USA News and Poland - part 8 [1465]

Any first year law student can tell you that what individual courts are trying to do is simply illegal. Most importantly, State courts do not have the authority to rule on Federal Laws and Constitutional issues. Thats why the local Federal courts, appeals courts, and the USSC exist. The USSC will blow up these states decisions or rulings.
More importantly, Trump has not been convicted of "insurection" and I dont think he can or will be. He asked people to calm down and go home publicly. Trump also asked for National Guard and more police before January 6. No one was armed, no alleged fake electors made it to cast a vote anywhere, and Mike Pence did his constitutional duty. While Trump probably should have been earlier to tell people to go home, and maybe could have kept things calmer, that is all conjecture. The main point is that, there has been nothing I have seen that says implicitly that Trump ordered people to forcefully take over the capitol, and sieze power. There is no smoking gun, and no direct orders. He will never get convited of insurection. A conviction under the insurection clause is required, and until that happens, the Democratic agenda of taking power by trickery will die. 10.5 months to go.
