debit card via MasterCard rather than Visa

You mean "Maestro" vs. "Visa Electron"? I didn't know that. I have a debit card in EUR (Maestro) and in PLN (Visa Electron) from the same bank (ING)... And I have used both overseas. Better check and compare charges :)

Have your registered your marriage in Poland? If yes, did you show the embassy your marriage certificate issued from office in Poland?
Did you pay an application fee when you applied for the visa? If yes, how much?
How old are you, and how old is she?
Were you married to anyone else before? If yes, when did you get divorced?
Have you ever had a Schengen Visa before?

I am not a lawyer but I have done a lot of research on this subject. The story you told here is simply not complete.

If nothing else works, your wife must consult a lawyer in Poland.

I believe this is the problem (could not justify stay in Poland means exactly that), and this in particular strictly cannot be based exclusively on subjective impressions of consul (while other cases can be). He didn't provide full details, but I am reasonably sure the marriage is either not yet registered in Poland or not recognized in Poland altogether (multiple wives or marriage by religious authorities and not officially registered in Algeria etc.)

Absolutely right - do not hire a lawyer in Algeria and do not appeal in Algeria as the legal system in Algeria has no jurisdiction over foreign embassies. You will only irritate consul beyond the point of willful cooperation.

History / Foreigners in Poland - 1980-1983 [9]

I know someone from Lebanon that came to Poland in 1979 as a student of medicine. He stayed in Poland after he graduated where he worked as a doctor in Zielona Góra. He married a Polish woman (also a doctor) in 1990 and eventually the whole family moved away in 1998. According to him nobody bothered him whatsoever.

Listen up, I know that for an average American guy it may appear that this "exotic" Polish woman is sweeter and far more feminine than the average American woman, but once the novelty wears off (and it will one day) you will be left with an emotionally troubled person that you essentially pulled out of a marriage. And 12 years is practically a generation gap, and not just a small age difference. Even if she is not wise enough then you should try to be. She might be simply troubled by something.

@asn11 just out of curiosity, how old are you and how old is she? I add my voice to those that say don't do it. Nothing good can come out of having an affair with a married person, especially with a significant age difference. I have been there. Even if they have marital problems, you don't want to end up being the tool she used to find out (even without her knowing that she is using you).

You have to ask yourself what do you want. You want to have some fun, no strings attached? How can you be sure you won't feel attached? Also important, how can you be sure SHE won't feel attached? Too many questions? Too complicated? Better stay away.

Yes, you need to prove that you have been living in Poland, and if you are an EU citizen the only way to do it is with tax return forms or something similar because Poland does NOT keep records of entry and exit by EU/EEA citizens. On the other hand, if you were from outside EU/EEA then there would be an actual record of your entries and exits from Schengen zone.

Actually criminal checks are required per the code (they have to ask several security related bodies whether any of them has the foreigner in their database and wait 30 days for answer or no answer). Regarding income or work history, could it be a unique issue in Poznan?

@Roger5; The other lesson is that courts may very well rule in defiance of all reason and logic. Happy to hear you got your insurance sorted. I am with Liberty Direct, no reason why, just found their number and called. Never made a claim with them so have no idea how is their service.

ivpn71 I don't understand what you want to ask.

All the information I am going to provide here applies if and only If you you are married to a Polish citizen, your marriage is registered in Poland, and you have been married for longer than 3 years. You may apply for permanent residence if you meet the conditions set forth by the Act of 12 December 2013 on Foreigners, Section VI, Chapter 1, Article 195.1(4) which basically says you have to be married to your Polish spouse since at least 3 years, and you must have lived in Poland for 2 years, uninterrupted (as defined by the same act, Article 195.4), immediately prior to filing the application on the basis of a temporary residence permit given to you on the basis of your marriage to a Polish citizen (plus other possible basis that I won't go into).

Article 203.1 of the same act specifies the documents required for such an application, and a proof of income is not one of them, however a statement on tax obligations is required to prove that you have no arrears in terms of tax payments. Additionally, marriage certificate, birth certificates of children if any, and ID of the spouse will be required.

Upon having resided in Poland for 2 years (uninterrupted) on the basis of a permanent residence permit in this particular case a foreigner may apply for recognition as a Polish citizen. Proof of income is NOT a required document in this case. Proof of proficiency in Polish is a required document in this case.

@jon357 Old man K is certainly twisted, but not stupid. Although he does look more and more like a boiler going on overpressure and about to pop. The Dud on the other hand always had that boiler look going on. Let's see where the safety valves are set.

I'm not sure that he's going to last although we may well be stuck with him for one term of office.

Eventually, I suspect the most likely "exit" will be a falling out between him and his boss, as arrogance gets into one's head while frustration bites into the other.

I entirely predict at least one rant about Islam to divert from the fact that his "promises" won't get kept.

Exactly. Some might think that that will win them either votes from a certain group or forgiveness from pretty much the same group. Let's see how tough he will be facing the rest the world when/if that happens.
