TK judges

It's so simple. The imbroglio could easily be solved if the TK reconvened with the required quorum of 13, held their deliberations and passed their ruling which would then be 100% legal. Then the PM would publish it and the problem would be resolved. But the KOD/PO/PETRU/MICHNIK mafia want to keep the controversy simmering in the belief that maybe, perhaps, somehow the PiS government will collapse overnight and the opposition will be back at the trough.

There is no provision

There is no provision in the constitution allowing TK to function in violation of the law. They clearly broke the law by not having the legally required quorum of 13 judges, so whatever they adjudicated automatically became illegal. Some of Poland's best constitutional lawyers have explained all this.

Adjudication means to convene in accordance with the law and deliberate over a law to determine whether or not it is constitutional. So can a pre-adjucated law be regarded as unconstitutional a priori without such due adjudicaton? That is the question, because that is exactly what has happened i n thsi case. Adjudication cannot take place in violation of the law, and the PM cannot publish an illegally passed ruling. It's a simple as that!

A law is unconstitutional not a prirori but only after it has been ofifcially ruled so by the Tribunal functioning in accordance with existing, binding law. If everyone knew ahead of time which is law is constitutional and which is not, there'd be no need to waste taxpayer money on such a costly toga-clad gang. After all, the Supreme Court could easily double as a constitutional court without requiring an extra money-guzzler the likes of the TK.

But the TK must abide by existing, binding law before it can declare anything unconstitutional. Otherwise the declaration is illegal. And the latest ruling was indeed illegal, hence the government is under no obligation to print illict rulings.

Maybe not much but many times more than any other single grouping. It is the KOD gang whose noise, commotion and publicity-seeking has little suppprt outside their own mutual adoration society and the foreign bodies to whom they have snitched. PiS remains in the 37-40% range in terms of support whilst their vociferous detractors are in their mid-teens. The sustained rumpus is only turning Poles off. When TK-related reports appear on the evening news, mamy average Poles say "Not that stuff again!" and leave the room to have a smoke on the balcony or fix themselves a tea or snack.

During 8 years in power the PO/PSL government failed to heed nearly 50 TK rulings. And what happened? Nothing? No KOD marches, no hysterical headlines in the Michnik rag, no snitching to the EU, no Delph fuming and ranting 24/7. One wonders why that is? And why those who had effectviely ignored those TK rulings that didn't suit them have suddenly become "holier than thou" TK defenders. Isn't that called hypocrisy?

A law is unconstitutional only when declared so by a valid TK ruling, not a priori. No matter how much anyone squirms, the TK broke the law. Supporting such a TK is supporting a law-breaking body.

It was the RT clique that moved straight into III RP with all the benefits of the nomenklatura, whereas the bulk of the nation is still lodged in PRL. With one excpetion: they are now free to work as dish-washers and nannies in Britain, Germany and elsewhere.

The RT establishment passed the goodies onto their chidlren, known as the "ministerial kids". It is estimated that 80% of the top fortunes in Poland belong to former SB collborators. Funny that Schetyna fails to mention that when he snitches to the EU to effectviely defend the continued monopoly of the SB-ocracy.

That's what the TK is for -- to rule on constitutionality. If ther Sejm could pass only constitutional laws (for instance if the Convent of Seniors or its Presidium saw to it), there'd be no need for the TK. The law you described would be declared unconstitutional after it was passed by the Sejm and Senate and signed into law. But the TK could not make that or any other ruling on the basis of an outdated and no-longer-binding TK law, as was the case in this instance.

PiS won't budg

...And the opposition rejects dialogue and compromise. It's like two stubborn jackasses facing off, each too pig-headed to step back.
And, viewing things from a Machiavellian persepctive, it's actually in both sides' interest to keep the controversy going. For the opposition the overrding dream of returning to power fans the hope that the protests and foreign interference will wear the government down and somehow bring the RT establishment back to their "rightful" place at the trough.

For PiS, to slacken means and give in and lose some of its iron-clad electrorate which thrives on upstaging and exposing the reds and pinkos and pursuing a hard anti-corruption and Smolensk line.

The TK resolution was passed in violation of the law. It is the Sejm that enacts laws which are valid and legally binding until delcared unconstitutional. No body is free to invoke a defunct or unamended law as the basis of its ruling. Of all bodies, it is the TK that first and foremost should act according to the law, not in violation thereof.

Why can't PiS simply respect the law

Why can't the TK simply obey the law? The government's TK reform was valid under the presumption of constitutionality until ruled otherwise and should have been the basis for the TK's ruling. But the TK violated it by having only a 12-judge panel rather than the requried 13. So right off the bat the TK disqualfied themselves from being entitled to hand down a valid ruling. It's as simple as that. If they rescind their ruling and reconvene with 13 judges, only then will their ruling be legal and binding.

Anyway, how can the TK stand in judgement over themselves. It's like an accused murderer presiding over his own case. There should be someone else, the Supreme Curt or other body to rule in such cases.

Venice toldl Poland the TK issue should be resolved in Poland through dialogue and compromise in parliament, since it was parliament that was responsible for both sets of illicit appointments that started the whole row. PM Szydło has invited all parliamenatry groupings to dialogue but the offer has been turned down. Schetyna prefers to defy the VC's recommendation to resolve the issue in Poland and wants to drag it out into the international forum. He was shown on Friday agitating Merkel to support him.

In fact, they were not incontinent oldsters but those mainly in their 20s that were protesting about not getting paid. The old ex-commies and other RT types are marching in defence of the trough they got opushed away from when PiS became the first democratically elected party since 1989 to claim an outright election victory with no need for coalition building.

PiS TK law is valid

Yes, it remains valid because the TK acted illegally when declaring it unconstituional. The PiS TK law enjoyed the presumptuion of constituionality until otherwise validly ruled by the Tribunal. In other words, the TK was obliged to follow the then binding PiS-enacted law to make their ruling valid, but they didn't. With only 12 judges they were one short of what was legally mandated, hence their ruling was illegal. Had 13 judges been present, their ruling would have been legal and binding. The trough-defenders in typical commie fashion have turned things round and claimed the government was in violation of the law.

Not only is KOD leader Kijowski behind in his child-support payments but some KOD demonstrators are allegedly complaining about not getting paid on time for taking part in the demos. 100 zł is said to be the typical stipend, but KOD coordinators can count on from 400 to 900 zł. George Soros is reportedly bankrolling the paid demonstrators.

As I understand it the SV project was launched in the 1970s by local community leaders, businessmen and residents to stem the further slumification of an older ethnic neighbourhood. Store fronts were given Tatra Mt effect wooden trim (gables, balconies, shutters) and new businesses and families began moving into the area. The annual festival attracted thousands from miles around and for a time the neighbourhood appeared to be flourishing. My question is: at what point in time did the re-slumification process begin and why?

Delph, don't be so harsh on PiS. Sincere dialogue and oompromise is needed in Poland not more of the Polish-Polish warfare first launcehd by PO in 2005. We can all see that has been a dead-end street wasting prescious time, effort, air time, newsprint and people's nerves.

Scroll back to the exit polls. The youngest voters supported PiS. Also parts of Poland that had traditionally been PO country voted for PiS. Only two regions, I believe, bot in the post-German territories had a majority of PO voters. One can interpret that as one wills, but there's no denying hard facts.

People voted PIS

Perhaps so, but why did most young people choose PiS? Young people tend to be more idealistic than their middlee-aged paretns. That came as a shock to PO because they failed to understand they were viewed as the "establishment". Their ACTA debacle also came as a shock. And Trump? He is viewed (rightly or wrongly) as anti-establishment, and that cuts ice with more and more people these days. Big government, big media and big business (in Poland's case foreign big business) are out only for themselves and their cosy status quo. All the high-sounding rhetoric about human rights, freedom and demcoracy is so much window dressing to gull the naive. Establishments are regarded by definition as corrupt and self-serving. In Poland the estbalishment is the post-RT clique as represented by the KOD leadership, Petru, PO, the Michnik camp and foreign interest lobbyists.

Of course there are such people. Many of those wlling to turn a blind eye to the RT establishment's monopoly and jump on their bandwagon were able to get ahead. Every system needs its go-with-the-flow crowd of opportunists and useful idiots who create the illusion of mass appeal. But the bottom line is that the majority of the Polish nation have been left out and the clique have received far more than they deserve. That's called injustice.
