Life / will he be 'caught' by the government for the army if we go to Poland? [7]

My husband was studying in Poland many years ago so he was exempted of the army, but he didn't finish what he was studying and came to the United States and is still here, not legal. He will be 29 this year.

Will he have any problem if we go to Poland or any other country of the UE next year because of the army?

USA, Canada / Will be marriage in USA valid in Poland? [2]

My husband and I have been married for almost 1 year here in USA and we are collecting the documents necessary for registering our marriage in Poland and Brazil.

I've read that to start the process to get the Polish citizenship we need to be married for at least 3 years, plus being living in the country, but we are still in USA.

Anyways, just talking about the MARRIAGE years, will this first year married under the American laws count in Poland or just will start count when we finally register it in Poland?
