If anyone has bought in Oak teraces phase I or II in katowice could you please contact, king.jeffrey@gmail, who has also bought there .......with a view to working together on fit-out and renting and possibly some other cost savings at this difficult time.

If anyone knows anything about the sale potential of this development please let me know also.

Welcome Dan,Jeff...
Both myself and Jeff have started to work together a little to share some information. I have one ..one bed apartment in this development which I am currently not sure about due to personnel circumstances and have been looking to sell/reassign but it seems its not really possible at this time and may need to default on the 20%!!!. Big loss... Would be willing to do a major deal though.

Would have liked to have kept it but this moment its does not seem possible.

I think the idea of getting at least a few together to keep fit out cost down and share rental opportunities for those that can complete is useful.

I also believe that there are people out there that would want some good deals also!!!!. Are there others looking at having to default on their deposits??

Maybe Dan and Jeff are willing to share in Nierozumiems suggestion to extend contract closing date. Maybe you (Dan and Jeff) have some more ways of getting others in the same situation into this forum to share this.

Its good to see there are some people that really wish to help and not just complain on this forum. I have got some good contacts through email and if more wish to share this I recommend they contact me on this email king.jeffrey@gmail.

The credit crisis is tough on most people but there seems to be a way to minimise the burden through useful sharing.

Glad to hear from an independant investor that the Katowice development is a good investment... I was starting to feel somewhat duped by PS.

I visited Oak terraces recently to view my apartment 38m2 corner with balcony.....This is a very well finished development in a very good location close to the city center and right beside a big shopping center (Silesia). Both inside and outside its well finished. Spacious area around apartments also and 24hr security. Walk to center in about 15 minutes or tram outside apartment building..

The apartments themselves were very surprisingly well finished inside.

Long term I believe this is a good investment from what I've seen and whats happening around Katowice and whats planned. etc.

We spoke to a guy in the sales office there. He said there were about 50 apartments remaining to be sold in phase II. 500 in total between I and II. The average price is about 6200 pln/m2 but sometimes 5900 for larger ones over 55m2. The smaller ones around 38m2 were most expensive or corner apartments with balcony going up to 6600pln/m2. (are they being sold?.. I dont know.)

The third phase is on hold which means there is probably currently some concerns about demand. This however is only good as it keeps the price stable until demand increases. Rent seems to be able to cover investment..( interest only) but there seems to be no good information available for new builds there yet for rent. There will be a new office block built just across the road but the details are not finalised as to what companies will use it. If this goes ahead it would be a great benefit for company long term rental contracts.

SPC : have you paid the 10% deposit for Rednet fitout or have you accepted the higher price offer?.

We are currently in discussion also through email with a few others so maybe you can send an email to king.jeffrey@gmail .... we have a few that are planning a conference call about the issues you have brought up and have been able to share some important information so far.....with people that are in the same position.

We are also discussing the legal issues associated with this for contract extensions and other issues.

Also Hi all,
Does anyone know anything about the polish law in relation to civil code Article 394 for earnest money. Any translation or something. (for those that managed to translate "fit-out" it may be interesting). This is a clause in a lot of contracts for property purchase and in this case also with oak teraces.

there are 2 forms of deposit that can be paid in Poland; one is a 'zadatek' which is covered by this clause, the other is a 'zaliczka'. Your notary act will say which it is.

Hi all....Has anyone experience working with TGC lawyers. in Warsaw....Have they a good record. Currently they seem a little slow to respond to all our questions.

Maybe they are getting busy with all this at this moment. Maybe we should send just one correspondence so we can get group answers.

Lawyers are now requesting builders for extension on multiple apartments as we have requested.

There is also now the question of morgages for those that still need them. Who recommends the best place for morgages (related to this topic)......Lots of companies say they can but to spend three months giving paperwork and then get refusals. Suggestions welcome.

you will only probably be able to get 10% back if you default. This is what the contract and lawyers have confirmed for others.

I am also curious however about the 7% VAT which is included in the 20% deposit (ie paid down on preliminary contract 20% plus 7% VAT) . Since VAT should only be paid if the contract goes ahead then this VAT should be returned. Maybe there is someone that can advise better on that.

My post on the PS forum was to do with attempting to gauge the interest level in regard to a builder I've worked with before in the UK with Polish family connections to bring a group of Piastow apartments to white finish level.

Neill can you pass on your contact details please.

Morgages have been applied for so waiting for response and will let you know of service level.

I haven't payed the 10% for the full-fit yet. I've kind of put everything on hold since I haven't yet decided what do do, keep it and rent it out, or just drop it and try to get the 20% down-payment back?

Matt have you started to find out the legal issues of getting your money back?. You can also contact us if you need to talk more on this as at least one other person in group is looking at the same..
