide the children and was later subject to an EAW and returned to Holland.

Really all you have to do is ring reunite in the UK and they will give you the advice you require. Do it now!!


Not only can it happen; It will!!

The Hague Convention is simply a tool to bring two parties together in the same country where the child was habitually resident in order that custody can be resolved under the laws of that land. Combined with Brussells II it is very powerful. Poland has failed to implement the Hague in the past correctly but it is slowly improving as the old guard of judges retire. They have also been fined on several occassions I believe. Hague cases are dealt with at the High Court in the UK. In Poland they are dealt with at a local level and the judges recieve no or little training. Also the courts in Poland are open to outside influence. For example 2500 Euro can comfortably keep you out of prison.

Article 13b under the Hague provides that a minor cannot be returned to a place of danger but the operative words are "grave risk" which effectively means that the danger must be imminent or extreemely serious and must be proven as such. Statements such as my wife hits the children are not enough. It has to be proven. Countries such as the UK have resources available to competently manage the return of a child in this situation, so article 13b cannot be used against the UK. If article 13b is used for a non return in the UK, it classed as a judicial error and juristiction transfers to the UK under Brussells II and the case is heard in England and Poland would be duty bound to effect a return.

Wrong. It does not matter what country you live in or what nationality you are. The law in this case would be based on 'habitual residence'. Removal from habitual residence by one parent is only allowed when both parents enter into a formal agreement. Verbal would be insufficient as it opens the door to he said she daid. There are exceptions. For example if you left your partner and children in one country to return home it could be considered as "Aquiessance" and visiting the child in the country where you left them can be considered the same. To Aquiesse you would also have not tried, in any way, to get your partner to return with the child to the country of habitual residence. This does not prevent you from visiting the child, it just means you need to take precautions before doing so.

In this case the events would go like this

Hague application through Official Solicitor in the UK
OffSol makes formal application to Central Authority in Warsaw
Local Court recieves application and sets date - 2-3 months
First hearing - Every attempt to transfer to Polish process will be made
Second hearing - The abducter or retainer usually backs down as they know they can't win. For those that don't, often their legal rep will leave them to it

Third Hearing - Most likely the return order with 21 days to appeal (Mostly there is no grounds for appeal)

21 Days later the judgement is final and the child must be returned. If not this escalates into Police and Kurator visits and if this fails it is possible to apply for an EAW as in the Dutch case.

It is hard to argue this is a criminal act under Polish Law although it is possible, but, more importantly abduction and retention are criminal acts under International Law.

In certain circumstances Polish Law seems deficient in protecting childrens rights as well as parents overseas.

Retail appears to be very profitable in Poland.

For example a £5 T Shirt in the UK will cost you £40 in Poland. The identical product.

Why is this? The only conclusion I can draw from this and what I have seen in Poznan, is that big retail is controlled by a very few, very rich people. No competition.

I have considered openning a shop myself, but I have a feeling the consequences would be dire for an English man.

When looking at a house with my Polish partner, her Polish friend said "You don't want to move there. Polish people live next door!"

I really laughed but soon understood is was no joke by her expression.

The area in which I live is referred to as the "Polish Ghetto" by some Poles. Personally I find them unobtrusive apart from the parking arrangements and their lack of understanding as to why Polish children living in England should speak English. 6 VW Passats don't fit in the drive of a 3 bed family home.

I guess when your country loses it's identity like the UK, it becomes important to some of us. Maybe being born during the last years of the empire makes a difference. I can't say I miss Charles and Annes summer holiday on Blue Peter though. Spoilt buggers. It was a different England then. The village station master was a true racist. If a black person got off the train, he kept them there until the next train arrived.

Have you been to Leicester, Bradford or London. I read 2 years ago that in 2012 Leciesters poulation would be in the greater majority, Asian. Notice I made no previous reference to blacks other than to the 'Racist' station master. Please point me in the direction of your data. How can you say that is comparing apples with oranges. It's like for like.

Personally I would quite like to set up shop in Poland. I quite like the place really but I was advised it might not be safe to do so. As you say the Polish perception of some products is different to ours in the UK. If you were very selective on your products, I think there is huge potential in Poland. I spent pretty much the last six moths going back and forth to Poznan and having spent the 20 years buying and selling I don't miss much. The competition talked about exists mostly at the lower end of the market. The upper end looks to me likes it's controlled by a Cartel. I was researching shoes a month or so ago and one brand which was available in Warsaw only, was 600% higher in Warsaw than in it's native country. The brand escapes me now.

I would think with the growth in internet facilities (more people with computers so we don't light a fire) in Poland and peoples level of trust in Internet Commerce growing that these higher prices are not going to last forever. Things change.

I don't read the Daily Mail, I'm an Al Jazeera viewer. I prefer my news without a goverment slant on it. Britain for the British. I'm sorry again you are being a little slovenly. I am talking about being English not British. A subtle difference again.

I freely admit I have issues with Poland, but these issues pertain to Polish justice and not polish people although arrogance and being rude are not the most endearing of Polish male traits. If you live with one, you learn to accept the rest.

Ok here is an example for you so you understand what I'm getting at.

Firstly I spent over £5000 on legal advice in Poland in a two week period. Every penny was wasted because the lawyers we spoke too had no concept of Law outside of Poland and how international law overides Polish law. At that time I also had no concept of this.

Brussels II Bis (A convention signed by Poland) clearly states that if you are habitually resident in a country then you can start a divorce in that country. If you ask a Polish lawyer they will tell you it's impossible. In Poznan anyway.

Without checking back, I doubt I said everything in Poland as that would of been untrue. My work in Poland was to help our lawyer understand English Law and how International Law should be applied and is applied in other countries. Law is really not complicated but the language used often is. As you are more than likely aware, most of Polish law is based on the 1965 Family and Gaurdianship code. Much of which was forward thinking and much of which is outdated and aimed at keeping families together what ever the cost. The section on corporal punishment for children is quite shocking to western readers although this was updated in 2010 with an anti smacking law.

To put things into context for you, here is what happenned.

The childrens father brought them to England and on the same day beat his wife. (Regular Occurance in Poland)
She decided there and then the marraige was finished.
He agreed to leave the children in England.
Almost daily telephone conversations between father and children.
3 months later he visits children for 1 week.
Telephone conversations continue
Dec 2010 Children taken to Poland to visit Father
January 6th 2011 children were not returned and father dissapears for 3 days.
3 days later he contacts Police who do nothing as he has parental authority equal to the mothers.
Children are extremely distressed with the older child not speaking and banging his head against furniture and walls
Father thinks this is a romantic situation (deluded)
3 days later the older child is left with mother on condition she doesn't take him to a doctor
On advice from lawyer he is driven to Berlin and I bring them back to England.
Child is very distressed
Next day visit a Polish psychiatrist.
Don't believe what we hear. Both children are drugged for 3 days and on the first day one child had to be shaken to resusitate after father had held his hand over his mouth and the child had gone unconscious.

Psychiatrist confirms he believes its true as everything would be out of the childs experience and the conversation was totally natural.
Fly back to Poland with report in Polish and go to court 2 days later to try and get younger child back to safety.

Polish Court rejected all documents. This process took one and a half minutes. The judge was severely reprimanded by a higher court 3 months later

The Polish process to get out of this mess would take up to 2 years.

A mother and her son. You cannot win this one by simply disagreeing. The fantasy father son bond does not exist in this situation. The hand that feeds the sweeties will win.

You really have a tough decision to make and before you make it I would review things like child maintenance decisions in your locality. Decisions appear to vary from town to town. You will of course be portrayed as an alcholic, wife and child abuser in court and she will also attempt to remove all parental responsabilty from you.

Better to try and educate her about food using an indirect approach. Do you remember the series in England that showed parents what their children would look like as they grew older with the food they were being fed. My ex wifes shopping srategies changed the following day. I am positive my children benefited enourmously from this, both educationaly and physically.

Personally I would try at all cost to keep this relationship together, especially if you don't fight all the time, as your child is too young to understand, and is easily manipulated. The child will believe what it is told.

There are some amazing decisions made my Polish Courts.

I met a Polish guy at an airport in the UK who had to take his daughter back to Poland every week to visit the mother. How could this child have a normal life with freinds etc. Unfair on the child and a punishment on the father for living in the UK.

A woman that worked for me earning £1200 after tax had to pay £900 for one child. As if loosing her child wasn't enough.

Another woman who worked for me had 1000zlt awarded to her and 3 months later this was reduced to 100zlt. Her ex husbands situation had not changed and he was a very high earner for a native.

I haven't heard of any good ones but then you are unlikely to on the internet.

Of course I will be attacked now and numerous misguided comments will follow. Its normal.

If you step back in time to the comunist era when food was in short supply and if you had dollars you could buy anything. If you didn't you struggled and could only look in the window of the American shop. The general population could not afford the likes of sweets and sweet things. They were a rare commodity and a treat. Now they are considered a necessity by some Polish Mothers who justify it because they never had.

The tide is turning and the European malaise is coming.

Something I have found highly beneficial with SEO is hosting location. For example I used 1and1.couk for a period of time assuming they were located in the UK. WRONG and they weren't very good either. When I moved my .co.uk sites to true UK hosting then my search engine rankings improved dramatically. I did research this first of course. I am guessing hosting in Poland would be on a par with quality UK Hosting as regards price. Expensive but worth it.

It's totally relevent and a good proportion of your traffic will always come from the three locations mentioned. They are massive. In particular the Asians are making great use of the internet to search out potential customers. Just look at how google works now. Local this. Local that. In a way, unless you are a known International Brand, it is a bit like bricks and mortar, location, location and location.If you haven't signed up for Webmaster Tools do so.


Google hasn't used keywords in Meta tags for a long time. That kind of SEO died with the keyword stuffers. Remember the days you searched for chocalate and every site was a prn site. They killed keywords. True SEO will be gone in 5 years as Social Media sites will dictate search rankings which is why Google has invested heavily in +1.


This can be converted to useful visitors by taking a look at your Meta Descriptions which is what appears below the link to your site in Googles results. Writing good landing pages with relevant content and good Description tags is critical.


Thats exactly what I aim for but this takes time to evolve and relies on good content from your site. There are subtle ways of speeding this up but like anything to get a return you need to work hard and add a bit of lady luck.
