How much should American dad that makes 407k PLN pay in child support?

If an American dad makes around $120,000USD/yr (which is almost 407,000PLN), what would he be expected to send to Poland for child support for a 5 year old?

This dad has 2 children, 1 that lives in the USA with the mother, and the 5 year old is in Poland with that childs mother. The Poland mother lives at home with her parents, so she doesn't have any rent expenses.

Currently he sends $410USD = 1390PLN to Poland every month.

Do you feel that is sufficient for a mother who lives at home in Lublin with her parents?

Furthermore, if the Polish mother ever pursued him legally, would she be entitled to more/less/same?

In the USA they go by a formula, which is generally 18% of the fathers gross income and there's a maximum limit for each income bracket. Is there not a formula like this for Poland? I tried searching for one and that's how I ended up here :-)

No idea about the legalities but my gut tells me you'd be entitled to more than 1300 zl. a month :)

I'm the American mother, not the Polish one ;-)

I'm just trying to get an idea of what would be considered equal disbursement of support between both of us, when taking into consideration each living situation.

OR, even just having an understanding of roughly how much a 5 year old in Poland costs per month (for food, clothings, toys, etc) would be helpful to figure out what would be an equal share.

Does USA law does not apply to him now? Shouldn't he pay the mother the amount regulated by American law? He lives there im the end.

I am actually curious how this works.

My uncle found out he has a 20 year old son a few years ago and has been having to pay child support.

Apparently, since his son isn't working or doing anything he is still required to pay child support even though (to me) he is considered an adult?

Yes.

The Polish courts wouldn't suggest much or any more - that's a modest but ordinary wage in Lublin.

We're in the middle of a battle for that right now :-) Which is why I was curious as to whether what he sends right now is sufficient to raise a 5 year old. Because I want to make sure that whatever he ends up having to pay me doesn't take away from what he sends her.

@MHR - be careful, something tells me that they will go for the gold and try to get as much as they can off your husband.

1300 PLN might be OK with Polish husband, but to be honest, it is very low amount of money. A more fair amount would be more like 2500 PLN, the fact that the mother lives with her parents should be irrelevant, She might not afford anything else. On the other hanh, child not be treated as source of income.

In any case - fair in my view would be anything between what he is paying now and 2500 PLN, do not let them hope for more.

I've heard somewhere that parents have to pay for children as long as they learn at school or study and in Poland probably maximum up to 26 birthday.
