No, consulates cannot give a work visa, Karta Polaka, or anything else to a Polish citizen because he/she has the RIGHT to live, reside and work in Poland. The citizenship petition is the only option, to declare his/her rights with the government.

You really are trying to argue a point that doesn't exist. Those without clear proof of Polish citizenship have no right to live, reside and work here, which is why the permanent residency through Polish descent option. It's the mechanism that's often used by Polish-Americans that retire to Poland.

Incidentally, consulates issue the Karta Polaka. You really ought to learn something about the laws in which you claim to understand.

The problem comes when someone is claiming citizenship through a grandparent, or great-grandparent, and there is some problem finding a document.

Which is why permanent residency is the option provided to such people that can prove that they are of Polish descent, but cannot prove it through paperwork. Incidentally, you cannot claim citizenship through a grandparent, as the line must be unbroken.

Those who never had to prove that claim clearly don't understand.

Those that actually understand the law know that the law provides for everyone of Polish descent as long as their ancestors had a link to Poland in some way. In the OP's case, permanent residency will be easily obtained to facilitate their legal stay in Poland.

Funny, the Polish lawyers I know, agree with that.

The consulates are directing people towards citizenship applications because they cannot grant residence permits. It needs to be applied for from within Poland, and consulates simply won't know about this provision as it's outside their competence.

Your Polish lawyers must be Ziobro's colleagues, because anyone with knowledge of Polish citizenship and residency law knows that the permanent residency/Karta Polaka mechanism is used to provide those of Polish descent a way to reside legally in Poland. In the OP's case, where Polish citizenship cannot be proved for various reasons, then the permanent residency application makes sense if they have a genuine connection to Poland.

No such thing. If you had read the rules on freedom of movement, states are perfectly able to deny entry if someone poses a danger to the public. In this case, he was coming with the intention of inciting others.

He won't win, as the law clearly allows refusal in the event of the person being a threat to public safety. You really need to learn more about Polish law. Those of Polish descent may apply straight away for permanent residency, which is often granted when there's clear proof that the family is Polish even if they don't have a right to citizenship. The Karta Polaka is a completely different device used when someone can claim Polish citizenship in theory, but cannot due to strict citizenship laws in the FSU.

If someone has a clear connection to Poland, such as Polish grandparents, they speak some Polish and they're active in Polonia organisations, permanent residency is normally granted without trouble.

Like many of your previous attempts to blame incidents on minorities in the II RP, it's again quite incorrect. The Polish majority in the II RP was openly hostile towards Jews throughout most of that state's existence, which is one reason why it deserved to fall.

Polonius, are you really so naive as to believe that PiS aren't riddled with people that also had such contacts? I mean - seriously - are you that brainwashed that you're willing to pretend that Interior Ministry local bosses wouldn't have had such contacts, or what about public prosecutors operating during martial law?

It seems to me that you're willing to tolerate people with close PZPR connections so long as they're now members of PiS.

And what is meant by "contacts"? Anyone in public life ended up having some type of contact with them (including JK I'd bet a small fortune).

I'd name names, but I'm afraid of those criminal libel laws. However, a lot of the current government come from nomeklatura families, and many of them only owe their position in public life through having prominent local families. One person in particular has three close family members that are known to be ex-PZPR, while many others had parents in good jobs as a result of their links with the PZPR.

The plot in this story as I read it is that her boyfriend has been a fictional owner (sole shareholder) of the company but the capital was her own from the very beginning.

If that's the case, she has no idea about how to run a company and he should run a mile. One of the most basic rules of opening an sp. z o.o. is that you always have two shareholders in order to massively reduce your ZUS bill.

The question of the OP is: can it be really at risk or not?

Absolutely. It's not the capital he has to worry about, it's the chance of being associated with fraud and by consequence, heavy-handed actions of the State.

Hiring health care workers in Poland at much less (almost 1/5th) then what you could in the U.S. could make life much better in Poland then in the U.S. for senior citizens.

Until of course, you have to deal with the things that make life much harder for them. Cheap health care is only part of the puzzle, as you also have to consider issues such as many Polish cities being covered in choking smog this winter. Winters can be long and harsh (snow at Easter is nothing unusual), city infrastructure is often incomplete or missing, and public bureaucracy can be intense if you're used to the Anglosphere way of doing things.

Of course, there are benefits like cheap health care, but who wants to live in choking smog in winter just for that?

The reality is that this is simply about seizing the assets of companies that aren't friendly towards the government. Criticise PiS as the owner of a large business? Expect your assets to be seized without trial.

They don't. If you knew anything about Poland, you'd know that Poland offers a very easy route for such people.

These migrants have skills, social security money to pump into Poland's economy, and most who are interested are old and will have to pay for someone to take care of them in old age.

They won't. They'll leave within months once they realise that it's not the land that they think it is. Poland is a tough place for older people, and it can be a very expensive place if you want to live somewhere nice.

Well this OP doesn't seem very interested in pumping money into Poland's economy, getting an in to the EU seems to be the primary focus...

Exactly, it's got nothing to do with Poland.

I wasn't aware that Polish law allows the debtors to pursue relations if it can be proven the debt was moved just for the purpose of evasion.

OK, for instance, do you understand Polish to know what you are signing? You could be placed as the 'representative' of the company, and with it, you could be listed as the one who has decision-making powers in the company. I can't explain this too well as it's a Polish concept, but it's possible that she could take on debts using your identity as the one who made the decision to take on those debts. For instance, let's say she orders something in your name. She doesn't pay for those goods, but when the time comes to pay, it's you that made the order on behalf of the company. That means that you will be held responsible, even though you thought you were only a shareholder and not a decision-maker.

That can then lead to criminal investigations, with your extradition to Poland to answer criminal charges, even for small amounts.

If she is honest, ask her to produce the financial statements from 2016 and 2015. That should be your first clue - if she refuses to produce them, then something is wrong. If you want, I can explain how to check some publicly available records which should give you insight into how the company is operating.

My strong, strong advice is not to get involved. I would be very reluctant to get involved, even as a Polish speaker living in Poland.

Run a mile.

Polish law is insane in this respect, and if you don't understand exactly what you're getting into, it's best to stay well away from it. There are various nefarious things that someone can do with you being a shareholder, and without you having a sound knowledge of Polish business law, it's wise to stay away.

She could simply buy the shares herself if management is an issue. If you know her company name, feel free to PM me and I'll tell you about any specific warning flags that I can find.

One does have to wonder about how desperately sad a male would need to be before he would boast about how much he enjoyed abused a woman whom he had never abused.

Remember that while he's playing the victim card up above about an employer allegedly being contacted, him and the poster known as "Deep" did exactly that to me. Seems to me as if he's delusional on more than one level, and that his only hobby is to obsess over moderators, administration, warnings and so on. The Admin made a decision to unban me, and anyone that's been on PF long enough knows that the Admin's decision is final and not worth debating.

Still, it's no coincidence that this forum has only one active female member with him around. Look here - he's already abusing a new female poster for no reason - polishforums.com/love/guy-cares-ladys-age-japan-80674/#msg1583201 - and he has the cheek to complain about me?
